\par By originating summons the plaintiff is now seeking to be indemnified by the defendant in terms of section 6 of the Policy according to its interpretation.
\par 
\par The defendant maintains that section 6 is restricted to the sum of $10}{\lang2057\langfe5129\langnp2057\insrsid12657622\charrsid14506983 ,}{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 000.00 to all claims in one accident.
\par

\par Mr. Nagin submits that section 6 of the Policy does not either apply to restrict the sum of $100,000.00 to all claims in one accident \lquote nor}{\lang2057\langfe5129\langnp2057\insrsid14828975\charrsid14506983  does it apply to passengers\rquote .}{

\par He says that the defendant\rquote s argument that the liability is limited to $100,000.00 \lquote does not make much sense\rquote  when one looks at the Compulsory Third Party Policy where each pas}{
\lang2057\langfe5129\langnp2057\insrsid4281353\charrsid14506983 senger is covered for $4000.00.}{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983  He says that when the Bus Company \'93
purchases additional cover under the Comprehensive Policy it seeks to extend cover of $4,000.00 for each passenger to $100,000.00 for each passenger.\'94

\par Counsel cites authorities to say that the plain and ordinary meaning of the policy must be given effect to (vide }{\b\i\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 New India Insurance Company Limited v Shambhu Prasad FCA }{
\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 Civil Appeal No. 0010 of 1998). He further submits that if there is genuine ambiguity then using the \lquote contra proferentem\rquote 
 rule, that ambiguity must be resolved in favour of the insured (}{\b\i\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 New India Insurance Company Limited v D. Gokal & Company Limited}{

5 of 2001S). This was a case where the insurance company was required under the passenger liability extension of the comprehensive Policy (like the present case) to indemnify the \lquote insured\rquote 
 in relation to a personal injury claim by a passenger in the vehicle.

\par Mr. Nagin submits that the case law referred to by Mr. Haniff in his submissions have no application to this case.
\par 
\par Counsel maintains that in the light of the authorities in this case \lquote each injury to a passenger was a separate accident arising from a separate event but aris}{\lang2057\langfe5129\langnp2057\insrsid4281353\charrsid14506983 
ing from one originating cause.}{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983  Even if section 6 of the Policy applied (but it is strongly submitted that it does not) the limitation there does not limit the Defendant\rquote 
s liability to an aggregate of $100,000.00 but to $100,000.00 to each passenger.\rquote

For the above reasons he submits that the defendant should indemnify the plaintiff in respect of all the claims for personal injury arising out of the accident on 3 May 1996 involving Bus CP433 to the maximum of $100,000.00 in respect of each claim.

 Injuries to several passengers constituted a \lquote series of accidents arising from one event, that is, the overturning of the bus on its side.

\par Therefore, counsel says that the defendant is only liable to a maximum of $100,000.00 in respect of the injuries caused to the passengers of bus Registration No. CP433 arising out of the accident.

\par He submits that the total of any liability of the insurer to indemnify the plaintiff in respect of all claims in respect of or arising out of injuries suffered by the passengers by reason of the bus overturning to its side is limited to $100,000.00.

It is the interpretation of section 6 of Policy No. 0075543 which is in question in this case.

\par I think that if just one passenger was injured the interpretation of section 6 may not have arisen for the amount on the Policy would perhaps have been s}{\lang2057\langfe5129\langnp2057\insrsid4281353\charrsid14506983 ufficient to cover the victim. }{
\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 But because a number of passengers were injured the question for determination is whether the $100,000.00 is l
imited to all the claims in this one accident or is it up to $100,000.00 for each injured person.
\par 
\par }{\b\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 (ii) Objects of personal accident insurance
\par }{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 
\par It is the object of personal accident insurance to provide for payment of a sum of money in the event of the insured sustaining injury.}{\lang2057\langfe5129\langnp2057\insrsid14506983  }{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 
Under \lquote Passenger Risks\rquote  in the Policy (as already stated above), it says that the \lquote Policy extends to cover the insured\rquote 
s liability at law for death or injury to persons (other than persons driving or any relative of the Insured or any employee of the Insured) being in or on the vehicle described herein entering into or alight from such vehicles\rquote .
\par 
\par There is no \lquote definition\rquote  of the word \lquote accident\rquote  in the Policy except what the insurer will pay for \lquote accidental damage\rquote  to the vehicle.
\par 
\par It is the defendant\rquote s contention that the maximum amount payable in respect of the \lquote an accident\rquote  is $100,000.00 in relation to any one accident or series of accidents arising from the one event.
\par 
\par Mr. Haniff referred the Court to a single Judge\rquote s decision in the Canadian case of }{\b\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 Richardson Construction Co v London and Lancashire Guarantee and Accident Co }{
\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 [1939] 2 D.L.R 738 where he says a liability indemnity policy contained a limit of $1,000 \lquote for any one accident or series of accidents }{
\lang2057\langfe5129\langnp2057\insrsid14828975\charrsid14506983 arising out of the one cause ..\rquote }{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 
 He says that this clause is similar to the exclusion clause in issue in this case but this is not so.
\par 
\par The facts in }{\b\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 Richardson}{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983  are as follows (as stated by Mr. Haniff):

\par The Plaintiff was a Construction Company.}{\lang2057\langfe5129\langnp2057\insrsid14506983  }{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 It entered into a contract with th
e Corporation of the City of Toronto for the construction of a bridge.

