Court at Lautoka this appellant entered a plea of guilty to one charge of escape from lawful custody and a plea of not guilty to a charge of serious assault.\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 On the 23 \hich\af0\dbch\af37\loch\f0 rd\hich\af0\dbch\af37\loch\f0 August 2010 a set of facts (i\hich\af0\dbch\af37\loch\f0 ncluding facts relating to the assault) was read to the appellant who then admitted them.\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 The Magistrate thereupon said \hich\af0\dbch\af37\loch\f0 "\hich\af0\dbch\af37\loch\f0 I convict the accused\hich\af0\dbch\af37\loch\f0 "\hich\af0\dbch\af37\loch\f0 . \par \par \hich\af0\dbch\af37\loch\f0 2.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid5078873 \hich\af0\dbch\af37\loch\f0 passed sentence, sentencing this appellant for both the escape \hich\af0\dbch\af37\loch\f0 and the assault to six months imprisonment and nine months imprisonment respectively, to be served \hich\af0\dbch\af37\loch\f0 that the appellant had a legitimate defence to the charge which he was never permitted to raise in a proper hearing. \par is ambiguous but in any \hich\af0\dbch\af37\loch\f0 event I now quash the conviction \hich\af0\dbch\af37\loch\f0 (if so convicted) \hich\af0\dbch\af37\loch\f0 and sentence passed on the appellant in passed on him for esca\hich\af0\dbch\af37\loch\f0 pe from lawful custody (6 months).\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 In November 2008 the Fiji Court of Appeal delivered a judgment in }{\b\f0\fs24\ul\lang2057\langfe1033\langnp2057\insrsid5078873\charrsid5078873 \hich\af0\dbch\af37\loch\f0 Viliame Tuibua}{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid5078873\charrsid5078873 \hich\af0\dbch\af37\loch\f0 (AAU 0116.2007S) which carefully analysed the appropriate tariff for escape offences; the Court said: \par }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid5078873\charrsid5078873 \par }\pard \ql \li720\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5078873 {\b\f0\fs24\lang2057\langfe1033\langnp2057\insrsid5078873\charrsid5078873 \hich\af0\dbch\af37\loch\f0 "\hich\af0\dbch\af37\loch\f0 In order to assist uniformity and c\hich\af0\dbch\af37\loch\f0 onsistency \hich\af0\dbch\af37\loch\f0 in sentencing\hich\af0\dbch\af37\loch\f0 for the offence of escaping from lawful custody, we feel it appropriate to state that a sentence of between 6 and 12 months imprisonment\hich\af0\dbch\af37\loch\f0 is an appropriate usual tariff for this type of offence.\hich\af0\dbch\af37\loch\f0 " \par }\pard \ql Magistrate for the escape offence was not only within the proper tariff for the offence, but was leniently at the bottom end of the appropriate range.\hich\af0\dbch\af37\loch\f0
