The starting point is justified mainly by the level of violence used to commit the robbery. \par \par \hich\af0\dbch\af36\loch\f0 [20\hich\af0\dbch\af36\loch\f0 ]\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 In \hich\af0\dbch\af36\loch\f0 R v. HAC042 of 2004\hich\af0\dbch\af36\loch\f0 , \hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 sente\hich\af0\dbch\af36\loch\f0 nces\hich\af0\dbch\af36\loch\f0 of 8 years and 10 years imprisonment, respectively, \hich\af0\dbch\af36\loch\f0 were imposed by this Court \hich\af0\dbch\af36\loch\f0 for a home invasion robbery where the occupants were threatened \hich\af0\dbch\af36\loch\f0 with knives \hich\af0\dbch\af36\loch\f0 by a group of men at night\hich\af0\dbch\af36\loch\f0 ,\hich\af0\dbch\af36\loch\f0 albeit, no physical \hich\af0\dbch\af36\loch\f0 injury was caused to any occupant. \par \par \hich\af0\dbch\af36\loch\f0 [23]\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 In \hich\af0\dbch\af36\loch\f0 Sta\hich\af0\dbch\af36\loch\f0 te v Semisi Wainiqolo\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 Criminal Case No. HAC008 of 2005\hich\af0\dbch\af36\loch\f0 , Winter J made the following observation: \par \par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid2244425 {\f0\fs24\lang2057\langfe1033\langnp2057\insrsid2244425\charrsid2244425 \hich\af0\dbch\af36\loch\f0 "\hich\af0\dbch\af36\loch\f0 The English authorities emphasized that for robbery with arms offenders might expect a sentence in t\hich\af0\dbch\af36\loch\f0 he order of 13 to 15 years jail.\hich\af0\dbch\af36\loch\f0 "\hich\af0\dbch\af36\loch\f0 \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid2244425 {\f0\fs24\lang2057\langfe1033\langnp2057\insrsid2244425\charrsid2244425 \par \hich\af0\dbch\af36\loch\f0 [24]\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 In \hich\af0\dbch\af36\loch\f0 Rokonabete & \hich\af0\dbch\af36\loch\f0 Ors v State\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 Criminal Case No: HAC 118 of 2007\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 this Court after reviewing cases from England on robbery with violence, said: \par \par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid2244425 {\f0\fs24\lang2057\langfe1033\langnp2057\insrsid2244425\charrsid2244425 \hich\af0\dbch\af36\loch\f0 "\hich\af0\dbch\af36\loch\f0 From these authorities, the following principles emerge.\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 The dominant factor in assessing seriousness for any types of robbery i\hich\af0\dbch\af36\loch\f0 s the degree of force used or threatened. \hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 The degree of injury to the victim or the nature of and duration of threats are also relevant in assessing the seriousness of an offence of robbery with violence.\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 If a weapon is involved in the use or threat of f\hich\af0\dbch\af36\loch\f0 orce that will always be an important aggravating feature. Group offending will aggravate an offence because the level of intimidation and fear caused to the victim will be greater.\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 It may also indicate planning and gang activity.\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 Being the ringleader in\hich\af0\dbch\af36\loch\f0 a group is an aggravating factor.\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 If the victims are vulnerable, such as elderly people and persons providing public transport, then that will be an aggravating factor.\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 Other aggravating factors may include the value of items taken and the fact that an \hich\af0\dbch\af36\loch\f0 offence was committed whilst the offender was on bail. \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid2244425 {\f0\fs24\lang2057\langfe1033\langnp2057\insrsid2244425\charrsid2244425 \par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid2244425 {\f0\fs24\lang2057\langfe1033\langnp2057\insrsid2244425\charrsid2244425 \hich\af0\dbch\af36\loch\f0 The seriousness of an offence of robbery is mitigated by factors such as a timely guilty plea, clear evidence of remorse, ready co-operation with the police, response to previous sentences, personal \hich\af0\dbch\af36\loch\f0 circumstances of the offender, first offence of violence, voluntary return of property taken, playing a minor part, and lack of planning involved.\hich\af0\dbch\af36\loch\f0 " \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid2244425 {\f0\fs24\lang2057\langfe1033\langnp2057\insrsid2244425\charrsid2244425 \par \hich\af0\dbch\af36\loch\f0 [25]\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 I apply these principles to this case. \par \par }{\b\f0\fs24\ul\lang2057\langfe1033\langnp2057\insrsid2244425\charrsid2244425 \hich\af0\dbch\af36\loch\f0 Aggravating Features \par }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid2244425\charrsid2244425 \par \hich\af0\dbch\af36\loch\f0 [2\hich\af0\dbch\af36\loch\f0 6\hich\af0\dbch\af36\loch\f0 ]\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 There are some disturbing aggravatin\hich\af0\dbch\af36\loch\f0 g features present in this case. \hich\af0\dbch\af36\loch\f0 The victims were attacked in the secur\hich\af0\dbch\af36\loch\f0 ity of their homes at night\hich\af0\dbch\af36\loch\f0 while they were asleep.\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 They were threatened with knives and pinch bars. Two of the victims were elderly persons.\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 One of them received physical injuries. \hich\af0\dbch\af36\loch\f0 You said it was not you \hich\af0\dbch\af36\loch\f0 but you\hich\af0\dbch\af36\loch\f0 r \hich\af0\dbch\af36\loch\f0 co-accused who struck the victim and that you had a minimal role in the robberies.\hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 However, I do not consider your culpability is lessened just because you did not strike the victim. You agreed with others to attack homes \hich\af0\dbch\af36\loch\f0 knowing the occupants would be present. You agreed to the use of weapon to threaten your victims.
