 caters for what has been called }{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid10556191 '}{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 the lower-income earner'}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  by the provision of low cost dwelling-houses on housing estates.

\par In this regard the }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Housing Authority}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 
 as the registered lessee of the land in question seeks vacant possession of the land so as to enable it to develop and subdivide a housing estate on the aforesaid land which is situated at }{
\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Caubati}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 , in the Nasinu area.
\par 
\par More particularly the }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Housing Authority}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 
 seeks to enforce its claim to vacant possession in terms of a }{\b\f0\ul\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Notice to}{\b\f0\ul\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid10556191  }{
\b\f0\ul\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Quit}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 
 dated the 25th of March 1992 which it has served on each of the defendants requiring each of them to deliver up vacant possession within 7 days.}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid10556191  }{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191

\par It is common ground that none of the defendants have complied with the}{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid10556191 '}{
\b\f0\ul\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Notice to Quit}{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 '}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  and all continue to occupy the various parcels of land in question.
\par 
\par Before dealing however with the affidavits filed by the defendants it is significant to note that the physical location of some of the defendant's existing houses falls in many instances across the bound
aries of two or more lots in the proposed sub-division and in some instances on a proposed road or access}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid10556191  }{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 way.
\par 
\par Needless to say in such instances short of re-aligning the proposed boundaries or roadway the defendants' houses must be removed, furthermore si
nce all the defendants houses are randomly scattered throughout the land if their houses were permitted to remain undisturbed, the development of the proposed sub-division would become a}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid10556191  }{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid10556191 '}{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 piece-meal'}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  affair with the inevitable increases in project costs.
\par 
\par Inconvenience to the Authority however no matter how serious or costly is no ground for granting an order for vacant possession if it is not properly brought within the terms of }{
\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Section 169}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 .
\par 
\par I am satisfied however from the affidavits and annexures filed on behalf of the }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Housing Authority}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  in these applications that it has made out a}{\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  prima facie}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  case for vacant possession.
\par 
\par The defendants however have also filed affidavits in an attempt to }{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid10556191 '}{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 show cause'}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  why they are refusing to give up possession of the land.}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid10556191  }{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 In order to do so however }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Section 172}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  of the }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Land Transfer Act}{
\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  (Cap. 131)}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  requires each of the defendants to prove to my satisfaction }{

\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Agricultural and Landlord Tenant Act}{\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  (Cap. 270) (hereafter referred to as }{
\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid10556191 '}{\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 ALTA')}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 
 by an examination of the previous titles to the land which it is undisputed comprised several agricultural leases granted by the}{\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  Lands Department}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  to several of the defendant's predecessors on the land.}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid10556191  }{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191

\par In }{\b\f0\ul\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Lotan v. Douglas Garrick}{\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  Civil Appeal No. 45 of 1984}{

\par }{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 To hold otherwise would be to allow sham defences for the purposes of delay."}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191

\par In this case none of the agricultural leases have been produced but in any event all appear to have been cancelled as from the}{\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  31st of December 1987}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  by an appropriate notice from the }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Director of Lands}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 .

\par Neither have any of the defendants produced appropriate applications under }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 ALTA}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 
 for a declaration of tenancy nor have they described themselves as farmers, cultivators or market gardeners or deposed to practising any form of agricultural husbandry on the land.}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid10556191  }{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Indeed with the exception of a self-e}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid7499872 m}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 ployed defendant all appear to be engaged in one form or other of paid employment quite unrelated to the land which they occupy.
\par 
\par From the paucity of evidence provided I am not at all satisfied that the defendants have established a threshold claim to relief under the provisions of }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 ALTA}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 .
\par 
\par Learned counsel for the defendants quite properly conceded that the defendants were not disputing the plaintiff's title to the land but rather they were looking to the plaintiff to honour the promises made by the }{
\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Director of Lands}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  in his}{
\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  Cancellation Notice}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  where it says}{

\par With all due regard to learned counsel's submission in the absence of }{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid10556191 '}{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 fraud'}{
\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  (which is not alleged)}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  there is no legal basis to support such a submission.}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid10556191  }{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 
In any event the issuance of direct leases was expressly made conditional upon the completion of development works which is precisely what the }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 Housing Authority}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191  is seeking to do on the land.
\par 
\par Then all the defendants have deposed to the }{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 "financial difficulties"}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid13318472\charrsid10556191 
 they are likely to face from having their homes demolished but whilst one can sympathise with their predicament, personal hardship is no reason for refusing an order for vacant possession.
\par 
\par In the result the defendants having failed to establish any right to possession of the land and accordingly there will be an order for possession in the plaintiff's favour.
