was sucked in by the machine. \par \par On search by police accused was found in a drunken state in Suva. \par \par The learned Magistrate convicted him and sentenced him to 12 months imprisonment on each count both concurrent.}{\fs24\lang2057\langfe1033\langnp2057\insrsid7043367 }{\fs24\lang2057\langfe1033\langnp2057\insrsid7043367\charrsid7043367 Additionally he activated an 18}{\fs24\lang2057\langfe1033\langnp2057\insrsid7043367 -}{\fs24\lang2057\langfe1033\langnp2057\insrsid7043367\charrsid7043367 months suspended sentence imposed on him on 18}{ \fs24\lang2057\langfe1033\super\langnp2057\insrsid7043367\charrsid7043367 th}{\fs24\lang2057\langfe1033\langnp2057\insrsid7043367\charrsid7043367 February 2001 on a charge of Housebreaking, Entering and Larceny.}{ \fs24\lang2057\langfe1033\langnp2057\insrsid7043367 }{\fs24\lang2057\langfe1033\langnp2057\insrsid7043367\charrsid7043367 The learned Magistrate activated the sentence after asking the appellant why it should not be activated. \par \par The first ground of appeal is that he was not allowed to mitigate.}{\fs24\lang2057\langfe1033\langnp2057\insrsid7043367 }{\fs24\lang2057\langfe1033\langnp2057\insrsid7043367\charrsid7043367 The records do not bear him out.}{ \fs24\lang2057\langfe1033\langnp2057\insrsid7043367 is without foundation. \par \par The other two grounds are about police conduct and that he was interviewed when suffering from a hangover from drinking.}{\fs24\lang2057\langfe1033\langnp2057\insrsid7043367 }{\fs24\lang2057\langfe1033\langnp2057\insrsid7043367\charrsid7043367 They are irrelevant to the appeal. \par \par Be that as it may, he
