Hearing the cries of the complainant, some people came towards them.}{\f0\lang2057\langfe5129\langnp2057\insrsid13444460  }{\f0\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460 The accused and his companion dropped her on the ground and ran.

\f0\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460 When the accused was located and questioned he admitted the offence.}{\f0\lang2057\langfe5129\langnp2057\insrsid13444460  }{

\par It is sufficiently clear that the appellant by his declaration desired to have intercourse with the complainant and had that been the only }{\i\f0\lang2057\langfe5129\langnp2057\insrsid13444460 '}{
\i\f0\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460 overt act'}{\f0\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460  alleged against him there could not be said to have been any offence committed, }{
\f0\ul\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460 but}{\f0\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460  by his actions of }{\i\f0\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460 pulling}{
\f0\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460  }{\f0\ul\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460 and }{\i\f0\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460 assaulting}{
\f0\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460  the complainant, the appellant's otherwise innocuous intention becomes manifestly an intent to have intercourse without the complainant's consent and that is an offence.

\par Accordingly the appellant has been properly convicted and his appeal against conviction is dismissed.

\par As for sentence however this was an offence in which the appellant's overt acts (}{\i\f0\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460 in the absence of his declared intention}{

\f0\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460 .}{\f0\lang2057\langfe5129\langnp2057\insrsid13444460  }{\f0\lang2057\langfe5129\langnp2057\insrsid2638695\charrsid13444460 Viewed in that 
light it was not as serious an offence as it first appears in the charge.
