s usual fees in connection with any of its services }{\lang2057\langfe1033\langnp2057\insrsid10247097\charrsid8597726 were to}{\lang2057\langfe1033\langnp2057\insrsid4992894\charrsid8597726  be debited to the borrower\rquote s account and }{

\par }{\lang2057\langfe1033\langnp2057\insrsid14099894\charrsid8597726 Fifthly a}{\lang2057\langfe1033\langnp2057\insrsid4992894\charrsid8597726 n establishment fee of $500 }{\lang2057\langfe1033\langnp2057\insrsid10247097\charrsid8597726 was }{
\lang2057\langfe1033\langnp2057\insrsid4992894\charrsid8597726 to be debited to the account or payable upon acceptance by the Defendant of the loan offer.

\lang2057\langfe1033\langnp2057\insrsid14099894\charrsid8597726 this}{\lang2057\langfe1033\langnp2057\insrsid6169202\charrsid8597726 , neither the Defendant nor the Third Party have sought to attach any fault to the Plaintiff.

\par Before proceeding to consider the issues in the Third Party proceedings, there is one matter that should be dealt with at this stage.}{\lang2057\langfe1033\langnp2057\insrsid8597726  }{\lang2057\langfe1033\langnp2057\insrsid6169202\charrsid8597726 
That issue is whether the mortgagee (the Plaintiff) has entered into a contract of sale pursuant to its }{\lang2057\langfe1033\langnp2057\insrsid679742\charrsid8597726 power of sale.}{\lang2057\langfe1033\langnp2057\insrsid8597726  }{
\lang2057\langfe1033\langnp2057\insrsid679742\charrsid8597726 If so, what effect d}{\lang2057\langfe1033\langnp2057\insrsid2049276\charrsid8597726 id}{\lang2057\langfe1033\langnp2057\insrsid679742\charrsid8597726 
 that have on any attempt by the Defendant to exercise his right of redemption which }{\lang2057\langfe1033\langnp2057\insrsid2049276\charrsid8597726 wa}{\lang2057\langfe1033\langnp2057\insrsid679742\charrsid8597726 
s the purpose of the loan from the Third Party.}{\lang2057\langfe1033\langnp2057\insrsid11946262\charrsid8597726 
\par }{\lang2057\langfe1033\langnp2057\insrsid679742\charrsid8597726 
\par It is therefore necessary to consider the effect of paragraphs 14 and 15 of the Plaintiff\rquote s affidavit in support sworn by Jagdish Prasad that states:

isila Tesinoko Waqaliti.

 the particulars of the sale have not been disclosed nor any relevant terms of the contract, the material in the affidavits has not been challenged and is the only evidence before me on this point.
\par 
\par On the authority of }{\b\i\ul\lang2057\langfe1033\langnp2057\insrsid10059021\charrsid8597726 Property and Bloodstock Ltd v. Emerton}{\lang2057\langfe1033\langnp2057\insrsid10059021\charrsid8597726 
 [1968] 1 Ch 94 ordinarily the entry by the Plaintiff as mortgagee into a contract for the sale of the mortgaged property, }{\lang2057\langfe1033\langnp2057\insrsid2049276\charrsid8597726 whe}{

 with the Third Party raises a question concerning the willingness of the Plaintiff to accept payment from the }{\lang2057\langfe1033\langnp2057\insrsid12348060\charrsid8597726 T}{\lang2057\langfe1033\langnp2057\insrsid15210512\charrsid8597726

\lang2057\langfe1033\langnp2057\insrsid9390063\charrsid8597726 Apart from the additional sum of $381.00 }{\lang2057\langfe1033\langnp2057\insrsid12348060\charrsid8597726 that had been }{\lang2057\langfe1033\langnp2057\insrsid9390063\charrsid8597726 
paid by the Defendant to the Third Party at its request on 
30 August 2007, the proposed settlement also required the Defendant to consent to the amount standing to his credit in his account with the Third Party in the sum of $1756.93 to be included in the settlement amount to be paid to the Plaintiff.}{

he affidavit it would appear that the Third Party has been willing to do this at all material times.

\par Considering that the }{\lang2057\langfe1033\langnp2057\insrsid11810015\charrsid8597726 Defendant}{\lang2057\langfe1033\langnp2057\insrsid15270995\charrsid8597726 
 has not paid any moneys under the mortgage since 2004 it does seem to have been an unreasonable decision on his part not to
 make an additional payment of $1756.93 in order to enable the matter to be settled whereby the right of redemption would be exercised and a fresh }{\lang2057\langfe1033\langnp2057\insrsid12348060\charrsid8597726 first }{
\lang2057\langfe1033\langnp2057\insrsid15270995\charrsid8597726 mortgage executed in favour of the Third Party.}{\lang2057\langfe1033\langnp2057\insrsid8597726  }{\lang2057\langfe1033\langnp2057\insrsid2976244\charrsid8597726 
Under the loan agreement the Defendant was, by implication, liable for any additional moneys owing to the mortgagee.}{\lang2057\langfe1033\langnp2057\insrsid15270995\charrsid8597726

