He says that he was locked in a cell for 5 days and that the only reason he confessed was to be released from custody. As a result he did not give t he answers in his statement voluntarily. \par \par }{\lang2057\langfe1033\langnp2057\insrsid274853\charrsid1258837 [3]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 The sixth accused prays unfair and prejudicial procedural errors in the taking of the statement which should lead me to having it excluded. \par \par }{\b\ul\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 The Legal Test \par }{\ul\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 \par }{\lang2057\langfe1033\langnp2057\insrsid274853\charrsid1258837 [4]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 The test for admissibility of all confessional sta tements made to the Police, is whether they were made freely and not as a result of threats, assaults, or inducements made to the accused by a person or persons in authority. Further, oppression or unfairness also leads to the exclusion of confessions. This is a matter of overriding discretion and one cannot specifically categorise the matters which might be taken into account}{\b\i\lang2057\langfe1033\langnp2057\insrsid1258837 "}{ \b\i\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 . \par }\pard \ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid1258837 {\b\i\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 \par }{\lang2057\langfe1033\langnp2057\insrsid15338303\charrsid1258837 [7]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 Further, the rights of suspects who are arrested or detained are protected by section 27 of the Constitution (which at the time was operative). A breach of the Constitution may also be a ground for excluding admissions. \par }{\lang2057\langfe1033\langnp2057\insrsid728318\charrsid1258837 \par }{\lang2057\langfe1033\langnp2057\insrsid15338303\charrsid1258837 [8]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 The burden of proving voluntariness, fairness, lack of oppression, compliance with the Consti tution and (if there is non-compliance) lack of prejudice to the suspect, rests at all times with the prosecution. They must prove these matters beyond reasonable doubt. \par \par }{\b\ul\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 The Facts \par }{\b\ul\lang2057\langfe1033\langnp2057\insrsid15162764\charrsid1258837 \par {\listtext\pard\plain\b\lang2057\langfe1033\langfenp1033\insrsid2705988\charrsid1258837 \hich\af0\dbch\af0\loch\f0 (1)\tab}}\pard \ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\ls4\adjustright\rin0\lin0\itap0\pararsid1258837 { \b\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 Fifth Accused}{\b\lang2057\langfe1033\langnp2057\insrsid15162764 \par }\pard \ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid1258837 {\b\lang2057\langfe1033\langnp2057\insrsid1258837\charrsid1258837 \par }{\lang2057\langfe1033\langnp2057\insrsid15338303\charrsid1258837 [9]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 Acting Sergeant Saim oni Ratu of the Tavua Police Station gave evidence before a Commission issued by this Court under s.120 of the Criminal Procedure Decree 2009, on the 6th July 2010. He told of having interviewed the 5th accused on the 11th October 2007 in the Crime Office at Tavua Police Station. The interview was in the Fijian vernacular and he translated it into English. He said t}{\lang2057\langfe1033\langnp2057\insrsid13857045\charrsid1258837 h}{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 at before the interview the accused }{\lang2057\langfe1033\langnp2057\insrsid1258837 "}{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 appeared happy}{\lang2057\langfe1033\langnp2057\insrsid1258837 "}{ \lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 and he made no complaints about his treatment in custody. He added that he did not see anybody ill-treating the accused. He applied the Judges}{\lang2057\langfe1033\langnp2057\insrsid1258837 '}{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 Rules and extended the usual rights to the}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 5th accused who signed to acknowledge being informed of those rights. The accused co-operated with the question and answer interview, answering al}{\lang2057\langfe1033\langnp2057\insrsid13857045\charrsid1258837 l}{ \lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 of the questions. He then formally produced both of the documents in question. \par }{\lang2057\langfe1033\langnp2057\insrsid15162764\charrsid1258837 \par }{\lang2057\langfe1033\langnp2057\insrsid15338303\charrsid1258837 [10]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 The 5th accused, being present of course, cross-examined the witness, asking him how long he had been in the cell.}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 The witness said that all he knew was that the accused had been arrested on the 10th October and interviewed on the 11th.}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 The accused suggested to the witness that he only gave the answers because his wife and children were visiting every day to which the witnesses replied that he had no idea about that but he did know that the responses given in the interview were given }{ \lang2057\langfe1033\langnp2057\insrsid1258837 "}{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 of your own free will}{\lang2057\langfe1033\langnp2057\insrsid1258837 "}{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 . \par \par }{\lang2057\langfe1033\langnp2057\insrsid15338303\charrsid1258837 [11]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 In re-examination, the witness said that the accused had never complained about being in custody for an unduly long time, nor were there any complaints about family visits. \par \par }{\lang2057\langfe1033\langnp2057\insrsid15338303\charrsid1258837 [12]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 Sergeant Vinesh told this Court that he was the main Investigating Officer for this case. He said that this accused was brought into the Station on the 11th October (a day later than the previous witness had deposed to) and was interviewed on that d ay. The accused made no complaint to him, nor was he a witness to any improprieties in the station. He was first produced before a Magistrate on