\par The Applicant was convicted of the rape of a 19 year old girl on the 8th of February 2001 at the University of the South Pacific.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 
The prosecution called 7 witnesses.
\par 
\par The complainant said that on the 8th of February 2001 she accompanied the Applicant from a house in Flagstaff to the University.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 
He had told her that he was her brother\rquote s friend. At the University compound the Applicant took her into his home, which was unoccupied, and raped her.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{
\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 When he fell asleep, she left and she walked home.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 
She showered but kept her underwear which had stains on them.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 She told her boyfriend what had happened, and she was m

The report states that there were bruises in the vaginal area consistent with the forceful introduction of a blunt object.
\par 
\par There was evidence of recent complaint and distress.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 Under caution the Applicant admitted sexual intercourse but 
said that it was consensual.
\par 
\par The learned Magistrate directed herself on the need for corroboration and correctly said that even without corroboration it was open to her to convict.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{
\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 She considered that the evidence of distress showed the complainant\rquote s consistency and that she was satisfied of the Applicant\rquote s guilt beyond reasonable doubt.

\par The Applicant was sentenced to 5 years imprisonment on the 5th of April, and was told that he had 28 days to appeal.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 
He has 31 previous convictions and a number of pending cases on the date of sentence.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 
On the 16th of April he asked for a copy of the court record, but he was told by the Registry that he did not need it to prepare his appeal because he already had a copy of the judgement and sentence.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }
{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 He was told this on the 6th of May, when his appeal period had already expired.

\par On the 29th of November 2002, the Applicant said he wanted to appeal and asked again for a copy of the record.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 
It appears that he had not received the letter written on the 6th of May.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 The learned 
Magistrate treated this an application for leave to appeal out of time, and minuted on the file \'93He was clearly told on 5.4.02 to appeal.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{
\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 His first application was refused as it was well out of time.\'94 Unfortunately I see no record of a first refusal.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{
\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 I do however find that the Applicant asked on several occasions for the court record but never got a reply.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{
\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 Indeed, the only letter to him after the 6th of May 2003 was one written to him on the 30th of September 2003 informing him that his application for leav
e to appeal out of time was refused with the reasons.

\par On the 24th of November 2003 the Applicant wrote to the Chief Registrar asking for leave to appeal against the refusal of leave by the Suva Magistrates\rquote  Court.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{
\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 For some reason, it was not filed until the 18th of February 2004.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{
\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 It is now almost two years since his conviction and sentence, and four months since he was told that his application for leave was refused by the Magistrates\rquote  Court.
\par 
\par In considering an application to enlarge time, the court must consider whether the Applicant has shown good cause.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 
Relevant matters are: the length of the lapse of time, the reasons for it, whether there are merits in the appeal and the lack of availability of the court record.
\par 
\par In this case, I cannot accept the Applicant\rquote s submission that his lack of legal knowledge was responsible for his failure to file an appeal in time.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{
\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 The Applicant is no stranger to our courts, and no legal knowledge is required to understand the words: \'9328 days to appeal.\'94}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{
\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 In his favour however
 is that he was not told of the decision of the Magistrate to refuse leave until the 30th of September 2003, nor was he invited to attend court when his application was heard.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{
\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 Further, it appears that he continued to ask for the court record and has not been supplied it to this day.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{
\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 
I can understand his frustration because I too was not supplied with the court file despite a written request dated 18th February 2004, until the High Court Registry made a second request while I was on the bench hearing this application.
\par 
\par This is an opportune time to refer to section 347 of the Criminal Procedure Code.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 That section provides:

This is because the Applicant was in custody and was never represented by counsel.

\par I now turn to the question of the merits of the appeal.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 
Of course there are two appeals, one from the refusal to enlarge time, and the other against conviction and sentence.}{\fs24\lang2057\langfe1033\langnp2057\insrsid728038  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7754934\charrsid728038 
In this ruling I am only concerned with the first, although the merits of the substantive appeal are relevant to the refusal to enlarge time.
