\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471 This finding of fact is correct, but even if it is attacked as being erroneous finding of fact, it could not be }{\b\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471 impugned}{
\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471 .

\par Counsel submitted that there is no error of law in this case.}{\lang2057\langfe1033\langnp2057\insrsid13699471  }{\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471 He argues that }{
\b\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471 Clause 28}{\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471  of the }{\b\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471 Collective Agreement}{
\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471  means that the employer responsible should endeavour to settle the grievance within 48 hours meaning wi
thin 48 hours from the time it is invoked but he says the applicant concealed that it delayed in resolving the grievance because of 19 May 2000 events.

\par Therefore, on the }{\b\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471 first issue}{\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471  counsel submits that the question of construction was authoritatively det
ermined by R1 and his determination is final and conclusive.

\par On the }{\b\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471 second issue}{\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471

The Committee even went further and acted }{\b\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471 ultra vires}{\lang2057\langfe1033\langnp2057\insrsid8003756\charrsid13699471  when it ordered payment of part of JN}{

This will result in the Arbitration Tribunal being burdened with many disputes for resolution.
