made voluntarily, and that the accused was never assault\hich\af0\dbch\af12\loch\f0 ed\hich\af0\dbch\af12\loch\f0 or forced. \par \par \hich\af0\dbch\af12\loch\f0 The accused giving evidence in Court said, that he was assaulted at Savusavu Police Station and was forced to admit committing the offen\hich\af0\dbch\af12\loch\f0 ces.}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \par \par \hich\af0\dbch\af12\loch\f0 On \hich\af0\dbch\af12\loch\f0 the voluntariness of the caution interview statement, more evidence were r\hich\af0\dbch\af12\loch\f0 evealed at the trial proper, tha\hich\af0\dbch\af12\loch\f0 n at the }{ \lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 voir dire}{\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 inquiry \hich\af0\dbch\af12\loch\f0 which was held before. \par \par \hich\af0\dbch\af12\loch\f0 Prosecution relies on the medical report of the accused\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 to show that the accused was \hich\af0\dbch\af12\loch\f0 not assaulted in Savusavu where his statement was recorded, but was assaulted in Suva when he was arrested.}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 The evidence of the accused was that the doctor, when writing the history given by the accused, has written what police officer had told the doctor\hich\af0\dbch\af12\loch\f0 .}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \par \par \hich\af0\dbch\af12\loch\f0 According to medical report which was produced in evidence as exhibit 3, \hich\af0\dbch\af12\loch\f0 on the first page\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 the police officer who took the accused to the doctor has written as the background, that the accused was alleged to have been assaulted by police in Suva on 1\hich\af0\dbch\af12\loch\f0 0/9/2009\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 whilst being arrested at his home in \hich\af0\dbch\af12\loch\f0 Nadonumai. \par \par \hich\af0\dbch\af12\loch\f0 On the second page of the medical report, in column \hich\af0\dbch\af12\loch\f0 D(\hich\af0\dbch\af12\loch\f0 10)\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 where history as related by the person to be examined to be written, the doctor has said; }{\i\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 "}{\i\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 history of assault by fellow police officers in\hich\af0\dbch\af12\loch\f0 Suva, whereby he was injured on chest and back by blunt trauma.}{\i\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 "}{ \lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \par \par \hich\af0\dbch\af12\loch\f0 When you read the wording of what the doctor has written, with the version of the accused\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 \hich\af0\dbch\af12\loch\f0 there is a doubt as to whether the doctor has written what the police officer said, or what the ac\hich\af0\dbch\af12\loch\f0 cused related to the doctor.\hich\af0\dbch\af12\loch\f0 The doctor who prepared the report was not call \hich\af0\dbch\af12\loch\f0 ed\hich\af0\dbch\af12\loch\f0 to give evidence.}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \par \par \hich\af0\dbch\af12\loch\f0 Further, the recording of the caution interview statement commenced on 12/9/2009, where on that date, accused was fit to make the statement\hich\af0\dbch\af12\loch\f0 .}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 O\hich\af0\dbch\af12\loch\f0 n 12/9/2009 w\hich\af0\dbch\af12\loch\f0 hen the accused was asked whether he wanted to be medically examined\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 or whether he was sick\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 he had answered negative.}{ \lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 The police officer who recorded his statement said in his evidence \hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 that the recording of the statement was adjourned on 12/9/2009 \hich\af0\dbch\af12\loch\f0 to 1\hich\af0\dbch\af12\loch\f0 5/9/2009\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 as the accused was not well\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 and for hi\hich\af0\dbch\af12\loch\f0 m\hich\af0\dbch\af12\loch\f0 to rest.