Mr. Sweetman submits that the application of the Order to an }{\i\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 "Industry which works 24 hours a day seven days a 
week with a clear distinction between the conditions of work and working hours in the crushing season and those in the slack season, was clearly never envisaged by the framers of the legislation, simply because the Sugar Industry has its own Collective Ag
reements spelling out the applicable terms and}{\i\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{\i\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 conditions of employment"}{
\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 .}{\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 These matters form part of the grounds of Appeal.}{

f its Appeal succeeds.

\par Mr. Sweetman submits that there is nothing to stay, but because the Respondent has threatened criminal prosecution by its letter dated 21 January 1998 if the Wages Regulation (Manufacturing Industry) Order 1993 (the "Order") is not 
implemented, it had decided to make the present application for stay of proceedings under Rule 34 of the Court of Appeal Rules which provides:

\par He says that the appellant has pursued its Appeal in a timely and diligent manner.
\par 
\par It is submitted that if the Court considers that this is a coercive judgment which can be executed by the Respondent, then execution must be stayed, otherwise the Appeal is rendered nugatory.
\par 
\par Mr. Sweetman argues that just as under s.}{\f0\lang2057\langfe5129\langnp2057\insrsid1269803  }{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 
123(4) of the Sugar Industry Act the Court or the Tribunal is enabled to make an order that the operation of the whole or part of the Award appealed a
gainst be stayed pending the determination of the Appeal or until further order of the Tribunal or the Court, similarly, the same power exists in relation to an Appeal from High Court to Court of Appeal.
\par 
\par For these reasons the appellant is seeking either an order that there is no need for order for stay of execution or that it order that no further proceedings be taken to enforce the decision of the Tribunal pending the Appeal herein.
\par 
\par }{\b\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 Respondent's submission}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833

\par The learned Counsel for the Respondent submits that the said Order is the written law, as held by this Court, and hence the appellant should comply with its provisions.}{\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{
\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 He says that because the Court's order is merely a "declaratory" order there cannot be any stay hence the application ought to be refused (}{
\b\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 P W Young's}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833  book "}{\b\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 Declaratory Orders}{
\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 "; }{\b\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 The Registration Officer for the Suva City Fijian Urban Constituency v James Michael Ah Koy}{

\par Mr. Nagin further stresses the point that the issue has always been whether the Order applies to the Respondent's workers and not the validity of the Order}{\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{
\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 itself.}{\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 
He concludes by saying that the alleged difficulty in implementing the Order "makes no sense" and says that the benefit of the }{\f0\lang2057\langfe5129\langnp2057\insrsid8004298 '}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 
social legislation' should not be denied the Respondent's members }{\f0\lang2057\langfe5129\langnp2057\insrsid8004298 '}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 when all other workers in the industry are enjoying the benefits'.

\par }{\b\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 Consideration of the issue}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 
\par 
\par The issue for the Court's determination is whether }{\f0\lang2057\langfe5129\langnp2057\insrsid8004298 '}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 a stay of execution or of proceedings' should be granted}{
\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 to the appellant.
\par 
\par I have considered the written and oral submissions made by both Counsel and have given due consideration to the matters raised by them.
\par 
\par There is no doubt that the Tribunal's order, which has been upheld by this Court on Appeal, is declaratory.}{\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 The effec
t of this is, in so far as it is applicable for our purposes, is as stated by }{\b\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 Young}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833  (supra) at p.216 when he said:

\par }\pard \ql \li0\ri0\nowidctlpar\tx-1440\faauto\rin0\lin0\itap0\pararsid14156833 {\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833

"The effect of the court's order is not to create rights but merely to indicate what they have always been....}{\b\i\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{\b\i\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 
Because of this, if an appeal is lodged against a declaratory order, conceptually there can be no stay of proceedings."}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833

\par And at p.3, on the definition of the word }{\f0\lang2057\langfe5129\langnp2057\insrsid8004298 '}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 declaratory' he said:

\par }\pard \ql \li720\ri0\nowidctlpar\tx-1440\faauto\rin0\lin720\itap0\pararsid8004298 {\b\i\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 .....the word "declaratory" is used in apposition to the words "executory", executory orders being
 court orders which are enforceable by execution."}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 
\par }\pard \ql \li0\ri0\nowidctlpar\tx-1440\faauto\rin0\lin0\itap0\pararsid14156833 {\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 
\par I wish to state here that the Appeal decision has not changed the }{\f0\lang2057\langfe5129\langnp2057\insrsid8004298 '}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 declaratory' nature of the Tribunal's Order.
\par 
\par Hence in these circumstances there is nothing to be stayed.}{\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 But because Rule 34(1) allows for stay of }{
\f0\lang2057\langfe5129\langnp2057\insrsid8004298 '}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 proceedings' I would give this aspect of the matter my due consideration.
\par 
\par The appellant has a right of appeal and this is what it is now doing.}{\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 
It has proceeded with the Appeal with due expedition having paid security for costs. It has raised a number of grounds in its appeal which give rise to a determination of point of law.}{\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{
\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 In other words issues of fact and of law are to be addressed as it was before this Court.}{\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{
\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 I am of the view that the appellant has an arguable Appeal and because of the nature of the case a decision by the appellate Court will be in the interest of both parties.}{
\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 
In expressing this view I am not unmindful of the fact that it has taken so long to finalize this matter for one reason or another and it is likely to take a little while longer because of the Appeal to come to some finality.}{
\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 
It is better to allow the application instead of having to refund hundreds of thousands of dollars being arrears of wages if the Appeal is successful despite the further delay that will be caused to the Respondent in finalizing the issue before the Court.

\par It is my view that the principles governing stay of }{\f0\lang2057\langfe5129\langnp2057\insrsid8004298 '}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 proceedings' are the same as in stay of }{
\f0\lang2057\langfe5129\langnp2057\insrsid8004298 '}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 execution'.}{\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 
These principles are fully set out in the notes to Or.59 r.13/1 (}{\b\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 The Supreme Court Practice 1979 p.909}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 ).}{
\f0\lang2057\langfe5129\langnp2057\insrsid14156833  }{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 It states, inter alia, that the Court does not }{\i\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 
"make a practice of depriving a successful litigant of the fruits of his litigation, and locking up funds to which prima facie he is entitled"}{\f0\lang2057\langfe5129\langnp2057\insrsid7362167\charrsid14156833 , pending an appeal. (}{

e tips in favour of the appellant, and its interest needs greater protection than that of the Respondent as it would suffer greater prejudice if stay of proceedings was refused.
