\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 "... expired without renewal"}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 .

\par As to the first, it is apparent from the lease document under which the applicant claims title that he himself is a }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 "lessee"}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  of the disputed premises and that he is more accurately described as a }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid6233459 '}{
\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 sub-lessor'}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 
 of the premises to the defendant who in turn is more accurately described as a }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid6233459 '}{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 sub-lessee'}{

\par Of more relevance however is the second requirement of the}{\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  1st limb}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 
 of the paragrap}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid6233459 h set out above namely:}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073 
\par }{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid6233459\charrsid10897316

 from the applicant's solicitors to the defendant requiring him to }{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 "... vacate the (said) premises by 31 May, 1991"}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 .
\par }\pard \ql \li0\ri0\nowidctlpar\tx-720\hyphpar0\faauto\rin0\lin0\itap0\pararsid10897316 {\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 
\par It is common ground that in}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid15671273  }{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 
spite of the letter the defendant did not vacate the premises and continued to occupy it until on or about the}{\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  1st of June 1991}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  when he was }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 "locked-out"}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 .
\par 
\par Thereafter each party sought injunctive relief against the other and on the}{\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  13th of June 1991}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  this Court granted the defendant's application }{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 "... until further order"}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 .
\par 
\par In doing so the c
ourt broadly considered the competing claims to occupy the premises, in particular, the question of the applicant's notice to quit, the unconditional acceptance of the June rent for the premises by the head-lessor's authorised agent and the basis and natu
re of the equitable interest asserted by the defendant.
\par 
\par In the result this Court was satisfied that the preliminary evidence and papers submitted to it}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid6233459 :}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073 
\par }{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid6233459\charrsid10897316 
\par }\pard \ql \li720\ri0\nowidctlpar\tx-720\hyphpar0\faauto\rin0\lin720\itap0\pararsid6233459 {\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 
"... collectively raised serious issues to be tried by the Court for which oral evidence must inevitably be heard if the issues are to be resolved"}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 .}{
\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316

This finding alone would be sufficient for the Court to dismiss the applicant's present summons but in addition learned counsel for the defendant argues that the applicant's evidence before the Court at the time of hearing this application}{
\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  (on the 2nd of August 1991)}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  did not raise a threshold }{
\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 locus}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 .
\par 
\par If I may say so there is some merit in this latter submission in that at the time of first filing this application}{\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  (on the 7th of June 1991)}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  the applicant was undeniably the lessee of the disputed premises under a registered lease dated the 18th of July 1988 }{
\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 "...}{\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  }{
\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 for a term of 3 years beginning on the 1st of July 1988"}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 .
\par 
\par In the absence of any admissible evidence of a renewal of the applicant's lease, it would have expired on the }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 1st of July 1991}{
\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  (}{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 i.e.}{
\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  a month before the actual hearing of this application)}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 
 and although this was foreshadowed in the Court's earlier ruling on the injunction matter, the applicant has not seen fit to plug that evidential}{\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  lacuna}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 .
\par 
\par Needless to say in the absence of a valid exercise of the applicant's option to renew }{\b\f0\ul\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 and/or}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  a valid renewal of the lease, the applicant must be considered to have failed to establish the statutory minimum required by }{
\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 Section 169(c)}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  that he is }{
\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 "a lessor"}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  entitled to issue a}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid6233459  summons for vacant possession.}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 
\par 
\par The applicant's second ground is based on the}{\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  2nd limb}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  of }{
\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 Section 169(c)}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  which envisages the situation where }{
\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 "... the term of the lease has expired"}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 .}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid6233459  }{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 Here the applicant relies on a document dated the 11th of January 1990 entitled}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid6233459 : }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 "}{\b\f0\ul\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 
CONTRACT BETWEEN KAMLESH CHAND AND CHEEWAI FONG}{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 "}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 
 which purports to be an agreement by the applicant to lease the premises to the defendant }{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 
"... for a period of one (1 year) commencing from the 1st of January 1990 ... "}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 .

\par It should be noted that although learned counsel for the applicant argues that the term of the agreement expired without renewal, }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 clause 9}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  of the agreement provides that:

"A further term of 1 year will be considered after completion of the term."}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316

\par Furthermore it is common ground that the defendant was permitted by the applicant to remain on the premises for 4 months and paid rent on a }{\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid6233459 '}{
\b\i\f0\expnd0\expndtw-2\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 ... month to month basis'}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  even after the so-called }{
\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid6233459 '}{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 lease'}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 
 had expired.
\par 
\par The circumstances and terms under which the defendant continued to remain on the premises is of critical importance in determining this case and, in the present state of the pleadings, remains unclear and contr}{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid6233459 o}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 versial}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid6233459  }{
\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 but in any event is not based on any written document.
\par 
\par It is impossible to determine the various issues raised by the conflicting versions at this stage nor would it be appropriate given the nature of those conflicts to resolve them purely on affidavit evidence.
\par 
\par This court is of course mindful of the fact that the defendant presently occupies and conducts a business on the disputed premises without paying anything to the defendant for the use of whose equipment he continues to fully enjoy.
\par 
\par In the exercise therefore of the court's discretion under }{\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 Section 172}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  of the }{
\b\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 Land Transfer Act}{\f0\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316  and without prejudice
 to the final determination of the proceedings the application is dismissed }{\b\f0\ul\expnd0\expndtw-3\lang2057\langfe5129\langnp2057\insrsid5598073\charrsid10897316 on the following conditions}{

\par It is further ordered that all monies paid into court may be released to the applicant as and when it is paid.

res that he has adequately discharged the burden of showing cause why he should not give up possession of the disputed premises at this stage to the applicant.

\par Subject to the defendant complying with the above conditions the application is dismissed with costs to the defendant.
