The majority opinions on counts 1, 2 and 8 and the unanimous op\hich\af0\dbch\af37\loch\f0 inions on counts 4, 5 and 6 are \hich\af0\dbch\af37\loch\f0 that the accused \hich\af0\dbch\af37\loch\f0 is \hich\af0\dbch\af37\loch\f0 not \hich\af0\dbch\af37\loch\f0 guilty. \par \par \hich\af0\dbch\af37\loch\f0 [2]\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 The majority and unanimous not guilty opinions relate to the official corruption charges. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 3\hich\af0\dbch\af37\loch\f0 ]\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 To prove the offence of official corruption the prosecution must lead evidence that the accused being a person employed in the public service received or ask\hich\af0\dbch\af37\loch\f0 ed for any benefit for himself or for others on account for something already done or to be done afterwards in the discharge of his official duties. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 4\hich\af0\dbch\af37\loch\f0 ]\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 Proof of receipt of some benefits alone is not enough to sustain an official corruption charge. \hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 There\hich\af0\dbch\af37\loch\f0 has to be a \hich\af0\dbch\af37\loch\f0 nexus between the receipt of \hich\af0\dbch\af37\loch\f0 benefit and what was done by the accused in the discharge of his official duties as a public servant. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 5\hich\af0\dbch\af37\loch\f0 ]\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 If the nexus is proven beyond a reasonable doubt the accused is guilty of official corruption. \hich\af0\dbch\af37\loch\f0 But if no su\hich\af0\dbch\af37\loch\f0 ch nexus exists or if there is \hich\af0\dbch\af37\loch\f0 a \hich\af0\dbch\af37\loch\f0 reasonable doubt about it then the accused cannot be found guilty of official corruption. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 6\hich\af0\dbch\af37\loch\f0 ]\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 The prosecution relied on the evidence of Nitesh Chand Maharaj to prove counts 1 and 2. The evidence on count 1 i\hich\af0\dbch\af37\loch\f0 s that the accu\hich\af0\dbch\af37\loch\f0 sed\hich\af0\dbch\af37\loch\f0 did not seek any benefit on account of renewing the liquor licence of Toberua Island Resort. The\hich\af0\dbch\af37\loch\f0 evidence is that another member\hich\af0\dbch\af37\loch\f0 of the Liquor T\hich\af0\dbch\af37\loch\f0 ribunal asked for fish when the Tribunal \hich\af0\dbch\af37\loch\f0 visited the Resort to inspect its facilities before the licence was\hich\af0\dbch\af37\loch\f0 renewed. The accused was \hich\af0\dbch\af37\loch\f0 seen receiving \hich\af0\dbch\af37\loch\f0 fish when it was distributed among\hich\af0\dbch\af37\loch\f0 all the\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 Tribunal members by the person who made the arrangement for the \hich\af0\dbch\af37\loch\f0 fish. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 7\hich\af0\dbch\af37\loch\f0 ]\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 T\hich\af0\dbch\af37\loch\f0 he evidence on count 2 is that \hich\af0\dbch\af37\loch\f0 the accused asked for fish and alcohol in January 2007 from Nite\hich\af0\dbch\af37\loch\f0 sh Maharaj while the liquor licence of Toberua Island Resort was renewed in April 2007. Nitesh Maharaj said there was no issue regarding the renewal of the Resort \hich\f0 \rquote \hich\af0\dbch\af37\loch\f0 s liquor licence when he supplied fish and alcohol to the accused.\hich\af0\dbch\af37\loch\f0 He \hich\af0\dbch\af37\loch\f0 said\hich\af0\dbch\af37\loch\f0 he\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 felt obliged to\hich\af0\dbch\af37\loch\f0 comply with the request of the accused because \hich\af0\dbch\af37\loch\f0 the accused\hich\af0\dbch\af37\loch\f0 held a position of authority. