Samisoni has no right of abode either in Fiji or in Australia.

\par Joycelyn is an Australian citizen.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 She has lived with her maternal grandparents for about the last 15 months.}{
\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 The circumstances under which she went to Tonga are not clear.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{
\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 The Respondents say that the Applicant refused to return her to them after they had agreed to allow her to have a short holiday with them.}{

\par The First Respondent has had a difficult past which she told me about.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 She is now 28 years old and describes herself as a student.}
{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 She has altogether 5 children by 4 different fathers.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{
\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 She is either divorced or separated from her first and second husbands.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{
\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 She has been and is living with Joycelyn\rquote s father who himself is married but separated from his wife and who has 4 children by his marriage.}{

\par The First Respondent told me that in about September 2001 she married her second husband in the USA.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 
In November 2001 she left her husband and returned to the Second Respondent who agreed to take her back.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 The Respondents decided t
hat they would settle down permanently, that they would gather all the First Respondents children and bring them all up together as one family.
\par 
\par In about May 2002 the Respondents went to Tonga.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 In the absence of the Applicant and his wife Samisoni and Joy
celyn were removed from their grandparents.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 
What exactly happened next is not entirely clear but it appears that the Respondents brought the children to Suva as a first step towards taking them on to Australia.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{
\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 It will be remembered that Samisoni has no 
right of abode in Australia and it seems that owing to visa and other formal difficulties the Respondents and the 2 children then returned briefly to Tonga.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{
\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 The First Respondent told me that she needed to obtain a copy of the Decree Nisi which recorded that the custody of Samisoni had been awarded to her in 1996.
\par 
\par When the Respondents returned to Tonga the Applicant commenced proceedings in the Supreme Court of Tonga.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 
A copy of the papers filed and orders made in those proceedings is annexed to the affidavit in support of this application.
\par 
\par The Applicants\rquote  case in Tonga essentially was that the 2 children should be returned to them and the Respondents should be restrained from removing them from Tonga because the children were well and happy with their gra
ndparents whereas the First Respondent:

\par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid1583461 {\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 \'93is irresponsible in respect of the care and safety of her children.}{
\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 Her conduct in general is not for the best interest of the children and is affecting their lives adversely in so many ways.}{
\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 She shows no regard to their stability and welfare, physically and emotionally, at present and for their future\'94.

\par On 28 June Mr. Justice Ford granted the orders sought.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 
The Respondents were forbidden to remove the children from Tonga and were ordered to return them to their grandparents.
\par 
\par In paragraph 15 of the supporting affidavit in these proceeding the Applicant states that:

the children .. were taken out of the jurisdiction of the Kingdom of Tonga without the leave of the Supreme Court in defiance of a lawful Court Order prohibiting the Respondents from taking the children our of Tonga\'94.

\par The Applicant now seeks an order of this Court returning the children to Tonga and their grandparents.
\par 
\par The Statement quoted from paragraph 15 of the Applicant\rquote s affidavit is not correct.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 
It is now clear that the Respondents and the children left Tonga on 26 June and that therefore they were already in Fiji and out of Tonga by the time the order of the Supreme Court of Tonga was made.
\par 
\par It is also clear that neither the Applicant nor his wife has any formal custody order in respect of either child in their favour.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 
None of the parties or the children has any connection with Fiji other than as a place of transit.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 
It would therefore be quite wrong for this Court to assume the jurisdiction to make any custody orders in respect of the children.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 
What it is however entitled and right to do is to make such orders as will be in the best interests of the children for the time being.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{
\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 Such orders must necessarily be reflective or the hard facts of the case as they stand at present.
\par 
\par In my view the 2 children need to be considered individua}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461 l}{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 ly.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{
\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 On the one hand Samisoni, now a schoolboy aged 8, is a Tongan citizen who has effectively lived all his life with his grandparents in Tonga.}{
\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 He has never lived with his mother.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{
\fs24\lang2057\langfe5129\langnp2057\insrsid2251625\charrsid1583461 His father\rquote s attitude to these proceedings (even if he is aware of them) is not known.}{\fs24\lang2057\langfe5129\langnp2057\insrsid1583461  }{

I have little doubt that a fresh visa would be forthcoming if that was seen to be in the best interests of the First Respondent and her 2 Australian children.

\par I order Samisoni to be returned to the care of the Applicant forthwith with a view to his immediate return to Tonga.
