For some reason it did not do so but instead applies for summary judgment.

\par Upon reading the affidavits filed herein and considering the submissions of counsel, I find that the defendants have raised a number of triable issues e.g. selling at much less than what the vehicle was worth and that excess interest has been charged.}{
