that the items were seized by the First Defendant\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 in the co \hich\af0\dbch\af36\loch\f0 u\hich\af0\dbch\af36\loch\f0 r\hich\af0\dbch\af36\loch\f0 se of \hich\af0\dbch\af36\loch\f0 their investigation\hich\af0\dbch\af36\loch\f0 s\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 on the strength of a search warrant.\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 It is further stated that the matter was directly under the carriage of the Director of Public Prosecution \hich\af0\dbch\af36\loch\f0 and a directive or court order was not given for the release of the seized items.\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 The Affid\hich\af0\dbch\af36\loch\f0 avit also states that the First Defendant believes that the detention of the items was lawful and the Office of Director Public Prosecution had a legitimate reason for the retention of the items.}{\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 \par }\pard \s15\ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid136500 {\f0\fs24\insrsid136500\charrsid136500 \par \hich\af0\dbch\af36\loch\f0 Counsel for the Defendants clarified at the hearing that \hich\af0\dbch\af36\loch\f0 three computers were seized and not three hard drives as stated in paragraph 12 of the Affidavit in Reply of Sgt Jese Raicebe. \par \par {\listtext\pard\plain\s15 \lang2057\langfe1033\dbch\af36\langnp2057\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 5.\tab}}\pard \s15\ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin0\itap0\pararsid136500 { \f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 On 12 March,2009,\hich\af0\dbch\af36\loch\f0 upon an application by the Defendants, the}{\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 Court \hich\af0\dbch\af36\loch\f0 had \hich\af0\dbch\af36\loch\f0 granted leave to make the Director of Public Prosecution\hich\af0\dbch\af36\loch\f0 a party Defendant\hich\af0\dbch\af36\loch\f0 in\hich\af0\dbch\af36\loch\f0 this case, \hich\af0\dbch\af36\loch\f0 for documents to be served and \hich\af0\dbch\af36\loch\f0 the}{\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 All these were taken away and kept from his use for 5 years 9 months even though in his trial in the Magistrate Court, \hich\af0\dbch\af36\loch\f0 none of these items were tendered as exhibits.}{\b\i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 }{\b\i\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 I note that despite the court order made by the learned Magistrate that these items be released to the respondent, it is still not done.}{ \i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 " \par }\pard \ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid136500 {\i\f0\fs24\insrsid136500\charrsid136500 \par }\pard\plain \s15\ql not returned to him as soon as it was established by the police that they would not be \hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 used as exhibits in the trial, as it later turned out.}{\b\i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 }{\b\i\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 This is an abuse of the criminal procedure process and it cannot be condoned}{\i\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 .}{\i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 " \par }\pard \ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid136500 {\i\f0\fs24\insrsid136500\charrsid136500 \par }\pard\plain \s15\ql \li720\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid136500 \fs22\lang2057\langfe1033\loch\af36\hich\af36\dbch\af36\cgrid\langnp2057\langfenp1033 {\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 At paragraph 57;}{\f0\fs24\insrsid136500 \par }\pard \s15\ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid136500 {\f0\fs24\insrsid136500\charrsid136500 \par }\pard\plain \ql by counsel for the appellant that the primary reason f\hich\af0\dbch\af36\loch\f0 or pursuing this appeal against the respondent was the need to obtain a High Court determination on certain legal issues raised by the Magistrates Court decision, for future guidance in the novel area of copyright law prosecution.}{ \i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 }{\i\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 In my view it is unfair \hich\af0\dbch\af36\loch\f0 to take the}{\i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 }{ \i\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 respondent through another procedure}{\i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 }{\i\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 where the continuation of the breach of his rights continues.}{\i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 }{\i\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 It seems to me the fairer approach is for the State to accept the decision of the Magistrate Court and ask the Magistrate Court to state a cas\hich\af0\dbch\af36\loch\f0 e to the High Court under Sections 329 to 339 of the CPC, covering the issues of law for determination.}{\i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 }{\i\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 In that way the respondent does not have t\hich\af0\dbch\af36\loch\f0 o\hich\af0\dbch\af36\loch\f0 live under a cloud of suspicion and stress}{\i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 "}{\i\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 .}{\i\f0\fs24\insrsid136500 \par }\pard \ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid136500 {\i\f0\fs24\insrsid136500\charrsid136500 \par }\pard\plain \s15\ql \li720\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid136500 \fs22\lang2057\langfe1033\loch\af36\hich\af36\dbch\af36\cgrid\langnp2057\langfenp1033 {\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 At paragraph 64;}{\f0\fs24\insrsid136500 \par }\pard \s15\ql person.}{\i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 }{\i\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 I speak first of their power to seize or detain goods.}{\i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 }{\i\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 This was considered by this court in Chic Fashions (West Wale\hich\af0\dbch\af36\loch\f0 s) Ltd v Jones [1968] 1 All ER 229, [1968] 2 QB 299.}{\i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 }{\i\f0\fs24\insrsid136500\charrsid136500 detain the goods for such time as is reasonably necessary to complete their investigations into the theft or fraudulent obtaining.}{\i\f0\fs24\insrsid136500 \hich\af0\dbch\af36\loch\f0 }{\i\f0\fs24\insrsid136500\charrsid136500 \hich\af0\dbch\af36\loch\f0 If their investigations indicate that the goods have been stolen or fraudulently obta\hich\af0\dbch\af36\loch\f0 ined by deception, the police can detain them further so that they can in due course be restored to their rightful owner and, where necessary, be produced as material evidence at the trial of an accused
