As regards}{\lang2057\langfe1033\langnp2057\insrsid10826861 }{ \lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 the head injuries, the doctor had seen subdural}{\lang2057\langfe1033\langnp2057\insrsid10826861 }{\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 haemorrhage over the parietal and occipital areas of the}{\lang2057\langfe1033\langnp2057\insrsid10826861 }{\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 brain. \par }\pard \ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10826861 {\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 \par }\pard \ql \li720\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid10826861 {\lang2057\langfe1033\langnp2057\insrsid10826861 }{\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 d) The doctor opined that the immediate cause of death}{\lang2057\langfe1033\langnp2057\insrsid10826861 }{\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 was the excessive loss of blood from injuries [and the}{ \lang2057\langfe1033\langnp2057\insrsid10826861 }{\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 collection of blood] into left pleural cavity. The doctor was}{\lang2057\langfe1033\langnp2057\insrsid10826861 }{ \lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 specific on the fact that there was little chance of saving}{\lang2057\langfe1033\langnp2057\insrsid10826861 }{\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 the life of the deceased. \par }\pard \ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10826861 {\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 \par }\pard \ql \li720\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid10826861 {\lang2057\langfe1033\langnp2057\insrsid10826861 }{\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 (e) The post-mortem report was produced as }{\b\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 PE-11}{\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 ,}{\lang2057\langfe1033\langnp2057\insrsid10826861 }{ \lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 contents of which were accepted by the accused. \par }\pard \ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10826861 {\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 \par {\listtext\pard\plain\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 \hich\af0\dbch\af0\loch\f0 5.\tab}}\pard \ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin0\itap0\pararsid10826861 { \lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 It was admitted that the above injuries were caused on the deceased by the accused with the kitchen knife (PE-3) after intruding into the laboratory, where the deceased was lonely working in the afternoon of 26th Saturday of September, 2009. The intent was to rob. As the deceased reacted against this physical violence on him with a handpicked knife, the accused got injured in the knee and got his fingers of the right hand cut resulting in bleeding injuries for which, the acc used took medical treatment at the Lautoka Hospital. The deceased was, however, overpowered and the accused had incessantly attacked the deceased at least with four strokes with the kitchen knife. Each one of such stroke had caused a separate injury. As the deceased stood up to escape the attack, he was punched twice on the face followed by another couple of punches as the deceased was running to the door to flee from the attacks . The deceased, upon receipt of repeated attacks, fell on the floor. Under law, any person has the right to defend himself or his property against such an act of attack or on attempt on property. The right has to be exercised only to the extent that it was rea s onable and proportionate in the circumstances that the deceased was in at that point of time. If you consider that the deceased attacking the accused as he invaded him[the deceased] with a kitchen knife was reasonable and proportionate and not excessive o r aggressive in the circumstances that the deceased was in at that time, then his [deceased}{\i\lang2057\langfe1033\langnp2057\insrsid10826861 '}{\i\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 s] act of injuring the accused is not unlawful. In deciding that issue too, you must bear in mind that even the killing of the deceased was not unlawful in self-defence, if you consider that the accused on the spur of the moment perceived that the threat at the hands of t he deceased was such that the accused had to reasonably use force. Such a finding could lead them to the\hich\af0\dbch\af53\loch\f0 inevitable\hich\af0\dbch\af53\loch\f0 conclusion that the accused was guilty of murder as charged in light of specific directions on law\hich\af0\dbch\af53\loch\f0 as set-out above\hich\af0\dbch\af53\loch\f0 .\hich\af0\dbch\af53\loch\f0 \par }\pard \s17\ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10826861 {\f0\fs24\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 \par {\listtext\pard\plain\s17 \lang2057\langfe1033\dbch\af53\langnp2057\insrsid10826861\charrsid10826861 \hich\af0\dbch\af53\loch\f0 18.\tab}}\pard \s17\ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\ls6\adjustright\rin0\lin0\itap0\pararsid10826861 { \f0\fs24\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 \hich\af0\dbch\af53\loch\f0 Physical invasion by the\hich\af0\dbch\af53\loch\f0 accused of the deceased with a lethal weapon in order to rob, denied him (the accused) any room to rely on provocation under law as clearly directed by me in my summing-up as set-out above. The assessors, if they had clearly acted on the direction on law \hich\af0\dbch\af53\loch\f0 \hich\af0\dbch\af53\loch\f0 on this point, could \hich\af0\dbch\af53\loch\f0 not \hich\af0\dbch\af53\loch\f0 and should \hich\af0\dbch\af53\loch\f0 not\hich\af0\dbch\af53\loch\f0 have \hich\af0\dbch\af53\loch\f0 reduced the culpability of the accused to that of manslaughter. }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid10826861 \par }\pard \s17\ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10826861 {\f0\fs24\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 \par {\listtext\pard\plain\s17 \lang2057\langfe1033\dbch\af53\langnp2057\insrsid10826861\charrsid10826861 \hich\af0\dbch\af53\loch\f0 19.\tab}}\pard \s17\ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\ls6\adjustright\rin0\lin0\itap0\pararsid10826861 { \f0\fs24\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 \hich\af0\dbch\af53\loch\f0 Moreover, the conduct and the acts of the accused, as borne-out by his own admissions and medical evidence, serve to show that they were unreasona \hich\af0\dbch\af53\loch\f0 ble, excessive, disproportionate and, in fact, look aggressive and revengeful. These factual positions, which are manifest on the face of the evidence, safely invested the assessors with\hich\af0\dbch\af53\loch\f0 the opportunity to exclude room for self-defence if they had duly con\hich\af0\dbch\af53\loch\f0 sidered the directions on law on the point. In the result, the assessors should have come to the finding of guilty for murder as the conduct of the accused did not permit to reduce the culpability to that of manslaughter. \par }\pard \s17\ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10826861 {\f0\fs24\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 \par {\listtext\pard\plain\s17 \lang2057\langfe1033\dbch\af53\langnp2057\insrsid10826861\charrsid10826861 \hich\af0\dbch\af53\loch\f0 20.\tab}}\pard \s17\ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\ls6\adjustright\rin0\lin0\itap0\pararsid10826861 { \f0\fs24\lang2057\langfe1033\langnp2057\insrsid10826861\charrsid10826861 \hich\af0\dbch\af53\loch\f0 For these reasons, I did not con\hich\af0\dbch\af53\loch\f0 form to the opinions of the assessors. I am satisfied beyond reasonable doubt that the prosecution has established malice aforethought on the available evidence presented to court. I am further satisfied that defences of provocation and self-defence, even \hich\af0\dbch\af53\loch\f0 \hich\af0\dbch\af53\loch\f0 if they were applied in the circumstances of this case, do not favour the accused to mitigate the offence of murder to that of manslaughter.