\lang2057\langfe5129\langnp2057\insrsid4281353\charrsid14506983 used in it must be construed. }{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 On this aspect it is stated as follows in Hals. 3rd Ed. Vol. 22 para 401 (page 212):

\par It is not denied by the defendant that there is the passenger extension liability of $100,000.00.}{\lang2057\langfe5129\langnp2057\insrsid14506983  }{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 But the defendant\rquote 
s contention is that the $100,000.00 is the maximum in respect of each accident whereas the plaintiff says that it is the maximum in respect of each claim by \lquote any passenger\rquote .

\par The question is not what that intention was on the issue when the insurer issued the Policy, but what is that true meaning of what it said.
\par 
\par We are concerned with the plain}{\lang2057\langfe5129\langnp2057\insrsid13129474\charrsid14506983 tiff which is a \lquote bus Company\rquote . }{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 It carries passeng}{
\lang2057\langfe5129\langnp2057\insrsid13129474\charrsid14506983 ers in its buses all the time. }{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 The likelihood of accidents are there and the plaintiff would naturally take out appropr}{
\lang2057\langfe5129\langnp2057\insrsid13129474\charrsid14506983 iate insurance for passengers. }{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 Apart from co
mmon sense, I am sure the parties must have envisaged that more than one passenger is likely}{\lang2057\langfe5129\langnp2057\insrsid13129474\charrsid14506983  to be injured in any accident.}{
\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983  If the defendant did not envi}{\lang2057\langfe5129\langnp2057\insrsid13129474\charrsid14506983 sage this then it should have. }{
\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 More likely than not that it did bear this in mind and took high premium accordingly.
\par 
\par Therefore on the facts of this case, words and phrases in the Policy need to be construed in the context in which they appear as the terms used can take a different meaning depending on the context in which they appear as in the present case.
\par 
\par In these circumstances Mr. Nagin\rquote s argument seems t}{\lang2057\langfe5129\langnp2057\insrsid14506983 o have some merit when he said:

\par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid14506983 {\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 \'93Under the Compulsory Third Party Policy each p}{
\lang2057\langfe5129\langnp2057\insrsid13129474\charrsid14506983 assenger is covered for $4000. }{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 When the Bus Company purchases additional cover under the Comprehensive Policy it seeks to 
extend the cover of $4,000.00 for each passenger to $100,000 for each passenger.\'94

\par In this case if the defendant did not mean to cover each passenger in that amount of $100,000.00 it could and should have said so by appropriate words.}{\lang2057\langfe5129\langnp2057\insrsid14506983  }{
\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 It did not do anything of the kind.

\par In that case one of the vehicles specified in the Policy overturned, and thereby caused injuries to about forty persons and the p}{\lang2057\langfe5129\langnp2057\insrsid13129474\charrsid14506983 laintiffs became liable to pay }{
\lang2057\langfe5129\langnp2057\insrsid14506983 c}{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 ompensation and expenses to the extent of 833l.

\par There the plaintiffs, tramcar company, effected with the defendants an insurance against \'93claims for personal injury in respect of accidents caused by vehicles for twelve calendar months from November 24, 1887\'94 to the amount of \'931500}{

\par There one of the questions for the Court was \'93whether the injury caused to each of the said persons contributed a separate accident within the meaning of the policy\'94.
\par 
\par In my view the answer to that question and to the issue before me lies in the judgment of Lord Esher M.R in }{\b\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 South Stafforshire}{
\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983  (supra \endash  p407) when he said:

For these reasons I think that the plaintiffs are entitled to judgment for the larger amount, and therefore the appeal must be allowed.

pon the assured for injuries, each of whom claims in respect of a specific accident to himself, and not from that of the insurers, and that therefore \'93any one accident\'94 means any accident to any one claimant upon the insured.}{

nguished from the case in hand.}{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983

\par I accept the reasoning behind the Court of Appeal decision in Staffordshire (supra) for there also the wording of the relevant clause resembles very closely the words in the instant case.
\par 
\par }{\b\lang2057\langfe5129\langnp2057\insrsid13129474\charrsid14506983 F. }{\b\lang2057\langfe5129\langnp2057\insrsid6754571\charrsid14506983 CONTRA PROFERENTEM RULE}{\b\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 
\par }{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 
\par Because \lquote contra proferentem\rquote  rule has been introduced in the submission by Mr. Nagin I shall deal with this aspect to see if this Rule applies in this case.
\par 
\par Although looking at the facts and circumstances of this case and applying the rule of construction I do not find any ambiguity in the Policy in regard to the issue, nevertheless, lest there be any doubt}{\lang2057\langfe5129\langnp2057\insrsid14506983  }{
\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 the maxim \lquote verba chartarum fortius accipiuntur contra proferentem\rquote  (called \lquote contra profe}{\lang2057\langfe5129\langnp2057\insrsid13129474\charrsid14506983 rentem\rquote 
 rule) comes into play. }{\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 If it does then, I refer to this hereunder to see how it fits in the circumstances of this case.

\par This contra proferentem rule permits a court to resolve a genuine ambiguity against an insurer which is the author of the contract in dispute.}{\lang2057\langfe5129\langnp2057\insrsid14506983  }{
\lang2057\langfe5129\langnp2057\insrsid9175785\charrsid14506983 This rule is only applicable when there is a genuine ambiguity in a policy and therefore reserved for those cases where the meaning of a word or phrase is entirely unclear.}{

 If a question is in a proposal or the language of a warranty or the wording of a condition or other term in the policy is ambiguous or obscure or unc

So, in this case where several persons are injured, the liability of the insurer is measured by the specified maximum for each injured passenger and the plaintiff (assured) will have no right to claim a larger indemnity in the case of each injured person.