\par Finally I am not satisfied on the material before me }{\lang2057\langfe1033\langnp2057\insrsid11810015\charrsid8597726 that}{\lang2057\langfe1033\langnp2057\insrsid15270995\charrsid8597726  the Third Party has acted with unreasonable delay in this matter.
}{\lang2057\langfe1033\langnp2057\insrsid8597726  }{\lang2057\langfe1033\langnp2057\insrsid15270995\charrsid8597726 It twice wrote to the Plaintiff requesting information about a settlement amount.}{\lang2057\langfe1033\langnp2057\insrsid8597726  }{
\lang2057\langfe1033\langnp2057\insrsid15270995\charrsid8597726 The first letter was dated 21 February 2006 and the second letter was dated 17 November 2006.}{\lang2057\langfe1033\langnp2057\insrsid8597726  }{
\lang2057\langfe1033\langnp2057\insrsid15270995\charrsid8597726 It did not get a reply from the Plaintiff until 28 November 2006 and from }{\lang2057\langfe1033\langnp2057\insrsid2976244\charrsid8597726 the }{
\lang2057\langfe1033\langnp2057\insrsid15270995\charrsid8597726 Fiji National Provident Fund until 3 May 2007.}{\lang2057\langfe1033\langnp2057\insrsid8597726  }{\lang2057\langfe1033\langnp2057\insrsid15270995\charrsid8597726 Initially settlement was
 to take place by mid June 2007.}{\lang2057\langfe1033\langnp2057\insrsid8597726  }{\lang2057\langfe1033\langnp2057\insrsid15270995\charrsid8597726 The Plaintiff then advised the Third Party that settlement was required in the sum of $21,381.04.}{
\lang2057\langfe1033\langnp2057\insrsid8597726  }{\lang2057\langfe1033\langnp2057\insrsid2976244\charrsid8597726 T}{\lang2057\langfe1033\langnp2057\insrsid15270995\charrsid8597726 he Defendant paid the additional sum of $381.04 on 30 August 2007.}{
\lang2057\langfe1033\langnp2057\insrsid8597726  }{\lang2057\langfe1033\langnp2057\insrsid15270995\charrsid8597726 Then there was further delay caused by the existence of a caveat on the title that had been lodged by the Suva City Council.}{

\par }{\lang2057\langfe1033\langnp2057\insrsid1330505\charrsid8597726 That was done and the Third Party informed the Plaintiff by letter dated 20 February 2008 that it was ready to settle as the caveat had been lifted.

\par Then by letter dated 5 March 2008 the Plaintiff informed the Third Party that the settlement amount was no longer $21,381.04.}{\lang2057\langfe1033\langnp2057\insrsid8597726  }{\lang2057\langfe1033\langnp2057\insrsid1330505\charrsid8597726 
The amount had increased to $32,627.74 although this included the amount required to be paid by FNPF.}{\lang2057\langfe1033\langnp2057\insrsid8597726  }{\lang2057\langfe1033\langnp2057\insrsid1330505\charrsid8597726 
After negotiations between the Plaintiff and the Third Party, it was agreed that the amount to be paid by the Third Party together with the Defendant\rquote s contribution to settle the debt would be $23,140.97.

\par There has certainly been tardiness on the part of the Plaintiff and the Fiji National Provident Fund in answering correspondence from the Third Party.}{\lang2057\langfe1033\langnp2057\insrsid8597726  }{
\lang2057\langfe1033\langnp2057\insrsid1330505\charrsid8597726 Perhaps the Third Party could have been more pro-active in pursuing replies but there is no }{\lang2057\langfe1033\langnp2057\insrsid11810015\charrsid8597726 certainty}{
\lang2057\langfe1033\langnp2057\insrsid1330505\charrsid8597726  that follow-up correspondence would have changed anything.
\par 
\par There were unforeseen issues that needed to be attended to.}{\lang2057\langfe1033\langnp2057\insrsid8597726  }{\lang2057\langfe1033\langnp2057\insrsid1330505\charrsid8597726 
Requesting a further small contribution ($381) from the Defendant and the need for the }{\lang2057\langfe1033\langnp2057\insrsid11810015\charrsid8597726 caveat}{\lang2057\langfe1033\langnp2057\insrsid1330505\charrsid8597726 
 to be removed by the Defendant both added to the delay.
\par 
\par As a result of the aforegoing I have concluded that as between the Plaintiff and the Defendant the Plaintiff is entitled to vacant possession of the property that is described in paragraph }{\lang2057\langfe1033\langnp2057\insrsid2976244\charrsid8597726 (

Although the Plaintiff has entered into a contract for the sale of the mortgaged property which still subsists, it has at all times been willing to accept payment in settlement of the mortgage debt.

\par As between the Defendant and the Third Party I have concluded that the Third Party has at all times remained willing to honour its agreement to provide a home loan in the sum of $21,000.00.}{\lang2057\langfe1033\langnp2057\insrsid8597726  }{
\lang2057\langfe1033\langnp2057\insrsid1330505\charrsid8597726 The reason why the agreement has not been performed was the unreasonable refusal of th
