notice}{ \b\i\fs24\insrsid3146206\charrsid9200542 "}{\fs24\insrsid9200542\charrsid9200542 .}{\fs24\insrsid3146206\charrsid9200542 }{\fs24\insrsid9200542\charrsid9200542 Secondly, any other construction would effectively render ex-parte injunction a permanent one, as it would paralyse all applications in the action. \par \par It is not disputed that the order for stay was properly made.}{\fs24\insrsid3146206\charrsid9200542 }{\fs24\insrsid9200542\charrsid9200542 The purpose of the stay was to conserve resources and to save time.}{\fs24\insrsid3146206\charrsid9200542 }{ \fs24\insrsid9200542\charrsid9200542 Justice Byrne considered that it would be pointless to hear two actions if resolution of one might effectively dispose of the other.}{\fs24\insrsid3146206\charrsid9200542 }{\fs24\insrsid9200542\charrsid9200542 This appears to be the reason, which led Justice Byrne to make the order he did.}{\fs24\insrsid3146206\charrsid9200542 }{\fs24\insrsid9200542\charrsid9200542 On page 5 of his decision he said that he agreed with last two paragraphs of third defendant \rquote s submission number of authorities.}{\fs24\insrsid3146206\charrsid9200542 }{\fs24\insrsid9200542\charrsid9200542 Those authorities deal with grant of stay and factors considered in }{ \fs24\lang2057\langfe1033\langnp2057\insrsid9200542\charrsid9200542 granting a stay.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3146206\charrsid9200542 }{\fs24\lang2057\langfe1033\langnp2057\insrsid9200542\charrsid9200542 Those cases are not strictly relevant to the present proceedings since stay has been "}{\fs24\insrsid9200542\charrsid9200542 in the action. \par \par An interlocutory injunction and an application to dissolve it therefore fall within the ambit of the word }{\fs24\insrsid3146206\charrsid9200542 "}{\fs24\insrsid9200542\charrsid9200542 proceedings}{\fs24\insrsid3146206\charrsid9200542 "}{ \fs24\insrsid9200542\charrsid9200542 .}{\fs24\insrsid3146206\charrsid9200542 }{\fs24\insrsid9200542\charrsid9200542 The stay granted therefore extends to the type of application which is before the Court.}{\fs24\insrsid3146206\charrsid9200542 }{ \fs24\insrsid9200542\charrsid9200542 Hence it cannot be heard so long as Justice Byrne\rquote s order dated 23rd July 2002
