He reluctantly accepted that 3 months of the term of imprisonment will have been served by the time the appeal is heard.

\par In my view 3 months is a reasonable time to wait before an appeal hearing.}{\fs24\lang2057\langfe1033\langnp2057\insrsid6236332  }{\fs24\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 It is certainly not exceptional.}{
\fs24\lang2057\langfe1033\langnp2057\insrsid6236332  }{\fs24\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 Further serving one sixth of the original sentence before an appeal is heard is unexceptional.}{
\fs24\lang2057\langfe1033\langnp2057\insrsid6236332  }{\fs24\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 I find that section 7(3)(b) and (c) of the Act do not aid the applicants.

I have not had the benefit of receiving the Magistrate Courts file.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 It is at present in preparation for send
ing to the High Court in respect of the substantive appeal.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 
I have however had an opportunity to read the judgment of my sister Justice Shameem.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 
It was this judgment that effectively caused the suspension to be cancelled and immediate sentence of imprisonment to be imposed.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 
I have taken care to read that judgment and find that there are several passages within it that support her honour\rquote s view that suspension of each of these sentences was not appropriate.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{
\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 I refer in particular to page 30 of her honour\rquote s judgment where she simply says \'93this was clearly not an appropriate case for suspension (of imprisonment)\'94.
\par 
\par In the result her honour calls for the case to be sent back to the learned Magistrate for amendment under section 335 of the Criminal Procedure Code.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{
\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 Her honour took this step as in her view the Procedural Provisions limited the High Court Jurisdiction to a determination of the case being stated.}{
\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 Regrettably the case was stated only in relation to suspension of sentence as the State did not quarrel wit
h the length sentence imposed.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 
Given that circumstances her honour could not make any order varying the sentence and could only direct the learned magistrate to amend his sentencing remarks to the effect that there be no suspension.
\par 
\par In this regard I note that the 18 months term of imprisonment was suspended for a period of 3 years from the 1st and 2nd of October, 2002 ie the suspension period would not have expired until the 1st and 2nd of October, 2005.
\par 
\par Counsel for the applicants argues without the benefit of legislative fiat or common law precedent that such an amendment by the learned magistrate must be backdated to the date upon which he originally imposed sentence ie the 1st and 2nd of October, 2002.

\par 
\par The State opposed that argument.
\par 
\par It draws my attention to various passages in Justice Shameem\rquote s judgment that under score her honour\rquote s view that there should have been no suspension of imprisonment.
\par }{\b\f0\ul\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 
\par Decision
\par }{\f0\lang2057\langfe1033\langnp2057\insrsid6236332 
\par }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 In my view it is clear that my sister Justice Shameem found that the magistrate erred in suspending this sentence.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{
\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 I agree with her honour\rquote s observation.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 
There was no basis upon which these violent offenders should have had their immediate sentence of imprisonment postponed.
\par 
\par I reject Mr. Valenitabua\rquote s argument that in amending this sentence the learned magistrate had to backdate the cancellation of suspension and the commencement of a sentence of imprisonment to the original sentencing date.
\par 
\par Counsel was unable to place before me any interpretation of the legislation on the procedure in criminal appeals or the cancellation or variation of suspension to support his argument.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{
\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 He had no case law to support his argument.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 
Rather he said that it was logical that the suspension and commencement of imprisonment would be backdated.
\par 
\par I disagree with him.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 This is a matter that will require fuller consideration and improved argument when it comes on for appeal.}{
\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 
However, in my view there are two matters which indicate that it is correct to impose an immediate sentence of imprisonment when a suspension order is cancelled.
\par 
\par Firstly and procedurally, under section 335 of the Criminal Procedure Code after a successful case stated the High Court sends back the case and file for amendment and the learned magistrate must amend accordingly.}{
\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 The provision continues:}{\f0\lang2057\langfe1033\langnp2057\insrsid13918320 
\par }{\f0\lang2057\langfe1033\langnp2057\insrsid6236332\charrsid6236332 
\par }\pard \s17\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid6236332 {\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 \'93\'85\'85\'85\'85\'85
.and the judgment shall be delivered after it has been so amended or restated.\'94

\par It follows as a matter of logic that the subject judgment is suspended during the period of consideration of the case stated and is \'93delivered\'94 fresh after the magistrate has corrected the error that he fell into.}{
\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 
The effect being that an immediate sentence of 18 months imprisonment starts to run from the point in time when that correct judgment is \'93delivered\'94 after amendment.
\par 
\par Second, it must be remembered that a suspended sentence can be cancelled if there are further offences committed by an accused during the period of the suspension.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{
\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 The legislation provides that on cancellation of the suspension the term of imprisonment should be served immediately in addition to a}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332 
ny penalty for the new offence.}{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 
\par 
\par It follows as a matter of logic that if as a result of a case stated or appeal process suspension of imprisonment is vacated then at that point in time the postponed sentence of imprisonment is resurrected and the offender is liabl
e for an immediate gaol term.
\par 
\par I remind myself that this is a bail application pending appeal and that any assessment on the likelihood of success of the appeal is just exactly that an assessment of likelihood not a prediction or judgment.}{
\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 This must be a test with a low threshold.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{
\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 In these bail applications the appeal case is not to be scrutinized but assessed on its likely outcome.
\par 
\par The burden is on the convicted applicant appellant.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 He must convince the court that it is more likely than not that his appea
l will succeed.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 Each of these applicants has not met that burden in this case.
\par 
\par }{\b\f0\ul\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 Conclusion

\par }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 After taking into account the likelihood of success in the appeal, the likely time before the appeal hearing and the proportion of the original sentence which will 
have been served by the applicant when the appeal is heard.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 
I find there are no exceptional circumstances upon which bail should be granted.}{\f0\lang2057\langfe1033\langnp2057\insrsid6236332  }{\f0\lang2057\langfe1033\langnp2057\insrsid13918320\charrsid6236332 In each case bail is refused.
