forgery as alleged in counts one and three. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 8\hich\af0\dbch\af37\loch\f0 ]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 Counsel for the State submits that the involvement of the accused can Added Tax (VAT) Returns and therefore was not entitled for any refund of tax.}{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 Evidence has been led that Honeymoon Beach Resort received VAT refunds and payments were deposited \hich\af0\dbch\af37\loch\f0 into the Company}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 '}{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 s\hich\af0\dbch\af37\loch\f0 bank account \hich\af0\dbch\af37\loch\f0 operated by the accused.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 Thereafter various cash withdrawals were made from the account.\hich\af0\dbch\af37\loch\f0 Some withdrawals were made to purchase an expensive vehicle. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 12\hich\af0\dbch\af37\loch\f0 ]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 The two \hich\af0\dbch\af37\loch\f0 cheques\hich\af0\dbch\af37\loch\f0 subject of the forgery counts are P40 and P42.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 Ac\hich\af0\dbch\af37\loch\f0 cording to the evidence, the \hich\af0\dbch\af37\loch\f0 cheques belong to\hich\af0\dbch\af37\loch\f0 Fiji Islands Revenue and Cu\hich\af0\dbch\af37\loch\f0 stoms Authority.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 The cheques contain \hich\af0\dbch\af37\loch\f0 com\hich\af0\dbch\af37\loch\f0 p\hich\af0\dbch\af37\loch\f0 u\hich\af0\dbch\af37\loch\f0 ter generated signatures of \hich\af0\dbch\af37\loch\f0 the authorized \hich\af0\dbch\af37\loch\f0 senior employees of Fiji Islands Revenue and Customs Authority.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 The \hich\af0\dbch\af37\loch\f0 cheques are not altered\hich\af0\dbch\af37\loch\f0 as \hich\af0\dbch\af37\loch\f0 alleged in the charges.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 There is no evidence that details of the genuine taxpayers were erased and inserted \hich\af0\dbch\af37\loch\f0 with a\hich\af0\dbch\af37\loch\f0 false taxpayer}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 '}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 s this respect, the forgery counts are defective.}{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 However, that does not mean that the \hich\af0\dbch\af37\loch\f0 cheques\hich\af0\dbch\af37\loch\f0 are not forged.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 There is evidence from which the assessors can conclude that the cheques\hich\af0\dbch\af37\loch\f0 are forged. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 13\hich\af0\dbch\af37\loch\f0 ]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 False details suc\hich\af0\dbch\af37\loch\f0 h as name of the taxpayer\hich\af0\dbch\af37\loch\f0 , \hich\af0\dbch\af37\loch\f0 cheque\hich\af0\dbch\af37\loch\f0 number \hich\af0\dbch\af37\loch\f0 of another taxpayer \hich\af0\dbch\af37\loch\f0 and amounts }{\b\f0\fs24\ul\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 were added}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 in genuine \hich\af0\dbch\af37\loch\f0 cheque\hich\af0\dbch\af37\loch\f0 leaves so that the documents could be used as\hich\af0\dbch\af37\loch\f0 genuine.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 It is in this sense\hich\af0\dbch\af37\loch\f0 that\hich\af0\dbch\af37\loch\f0 the \hich\af0\dbch\af37\loch\f0 cheques \hich\af0\dbch\af37\loch\f0 are forged, and not in the manner alleged by the prosecution in the charges. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 14\hich\af0\dbch\af37\loch\f0 ]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 Counsel for the State submits that the forgery occurred outside Fiji Island Revenue and Customs Authority and not inside Fiji\hich\af0\dbch\af37\loch\f0 Islands Revenue and Customs Authority.}{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 Counsel submits that since there is evidence that the accused benefitted from the forgery, he is the forger. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 15\hich\af0\dbch\af37\loch\f0 ]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 T\hich\af0\dbch\af37\loch\f0 his submission cannot be sustained on the evidence.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 Whilst there is evidence from the employees of\hich\af0\dbch\af37\loch\f0 Fiji Islands Revenue and Customs Authority that the \hich\af0\dbch\af37\loch\f0 cheques\hich\af0\dbch\af37\loch\f0 P40 and P42 were not generated by their system, the witnesses offered no explanation how it was possible for the accused to obtain genuine computer generated signatures \hich\af0\dbch\af37\loch\f0 of authorized signatories \hich\af0\dbch\af37\loch\f0 on the \hich\af0\dbch\af37\loch\f0 cheques\hich\af0\dbch\af37\loch\f0 .}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 In his caution interview, the accused admits that the \hich\af0\dbch\af37\loch\f0 cheques\hich\af0\dbch\af37\loch\f0 were given to him by two employees of Fiji Islands Revenue and Customs Authority.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 The prosecution led no evidence to rebut that this admission of the accused is a lie.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 In fact\hich\af0\dbch\af37\loch\f0 , the prosecution relies on the truth of the admission to prove the charges. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 16\hich\af0\dbch\af37\loch\f0 ]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 It therefore \hich\af0\dbch\af37\loch\f0 follows that the only\hich\af0\dbch\af37\loch\f0 inference that can be drawn from these facts is that the \hich\af0\dbch\af37\loch\f0 cheques\hich\af0\dbch\af37\loch\f0 were forged by someone i\hich\af0\dbch\af37\loch\f0 nside Fiji\hich\af0\dbch\af37\loch\f0 Islands\hich\af0\dbch\af37\loch\f0 Revenue and Customs A\hich\af0\dbch\af37\loch\f0 uthority \hich\af0\dbch\af37\loch\f0 and then given to the accused as part of a conspiracy.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 Unfortunately, the prosecution neither alleges \hich\af0\dbch\af37\loch\f0 a \hich\af0\dbch\af37\loch\f0 conspiracy\hich\af0\dbch\af37\loch\f0 ,\hich\af0\dbch\af37\loch\f0 nor \hich\af0\dbch\af37\loch\f0 a \hich\af0\dbch\af37\loch\f0 joint enterprise in relation to the forgery of the \hich\af0\dbch\af37\loch\f0 cheques\hich\af0\dbch\af37\loch\f0 .}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 If the prosecution had\hich\af0\dbch\af37\loch\f0 alleged \hich\af0\dbch\af37\loch\f0 a joint enterprise, then it could\hich\af0\dbch\af37\loch\f0 have \hich\af0\dbch\af37\loch\f0 be\hich\af0\dbch\af37\loch\f0 en argued \hich\af0\dbch\af37\loch\f0 that the accused was part of a common i\hich\af0\dbch\af37\loch\f0 ntention to do an unlawful act and it did not matter who the actual forger was.}{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 Since the prosecution has not presented the case in this manner, and any amendment cannot be made to the charges, without\hich\af0\dbch\af37\loch\f0 caus\hich\af0\dbch\af37\loch\f0 ing prejudice\hich\af0\dbch\af37\loch\f0 to the accused, I find t \hich\af0\dbch\af37\loch\f0 here is no evidence to implicate the accused on counts one and three.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071 \hich\af0\dbch\af37\loch\f0 }{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1730071\charrsid1730071 \hich\af0\dbch\af37\loch\f0 I enter a verdict of not guilty in respect to counts one and three. \hich\af0\dbch\af37\loch\f0 On