t}{\lang2057\langfe1033\langnp2057\insrsid13857045\charrsid1258837 he 15th }{ \lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 October, the reason being that the interview was conducted on the 11th}{\lang2057\langfe1033\langnp2057\insrsid15338303\charrsid1258837 and}{ \lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 12th October and the 13th and}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 14th were weekend holidays. His family was allowed to visit him. \par }{\lang2057\langfe1033\langnp2057\insrsid728318\charrsid1258837 \par }{\lang2057\langfe1033\langnp2057\insrsid15338303\charrsid1258837 [13]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 In cross-examination the 5th accused put to this witness that his family came to visit him at the Station but they were not allowed to see him. He was tasked to interview the sixth accused which he then did on the 8th October 2010. He initially told me that the inte rview was recorded in the English language, but on further questioning }{\lang2057\langfe1033\langnp2057\insrsid1258837 "}{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 remembered}{\lang2057\langfe1033\langnp2057\insrsid1258837 "}{ \lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 that it was recorded in the Fijian vernacular and then translated into English. The accused never complained of assaults or force and he was afforded all of his rights. He answered the questions quite freely, never complained of any improprieties and signed the interview at the end. The witness produced the interview and its translation. \par \par }{\lang2057\langfe1033\langnp2057\insrsid12670015\charrsid1258837 [15]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 In cross-examination, the witness agreed that the accused was denying the allegat ions put to him on the first day of the interview, but on the second day he was making admissions. He admitted that the suspect was not cautioned again on the second day before he made these admissions. Question 72 in the interview (which is the first que stion asked on the second day) refers to }{\lang2057\langfe1033\langnp2057\insrsid1258837 "}{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 information}{\lang2057\langfe1033\langnp2057\insrsid1258837 "}{ \lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 being given by the suspect}{\lang2057\langfe1033\langnp2057\insrsid1258837 '}{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 s wife. This question was not translated into the English version. He also admitted that the interview was not read over to the suspect at the end, and moreover he agreed with Counsel for the accused that during the interview the 1st and }{ \lang2057\langfe1033\langnp2057\insrsid11272217\charrsid1258837 3rd}{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 accused were brought into the room. \par \par }{\lang2057\langfe1033\langnp2057\insrsid12670015\charrsid1258837 [16]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 In re-examination, he said that because space in the Tavua Station was confined, the two co-accused had to pass through the interview room to get to the charge room. He also explained that he did not read over the interview to the accused because as he finished every page he would hand it to the 6th accused to read it for himself. Although asked, he was unable to give a satisfactory answer for this admission. \par \par }{\b\ul\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 Analysis \par \par }{\lang2057\langfe1033\langnp2057\insrsid12670015\charrsid1258837 [17]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 The 5th accused objection to the interview has always been that he was kept in his cell without release for 5 days which mentally affected his }{\lang2057\langfe1033\langnp2057\insrsid1258837 "}{ \lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 performance}{\lang2057\langfe1033\langnp2057\insrsid1258837 "}{\lang2057\langfe1033\langnp2057\insrsid2705988\charrsid1258837 at the interview. However it is quite apparent from the evidence of the officers, whom I believe, that the interview was conducted almost as soon as he had been brought to the Station, be it within one day or the same day. There appears to be no oppression to make me withdraw the interview from the assessors and as a result I find that the interview is voluntary and can be lead in evidence in the trial proper. \par \par }{\lang2057\langfe1033\langnp2057\insrsid13646997\charrsid1258837 [18]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid13646997\charrsid1258837 The sixth accused sole ground of objection is that the interview is } {\lang2057\langfe1033\langnp2057\insrsid1258837 "}{\lang2057\langfe1033\langnp2057\insrsid13646997\charrsid1258837 unfair and prejudicial to the accused in that its prejudicial effect outweighs its probative value}{ \lang2057\langfe1033\langnp2057\insrsid1258837 "}{\lang2057\langfe1033\langnp2057\insrsid13646997\charrsid1258837 . \par \par [19]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid13646997\charrsid1258837 This very unhappily worded ground takes the 6th accused}{\lang2057\langfe1033\langnp2057\insrsid1258837 '}{ \lang2057\langfe1033\langnp2057\insrsid13646997\charrsid1258837 s case no further. All interviews that contain confessions are prejudicial and as such are probative; the prejudice being the proof, not outweighing the proof. However the real intent of the ground, though not worded as such, is the }{\lang2057\langfe1033\langnp2057\insrsid1258837 "}{\b\lang2057\langfe1033\langnp2057\insrsid13646997\charrsid1258837 unfairness}{\b\lang2057\langfe1033\langnp2057\insrsid1258837 "}{\lang2057\langfe1033\langnp2057\insrsid13646997\charrsid1258837 of the interview. \par }{\lang2057\langfe1033\langnp2057\insrsid728318\charrsid1258837 \par }{\lang2057\langfe1033\langnp2057\insrsid13646997\charrsid1258837 [20]}{\lang2057\langfe1033\langnp2057\insrsid1258837 }{\lang2057\langfe1033\langnp2057\insrsid13646997\charrsid1258837 There are obviously breaches of the Judges Rules in the course of this interview. The suspect was never cautioned on the second day, nor was it read over to him in its entirety at the end before being asked to make additions, corrections or alterations. He was asked if he wanted to alter or add, but this was not done in response to the int erview having been read to him.
