Accused\hich\af0\dbch\af12\loch\f0 is \hich\af0\dbch\af12\loch\f0 charged with 19 counts of rape of\hich\af0\dbch\af12\loch\f0 his daughter of 14 years old on several occasions. \par \par \hich\af0\dbch\af12\loch\f0 [2]\hich\af0\dbch\af12\loch\f0 \hich\af0\dbch\af12\loch\f0 It is submitted on behalf of the accused the accused has never jumped bail and the chances of the case being taken up for trial within next 6 months is very remote. \hich\af0\dbch\af12\loch\f0 \hich\af0\dbch\af12\loch\f0 Further in his affidavit accused\hich\af0\dbch\af12\loch\f0 submits that he denies the allegations and that he believes that his wife has instigated his daughter to make a false complaint against him. \par \par \hich\af0\dbch\af12\loch\f0 Further he states that he has no previous convictions and he will live out of his village if bail is granted. \par \par \hich\af0\dbch\af12\loch\f0 [\hich\af0\dbch\af12\loch\f0 3]\hich\af0\dbch\af12\loch\f0 \hich\af0\dbch\af12\loch\f0 State objecting\hich\af0\dbch\af12\loch\f0 to the bail being granted\hich\af0\dbch\af12\loch\f0 states \hich\af0\dbch\af12\loch\f0 that \hich\af0\dbch\af12\loch\f0 the alleged offence is of serious nature and as there is sufficient evidence to result a conviction there is likelihood that the accused may\hich\af0\dbch\af12\loch\f0 not surrender himself to court and will attempt to evade p\hich\af0\dbch\af12\loch\f0 rosecution.\hich\af0\dbch\af12\loch\f0 \hich\af0\dbch\af12\loch\f0 Further State submits that in the interest of the public bail should not be granted. \par \par \hich\af0\dbch\af12\loch\f0 [4]\hich\af0\dbch\af12\loch\f0 \hich\af0\dbch\af12\loch\f0 In terms of section 3 of the Bail Act there is a presumption in favour of bail being granted to an accused but a person who opposes the granting of bail \hich\af0\dbch\af12\loch\f0 may seek to rebut the presumption. \par \par \hich\af0\dbch\af12\loch\f0 [5]\hich\af0\dbch\af12\loch\f0 \hich\af0\dbch\af12\loch\f0 Bail must not be refused unless the court is satisfied as to one or more of the consideration set out in section 19(1) of the Bail Act namely: \par \par }\pard \ql \hich\af0\dbch\af12\loch\f0 The accused is facing a very serious cha\hich\af0\dbch\af12\loch\f0 rge and if convicted will have to serve a lengthy period of imprisonment.
