}{\f0\fs24\insrsid10054484\charrsid7756669 The defendant also filed an ex-parte summons for setting aside the writ and the warrant of arrest. \par }{\f0\fs24\insrsid16525457\charrsid7756669 \par [8]\tab }{\f0\fs24\insrsid10054484\charrsid7756669 In support of the defendant}{\f0\fs24\insrsid7756669 '}{\f0\fs24\insrsid10054484\charrsid7756669 s application 2 affidavits were filed by the defendants}{\f0\fs24\insrsid6364475\charrsid7756669 .}{ \f0\fs24\insrsid10054484\charrsid7756669 \par }{\f0\fs24\insrsid16525457\charrsid7756669 \par [9]\tab }{\f0\fs24\insrsid3932628\charrsid7756669 The defendant}{\f0\fs24\insrsid7756669 '}{\f0\fs24\insrsid3932628\charrsid7756669 s contention is that since the vessel is mortgaged to a bank, th e bank is the beneficial owner and therefore, it cannot be arrested. This contention is mainly based on the issue of beneficial ownership. \par }{\f0\fs24\insrsid16525457\charrsid7756669 \par [10]\tab }{\f0\fs24\insrsid5122222\charrsid7756669 However, the plaintiff submitted, that the issue of beneficial ownership is immaterial, so long as the defendants owed the plaintiffs the total sum of 150000.00.}{\f0\fs24\insrsid9207470\charrsid7756669 \par }{\f0\fs24\insrsid16525457\charrsid7756669 \par [11]\tab }{\f0\fs24\insrsid10174499\charrsid7756669 In the light of the above argument, the cardinal issue to be determined here is whether or not at the time of the issuance of writ, Western Shipping Ltd is the beneficial owner of all the shares; an d if so can the plaintiff bring an action in rem. \par }{\f0\fs24\insrsid16525457\charrsid7756669 \par [12]\tab }{\f0\fs24\insrsid9207470\charrsid7756669 In the affidavit file}{\f0\fs24\insrsid4085255\charrsid7756669 d}{\f0\fs24\insrsid9207470\charrsid7756669 by the 1st defendant company, it }{\f0\fs24\insrsid9508688\charrsid7756669 has been admitted }{ \f0\fs24\insrsid9207470\charrsid7756669 that the 1st defendant is registered with the Fiji Maritime Department as the owner and operator of the vessel Cagi Mai Ba. Th e vessel is mortgaged to ANZ through Mortgage Debenture dated 06.12.2004. The Debenture covers all the assets and undertaking of 1st defendant. It was admitted that the 1st plaintiff provided services to the defendants between 09.06.2009-0.07.20110. The 1 st defendant}{\f0\fs24\insrsid7756669 '}{\f0\fs24\insrsid14513330\charrsid7756669 s position is that it}{\f0\fs24\insrsid9207470\charrsid7756669 has paid the sum of 10000.00}{\f0\fs24\insrsid9984539\charrsid7756669 to the 1st plaintiff and would settle any outstanding debts}{\f0\fs24\insrsid9126332\charrsid7756669 ,}{\f0\fs24\insrsid9984539\charrsid7756669 after it has verified and vetted by both parties.}{\f0\fs24\insrsid9207470\charrsid7756669 \par }{\f0\fs24\insrsid16525457\charrsid7756669 \par [13]\tab }{\f0\fs24\insrsid774\charrsid7756669 In his affidavit, the operational manager of the 1st defendant admitted that the 1st plaintiff had provided services to the 2nd defendant. Karim}{ \b\f0\fs24\ul\insrsid7756669 '}{\b\f0\fs24\ul\insrsid8331573\charrsid7756669 s Ltd No1 [1998] FJHC 76}{\b\f0\fs24\ul\insrsid10173818\charrsid7756669 \par }{\f0\fs24\insrsid3169139\charrsid7756669 \par [23]\tab }{\f0\fs24\insrsid8743492\charrsid7756669 In the light of the above cases}{\f0\fs24\insrsid8811755\charrsid7756669 ,}{\f0\fs24\insrsid8743492\charrsid7756669 the defendants submitted }{\f0\fs24\insrsid8811755\charrsid7756669 that the court should look beyond the registered ownership of the ship in order to find the beneficial ownership. \par }{\f0\fs24\insrsid3169139\charrsid7756669 \par [24]\tab }{\f0\fs24\insrsid12680461\charrsid7756669 However, it could be noted that }{\f0\fs24\insrsid13526726\charrsid7756669 in both abovementioned cases}{\f0\fs24\insrsid5063043\charrsid7756669 ,}{\f0\fs24\insrsid13526726\charrsid7756669 the applications for release of the vessels were made by the interveners who made claims on the basis of beneficial ownership, whereas in the instant case no such beneficial owner has intervened}{\f0\fs24\insrsid5063043\charrsid7756669 and the application for release of the vessel has been made by the registered owner.}{\f0\fs24\insrsid10237127\charrsid7756669 \par }{\f0\fs24\insrsid3169139\charrsid7756669 \par [25]\tab }{\f0\fs24\insrsid10237127\charrsid7756669 In Wasawasa Fisheries Ltd case it was stated: \par }{\i\f0\fs24\insrsid3169139\charrsid7756669 \par }\pard \ql \li294\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin294\itap0\pararsid16658361 {\i\f0\fs24\insrsid7756669 '}{\i\f0\fs24\insrsid10237127\charrsid7756669 to sum up, I find that the intervener (Levestam) is the beneficial owner of the vessel within the meaning ascribed to the term under the relevant said section of the Administration of Justice Act applicable to Fiji. This ownership emanates from the Sale and Purchase A}{\i\f0\fs24\insrsid13854564\charrsid7756669 greement entered into between the defendant and the intervener for the sale of the vessel to the defendant. This agreement inter alia, gives certain rights to the intervener in case of default in payment of the purchase price and it is clear from the evidence that there has been a default and the defendant admits that money is still owed to the intervener. The ownership of the vessel had not at any time passed to the defendant except t hat it had possession of it for the purpose of fishing before the arrest.}{\i\f0\fs24\insrsid10237127\charrsid7756669 the court that the 1st defendant is intending to dissipate its assets and there is a real risk that the debt owed }{\f0\fs24\insrsid4875702\charrsid7756669 to the plaintiff may never be