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 8\hich\af0\dbch\af37\loch\f0 ]\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 In these circumstances, it is open to the assessors to be left with \hich\af0\dbch\af37\loch\f0 a \hich\af0\dbch\af37\loch\f0 reasonable doubt whether the accused received or asked for a benefit from Nitesh Maharaj o\hich\af0\dbch\af37\loch\f0 n account of renewing the liquor l\hich\af0\dbch\af37\loch\f0 icence of Toberua Island Resort which is an essential element of the offence of official corruption. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 9\hich\af0\dbch\af37\loch\f0 ]\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 The prosecution conceded that no evidence was led on count 4. The assessors have properly rendered not \hich\af0\dbch\af37\loch\f0 guilty \hich\af0\dbch\af37\loch\f0 opini\hich\af0\dbch\af37\loch\f0 ons on this count.}{\f0\fs24\insrsid8480911 \par }{\f0\fs24\insrsid9517697\charrsid8480911 \par }{\f0\fs24\insrsid8480911\charrsid8480911 \hich\af0\dbch\af37\loch\f0 [10\hich\af0\dbch\af37\loch\f0 ]\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 Counts 5 and 6 relate to the evidence of Malakai Ravai of Foster\hich\f0 \rquote \loch\f0 s Group Limited.\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 On three occasions in 2006 Foster\hich\f0 \rquote \loch\f0 s Group \hich\af0\dbch\af37\loch\f0 Limited applied\hich\af0\dbch\af37\loch\f0 for \hich\af0\dbch\af37\loch\f0 Occasional Liquor Licences and were issued by the accused. In the same year, Alumita Ra\hich\af0\dbch\af37\loch\f0 ceva from the Commissioner Central\hich\f0 \rquote \loch\f0 s Office called Malakai Ravai on behalf of the accused and asked for liquor. Malakai Ravai supplied\hich\af0\dbch\af37\loch\f0 the liquor on two\hich\af0\dbch\af37\loch\f0 occasions. Neither Alumita Raceva nor Malakai Ravai in their evidence suggested that the liquor were re\hich\af0\dbch\af37\loch\f0 quested or supplied on account of the accused issuing Occasional Liquor Licences. In these circumstances, it is open to the assessors \hich\af0\dbch\af37\loch\f0 to entertain \hich\af0\dbch\af37\loch\f0 a \hich\af0\dbch\af37\loch\f0 reasonable doubt about the guilt of the accused on counts 5 and 6. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 11\hich\af0\dbch\af37\loch\f0 ]\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 Count 8 relates to Sachin Ram an e\hich\af0\dbch\af37\loch\f0 mployee at the Commissioner Central\hich\f0 \rquote \loch\f0 s Office. The charge is that the accused abused the authority of his office by forcing\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 Sachin Ram to collect waste food from various restaurants during official working hours and that he would sack Sachin Ram if he refu\hich\af0\dbch\af37\loch\f0 sed to follow his directive. Sachin Ram gave evidence of collecting waste food on the directive of the accused during official working hours but he did \hich\af0\dbch\af37\loch\f0 not \hich\af0\dbch\af37\loch\f0 give evidence of any threat by the accused. The only evidence of threat to Sachin Ram is \hich\af0\dbch\af37\loch\f0 in \hich\af0\dbch\af37\loch\f0 the caut\hich\af0\dbch\af37\loch\f0 ion interview of the accused but the accused qualified his answer by saying he was only joking about sacking Sachin Ram if he did not follow his directive.\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 In these circumstanc \hich\af0\dbch\af37\loch\f0 es, the majority not\hich\af0\dbch\af37\loch\f0 guilty opinions are available on the evidence. \par \par \hich\af0\dbch\af37\loch\f0 [\hich\af0\dbch\af37\loch\f0 12\hich\af0\dbch\af37\loch\f0 ]\hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 The \hich\af0\dbch\af37\loch\f0 assessors have expressed unanimous opinions that the accused is guilty on counts 3, 7 and 9. These counts relate to charges of abuse of office arising from \hich\af0\dbch\af37\loch\f0 the \hich\af0\dbch\af37\loch\f0 authorisation of government vehicles \hich\af0\dbch\af37\loch\f0 and deployment of staff during working hours\hich\af0\dbch\af37\loch\f0 by the accused\hich\af0\dbch\af37\loch\f0 to collect liquor for unofficial functions.
