\par Mr. Dreu made an application for bail before Justice Shameem in August of this year and it was refused. The court was minded to grant bail because of the delay there would be between arrest and trial. However,
 her Honour refused the application as the accused earlier failed to attend court.

They claimed that the conditions of imprisonment at the remand facility in Korovou Prison, Suva were so poor that their physical and mental health would be affected by a further remand in custody.

\par They claimed that the remand facility conditions continued to breach their non derogable entitlements under the Constitution especially Sections 25 and 27.

\par The conditions were such, they claimed, that they there were subjected to physical, mental, emotional, inhumane and degrading treatment (Section 25).}{\fs24\lang2057\langfe1033\langnp2057\insrsid16389161  }{

It had cracks in the wall and ceiling.}{\fs24\lang2057\langfe1033\langnp2057\insrsid16389161  }{\fs24\lang2057\langfe1033\langnp2057\insrsid7866188\charrsid16389161 I am advised that when it rains water comes in through the window.}{

\fs24\lang2057\langfe1033\langnp2057\insrsid7866188\charrsid16389161 I detected that pieces of the concrete ceiling were rotting and falling into the cell.}{\fs24\lang2057\langfe1033\langnp2057\insrsid16389161  }{

He too suffered a regime of lengthy lockdowns.

a generous and purposive interpretation of section 25 requires that I not only address this bail application in its present sense but also must; if I find there has been a breach of the section; provide a purposive remedy to right the wrong that has been
