In this case the defendants are being sued as guarantors and they have raised the issue that certain payments were made by Fiji National Provident Fund to

nt of summary judgment will apply.

\par Therefore, the determination of the issue in this application cannot be made without the trial of the action. 
\par 
\par On the affidavit evidence before me and after considering the very useful written submissions from both counsel I am left in the position that there }{\b\lang2057\langfe1033\langnp2057\insrsid1330211\charrsid5394125 ought not }{
