entence of imprisonment could not usually be passed for a period of more than two years (see Halsbury 2nd Ed. paras. 319 and 320)\hich\af0\dbch\af31505\loch\f0 . These two forms of punishment were inherently dif}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 
\fs24\insrsid1382144\charrsid5272673 \hich\af0\dbch\af31505\loch\f0 ferent. A sentence of penal servitude was never the same as a sentence of i\hich\af0\dbch\af31505\loch\f0 
mprisonment in England. It was apparently for this reason when the Criminal Justice Act 1948 was passed in England, by which the punishment of penal servitude was abolished, that by the provisions of Section 83, and Part 1 of the 10th Schedule to the Act,
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 
the provisions of sections 6 to 30 of the Forfeiture Act 1870 were repealed. Further it was apparently considered necessary expressly to provide, by Section 78 and the transitory provisions of the 8th Schedule of the Criminal Justice Act 1948, that person
\hich\af0\dbch\af31505\loch\f0 s\hich\af0\dbch\af31505\loch\f0 
 who at the commencement of the Act were undergoing a term of penal servitude should in future be treated as if they had been sentenced to imprisonment. It appears to me that this would not have been necessary had it been that a sentence of imprisonment w

 Defendant had not taken any steps to get these matters completed by 22nd May, 1956, it would not have made any difference because the 2nd Defendant himself could have taken the necessary steps to effect them notwithstanding the opposition of the Plaintif