}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{ \lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 But in cross examination\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 and on perusing the caution interview statement it was revealed that \hich\af0\dbch\af12\loch\f0 the recording was adjourned\hich\af0\dbch\af12\loch\f0 on the 1\hich\af0\dbch\af12\loch\f0 2\hich\af0\dbch\af12\loch\f0 th\hich\af0\dbch\af12\loch\f0 , \hich\af0\dbch\af12\loch\f0 not because that the accused was not well \hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 but to get the f\hich\af0\dbch\af12\loch\f0 iles down from Labasa. \par \par \hich\af0\dbch\af12\loch\f0 When the recording of the statement resumed on 15/9/2009, it was revealed that the accused was sick.}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{ \lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 On questioning, accused had complained that he was feeling pain on his ribs and he wanted to be medically examined.}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 Therefore wh\hich\af0\dbch\af12\loch\f0 en he was taken to the doctor to be examined on the 15/9/2009, doctor found that there were injuries \hich\af0\dbch\af12\loch\f0 on the chest by blunt trauma. \par \par \hich\af0\dbch\af12\loch\f0 Therefore the\hich\af0\dbch\af12\loch\f0 re is a clear doubt\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 as to whether\hich\af0\dbch\af12\loch\f0 the accused was assaulted in Savusavu between 12 and 15/9/2009 as accused te\hich\af0\dbch\af12\loch\f0 stified.}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{ \lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 The accused did not complain of pain or sickness on the 12/9/2009\hich\af0\dbch\af12\loch\f0 when he was brought to Savusavu according to the caution interview statement itself.}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 Hence it is doubtful, that the caution interview statement was made voluntarily\hich\af0\dbch\af12\loch\f0 . \par \par \hich\af0\dbch\af12\loch\f0 The Accused \hich\af0\dbch\af12\loch\f0 giving evidence said that although he came to Savusavu with the other accused persons\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 he did not participate in committing any of the offences\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 as\hich\af0\dbch\af12\loch\f0 he did not like the idea of ty\hich\af0\dbch\af12\loch\f0 ing the security guard.}{ \lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 The 1\hich\af0\dbch\af12\loch\f0 st\hich\af0\dbch\af12\loch\f0 accused who gave evidence on behalf of the de\hich\af0\dbch\af12\loch\f0 fence also said\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 that the accused Soloveni did not take part in committing the offences, although he came from Suva to Savusavu with them.}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{ \lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 He further said, that at the police station \hich\af0\dbch\af12\loch\f0 when he really wanted to tell the police that Soloveni was not there, th \hich\af0\dbch\af12\loch\f0 e police kept on beating him saying that he was lying.}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \par \par \hich\af0\dbch\af12\loch\f0 The victim of the robbery Na\hich\af0\dbch\af12\loch\f0 m Bok Cho also said in evidence, \hich\af0\dbch\af12\loch\f0 that he saw only three persons at the time of robbery. \par \par \hich\af0\dbch\af12\loch\f0 Apart from the \hich\af0\dbch\af12\loch\f0 said \hich\af0\dbch\af12\loch\f0 caution interview statement of the accused Soloveni, there is\hich\af0\dbch\af12\loch\f0 no evidence direct or circumstantial \hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 to prove that this\hich\af0\dbch\af12\loch\f0 accused took part in the offences of robbery\hich\af0\dbch\af12\loch\f0 ,\hich\af0\dbch\af12\loch\f0 or manslaughter. \par \par \hich\af0\dbch\af12\loch\f0 Hence I find that the prosecution has failed to prove the counts one and two of the information beyond reasonable doubt.}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{ \lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 Therefore \hich\af0\dbch\af12\loch\f0 I agree with the assessors that the accused is not guilty of the offence of manslaughter in count no. 1.}{ \lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 For the above reasons, \hich\af0\dbch\af12\loch\f0 I do not accept the opinions of the assessors that the accused is guilty of robbery with violence in count no. 2, as the prosec\hich\af0\dbch\af12\loch\f0 ution has not proved it beyond reasonable doubt.}{\lang2057\langfe1042\langnp2057\insrsid1927011 \hich\af0\dbch\af12\loch\f0 }{\lang2057\langfe1042\langnp2057\insrsid1927011\charrsid1927011 \hich\af0\dbch\af12\loch\f0 Therefore I reject the opinions of guilty by the assessors on count no. 2. \par \par \hich\af0\dbch\af12\loch\f0 Therefore the accused is acquitted on both counts no. 1 and 2 of the information. \par \par }\pard \qc
