It is clear that by making an order by consent the Agricultural Tribunal could not endow the parties with capacity to make a contract outside the scope of s.44 and in breach of the prohibition against contracting out in s.15.\'94

Damages are not always an adequate remedy in a land case such as this, particularly if the land is a litigant\rquote s home and has been so over many years.
