\par These are proceedings for committal of the Defendant pursuant to leave granted on 15 August 2001.

\par The Plaintiff\rquote s case is that on 18 January 2000 the Defendant entered into an asset purchase agreement for the purchase of a Nissan 10 wheeler lorry registration number DN 946 valued at approximately at $76,000.}{

\par Having today heard three witnesses called by the Plaintiff as well as the Defendant I am in no doubt whatever that the Defendant has wil
fully disobeyed the order of Byrne J dated 12 June 2001 by failing to return to the Plaintiff approximately $50,000 worth of parts which either he or his agent removed from DN 946.

\par At the beginning of the hearing I suggested to Mr. Kapadia who appeared for the Plaintiff that the value of committing a person in these circumstances is limited.}{\fs24\lang2057\langfe5129\langnp2057\insrsid7020306  }{
