to the affidavit in support of the application nor does he have any instructions in respect of the summons for summary judgement. However he informed the Court that he still wishes to remain on record, the matter was then adjourned for hearing on the summ
ons on the 2 October 2009 and the defendant\rquote 
s solicitor was then directed to obtain further instructions or there may be judgement against his client. At this point it should be noted that there was no indication from either the defendant nor his then solic

of the view that the rules were followed correctly prior to the granting of the application for default judgement}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\lang2057\langfe1033\langnp2057\insrsid10964182\charrsid10385969

\f0\fs24\insrsid4146670\charrsid10385969 ould be no judgement whatsoever.}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid3177449\charrsid10385969  }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid4861689\charrsid10385969 
In other words it was entered for too much or more than the amount guaranteed. }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid10964182\charrsid10385969 The plaintiff on the other hand submits that notwithstanding clause 15 the plaintiff is still

\b\f0\fs24\insrsid12672025\charrsid10385969  payable under the guarantee}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid11682867\charrsid10385969 \'94}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid12672025\charrsid10385969 
 in clause 15 refers to the judgement debt}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid14354998\charrsid10385969  which could be recovered }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid12672025\charrsid10385969 and }{\rtlch\fcs1 \af0\afs24

itself. That is, the judgement debt under the guarantee can be any amount. And further the fact that this is limited to his assets in Fiji }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid14354998\charrsid10385969 by the proviso }{\rtlch\fcs1

Therefore the judgement debt can be obtained for any amount but that the recovery or the enforcement of which is limited to his local assets. }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid15297923\charrsid10385969

. His counsel appeared when the summons for summary judgement was first called and obtained 
further time to file an affidavit in opposition. This too did not happen. Although there is no evidence put before the Court in regards to his medical condition or that he had a coronary by-pass at the time I do not doubt that the defendant may indeed hav
e suffered this condition at the time. But I am of the view that he had ample time to instruct his then solicitor to file a defence}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid11806885\charrsid10385969
