e purchase of the clock from Motibhai & Company Limited was not approved by the Board of Directors on 2 April 2003. T\hich\af0\dbch\af52\loch\f0 he first accused \hich\af0\dbch\af52\loch\f0 obviously \hich\af0\dbch\af52\loch\f0 knew that the Board had 
\hich\af0\dbch\af52\loch\f0 not approved the purchase of \hich\af0\dbch\af52\loch\f0 any\hich\af0\dbch\af52\loch\f0  clock on 2 April 2003.\hich\af0\dbch\af52\loch\f0  \hich\af0\dbch\af52\loch\f0 I also find that t\hich\af0\dbch\af52\loch\f0 he first 
\hich\af0\dbch\af52\loch\f0 accus\hich\af0\dbch\af52\loch\f0 ed did not have\hich\af0\dbch\af52\loch\f0  an honest and reasonable but mistaken belief that the purchase of the clock was part of a capital exp\hich\af0\dbch\af52\loch\f0 
enditure approved by the Board.

\par \hich\af0\dbch\af52\loch\f0 [12]\tab \hich\af0\dbch\af52\loch\f0 I accept the evidence of \hich\af0\dbch\af52\loch\f0 the procurement officer, Luke Narara \hich\af0\dbch\af52\loch\f0 that \hich\af0\dbch\af52\loch\f0 the \hich\af0\dbch\af52\loch\f0 
Logistics Management Procedure\hich\af0\dbch\af52\loch\f0 s \hich\af0\dbch\af52\loch\f0 contained in the Post Fiji Corporate Governance Manual \hich\af0\dbch\af52\loch\f0 applied to the purchase of the clock. \hich\af0\dbch\af52\loch\f0 
It does not matter that the Manual was not approved by the Board of Directors or the Ministry of Public Enterprises. What matters is that the procedures were acc\hich\af0\dbch\af52\loch\f0 epted to be applicable at the relevant period.

\par \hich\af0\dbch\af52\loch\f0 [13]\tab \hich\af0\dbch\af52\loch\f0 I am further satisfied that the ex\hich\af0\dbch\af52\loch\f0 ceptions for \hich\af0\dbch\af52\loch\f0 the \hich\af0\dbch\af52\loch\f0 tender procedures\hich\af0\dbch\af52\loch\f0

I do not think the need to install the clock before the South Pacific Games or the fact that \hich\af0\dbch\af52\loch\f0 P\hich\af0\dbch\af52\loch\f0 rouds was \hich\af0\dbch\af52\loch\f0 the \hich\af0\dbch\af52\loch\f0 
sole agent for Seiko clock in Fiji were circumstances to justify deviating from the tender procedures.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid7031004 \hich\af0\dbch\af52\loch\f0  }{
\f0\fs24\lang2057\langfe1033\langnp2057\insrsid7031004\charrsid7031004 \hich\af0\dbch\af52\loch\f0 I feel sure that the \hich\af0\dbch\af52\loch\f0 first accused acted despotically\hich\af0\dbch\af52\loch\f0 
 by not calling for tenders for the purchase of the clock.

first accused denied any knowledge of the existence of the Manual that contained the tender procedures. The evidence of Susana Naiwasetawa is that on 8 April 2003 the first accused himself issued a circular to all the staff to understand the Manual. I fin
\hich\af0\dbch\af52\loch\f0 d\hich\af0\dbch\af52\loch\f0  the denial of knowledge of existence of the Manual was a deliberate lie.
\par

When the first accused said to him that the se\hich\af0\dbch\af52\loch\f0 cond accused wanted to supply the clock, Naidu felt obliged to comply with the suggestion.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid7031004 \hich\af0\dbch\af52\loch\f0  }{
\f0\fs24\lang2057\langfe1033\langnp2057\insrsid7031004\charrsid7031004 \hich\af0\dbch\af52\loch\f0 He facilitated the clock from Motibhai & Company Limited because in his mind \hich\af0\dbch\af52\loch\f0 that is what both accused
\hich\af0\dbch\af52\loch\f0  \hich\af0\dbch\af52\loch\f0 persons \hich\af0\dbch\af52\loch\f0 wanted him to do.

He struck to me as a genuine and honest witness although he appears to be a person who pleased othe\hich\af0\dbch\af52\loch\f0 rs\hich\af0\dbch\af52\loch\f0 .\hich\af0\dbch\af52\loch\f0

\hich\af0\dbch\af52\loch\f0  evidence that he only came to know \hich\af0\dbch\af52\loch\f0 that the clo\hich\af0\dbch\af52\loch\f0 ck had been purchased from Motibhai\hich\af0\dbch\af52\loch\f0  & Company Limited in June 2003 implausible.

I feel sure that the second accused directed the purchase of the clock for Post Fiji Limited from Motibhai & Company Limited. Naidu may have gained from the purchase by calculating a fee on $75,000\hich\af0\dbch\af52\loch\f0 ,\hich\af0\dbch\af52\loch\f0 
 b\hich\af0\dbch\af52\loch\f0 ut on the second accused}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid7031004 \hich\af0\dbch\af52\loch\f0 '}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid7031004\charrsid7031004 \hich\af0\dbch\af52\loch\f0 s 
\hich\af0\dbch\af52\loch\f0 own \hich\af0\dbch\af52\loch\f0 admission \hich\af0\dbch\af52\loch\f0 in court, \hich\af0\dbch\af52\loch\f0 Motibhai & Company Limite\hich\af0\dbch\af52\loch\f0 d also made a profit of $1600\hich\af0\dbch\af52\loch\f0 .
