}{\b0\fs24\insrsid13907272 \par }{\b0\fs24\insrsid9133792\charrsid5636699 \hich\af0\dbch\af37\loch\f0 13.\tab It appears \hich\af0\dbch\af37\loch\f0 that the learned Magistrate, who presided court on 20.07.2009, ha}{\b0\fs24\insrsid7567104\charrsid5636699 \hich\af0\dbch\af37\loch\f0 d}{ \b0\fs24\insrsid9133792\charrsid5636699 \hich\af0\dbch\af37\loch\f0 fallen into error when he adjourned proceedings for 26. 10.2009 without proceeding to convict the accused after the plea of gu\hich\af0\dbch\af37\loch\f0 ilt was tendered. It is mandatory under Section 174 (1) and (2) of the Decree to enter an order of conviction and to sentence as provided for under the Decree. The position was the same under Section 206 (1) and (2) of the Criminal Procedure Code, which w \hich\af0\dbch\af37\loch\f0 a\hich\af0\dbch\af37\loch\f0 s in force as at 20.07.2009. The section does not postulate a system whereby the Magistrate is empowered to adjourn proceedings to effect restitution to the virtual complainant. Restitution, if at all, could be considered only after conviction, the outcom \hich\af0\dbch\af37\loch\f0 e\hich\af0\dbch\af37\loch\f0 of which can then be considered in imposing an appropriate sentence under the Sentencing}{\b0\fs24\insrsid7567104\charrsid5636699 \hich\af0\dbch\af37\loch\f0 and Penalties}{ \b0\fs24\insrsid9133792\charrsid5636699 \hich\af0\dbch\af37\loch\f0 Decree. Any order violative of this procedure is not mandated by law and would therefore be improper and unlawful. \par }{\b0\fs24\insrsid13907272 \par }{\b0\fs24\insrsid9133792\charrsid5636699 \hich\af0\dbch\af37\loch\f0 14.\tab }{\b0\fs24\insrsid4277859\charrsid5636699 \hich\af0\dbch\af37\loch\f0 This impropriety in procedure had\hich\af0\dbch\af37\loch\f0 paved the way for the accused to abscond having v}{\b0\fs24\insrsid4806073\charrsid5636699 \hich\af0\dbch\af37\loch\f0 iolated his bail undertaking which conduct also}{\b0\fs24\insrsid4277859\charrsid5636699 \hich\af0\dbch\af37\loch\f0 undermine}{ \b0\fs24\insrsid4667254\charrsid5636699 \hich\af0\dbch\af37\loch\f0 d}{\b0\fs24\insrsid4277859\charrsid5636699 \hich\af0\dbch\af37\loch\f0 the authority of court. This has, on the other hand, resulted in prolonging the proceedings and consumed }{ \b0\fs24\insrsid4667254\charrsid5636699 \hich\af0\dbch\af37\loch\f0 a substantial amount of }{\b0\fs24\insrsid4277859\charrsid5636699 \hich\af0\dbch\af37\loch\f0 time and resources\hich\af0\dbch\af37\loch\f0 of court and}{ \b0\fs24\insrsid4667254\charrsid5636699 \hich\af0\dbch\af37\loch\f0 of}{\b0\fs24\insrsid4277859\charrsid5636699 \hich\af0\dbch\af37\loch\f0 the State.}{\b0\fs24\insrsid9133792\charrsid5636699 \par \par \hich\af0\dbch\af37\loch\f0 15.\tab }{\b0\fs24\insrsid4277859\charrsid5636699 \hich\af0\dbch\af37\loch\f0 This court is of the view that }{\b0\fs24\insrsid4667254\charrsid5636699 \hich\af0\dbch\af37\loch\f0 the nature of the error made by the learned Magistrate warrants its setting-aside. However, it appears that }{\b0\fs24\insrsid4277859\charrsid5636699 \hich\af0\dbch\af37\loch\f0 any decision to quash the order of the Magistrate of 20.7.2009 would now be superfluous as the accused, on his apprehension, has informed court that he would withdraw the plea of guilt. The learned}{\b0\fs24\insrsid1209277\charrsid5636699 \hich\af0\dbch\af37\loch\f0 M}{\b0\fs24\insrsid4277859\charrsid5636699 \hich\af0\dbch\af37\loch\f0 agistrate, even though}{\b0\fs24\insrsid1209277\charrsid5636699 \hich\af0\dbch\af37\loch\f0 no specific order has been made in\hich\af0\dbch\af37\loch\f0 regard to the application of the accused, has fixed the case for trial, which implies that the earlier plea any longer does not have an effect. }{\b0\fs24\insrsid4277859\charrsid5636699 \par }{\b0\fs24\insrsid13907272 \par }{\b0\fs24\insrsid9133792\charrsid5636699 \hich\af0\dbch\af37\loch\f0 16.\tab }{\b0\fs24\insrsid4667254\charrsid5636699 \hich\af0\dbch\af37\loch\f0 As regards bail, the learned Magistrate was correct in his ruling of 10.09.2010, when he committed the acc \hich\af0\dbch\af37\loch\f0 used to remand custody in consequence of }{\b0\fs24\insrsid7567104\charrsid5636699 \hich\af0\dbch\af37\loch\f0 the}{\b0\fs24\insrsid4667254\charrsid5636699 \hich\af0\dbch\af37\loch\f0 failure}{ \b0\fs24\insrsid7567104\charrsid5636699 \hich\af0\dbch\af37\loch\f0 by the accused}{\b0\fs24\insrsid4667254\charrsid5636699 \hich\af0\dbch\af37\loch\f0 to appear in court aft}{\b0\fs24\insrsid4806073\charrsid5636699 \hich\af0\dbch\af37\loch\f0 er being released on bail. The s}{\b0\fs24\insrsid4667254\charrsid5636699 \hich\af0\dbch\af37\loch\f0 ucceeding Magistrate was equally correct, when he refused bail}{\b0\fs24\insrsid11500260\charrsid5636699 \hich\af0\dbch\af37\loch\f0 upon consideration of the application for bail and State}{\b0\fs24\insrsid5636699\charrsid5636699 \hich\af0\dbch\af37\loch\f0 '}{\b0\fs24\insrsid11500260\charrsid5636699 \hich\af0\dbch\af37\loch\f0 s response. I \hich\af0\dbch\af37\loch\f0 do not see any illegality in the two orders of the Magistrates for this court to interfere.}{\b0\fs24\insrsid4667254\charrsid5636699 \par }{\b0\fs24\insrsid13907272 \par }{\b0\fs24\insrsid9133792\charrsid5636699 \hich\af0\dbch\af37\loch\f0 17.\tab }{\b0\fs24\insrsid11500260\charrsid5636699 \hich\af0\dbch\af37\loch\f0 It is to be noted that the accused on his first appearance in court was admitted to bail in recognition of his }{\b0\fs24\insrsid5636699\charrsid5636699 \hich\af0\dbch\af37\loch\f0 '}{\b0\fs24\insrsid11500260\charrsid5636699 \hich\af0\dbch\af37\loch\f0 right to be released on bail}{\b0\fs24\insrsid5636699\charrsid5636699 \hich\af0\dbch\af37\loch\f0 '}{\b0\fs24\insrsid11500260\charrsid5636699 \hich\af0\dbch\af37\loch\f0 as set-out in Sect\hich\af0\dbch\af37\loch\f0 ion 3 (1) of the Act.
