(1) Except as otherwise provided in this Act, every member of the Tribunal shall be appointed for a term not exceeding 3 years, but may from time to time be reappointed. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (2) Unless he o r she sooner vacates office under section 8 of this Act, every member of the Tribunal shall continue in office until his or her successor comes into office, notwithstanding that the term for which he or she was appointed may have expired. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 7. }{\fs24\ul\insrsid13043067\charrsid10691147 Disclosure of interest by Tribunal members}{\fs24\insrsid13043067\charrsid8062676 - (1) A Tribunal member who has a direct or indirect pecuniary or other interest in a matter being considered or about to be considered by the Tribunal shall, as soon as possible after the relevant facts have come to the membe r's knowledge, disclose the nature of the interest at a meeting of the Tribunal. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (2) A disclosure under subsection (1) shall be recorded in the minutes of the meeting of the Tribunal and the member shall not}{\fs24\insrsid10691147 }{\fs24\insrsid13043067\charrsid8062676 - (1}{\fs24\insrsid13043067\charrsid8062676 ) Any member of the Tribunal may at any time be removed from office by the Queen's Representative for inabi}{\fs24\insrsid6621760 lity to perform the functions of}{\fs24\insrsid13043067\charrsid8062676 the office, bankruptcy, neglect of duty, or misconduct, proved to the satisfaction of the Queen's Representative. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (2) Any member of the Tribunal may at any time resign his or her office by giving written notice to that effect to the Minister. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (3) If any member of the Tribunal dies, or resigns, or is removed from office, the vacancy thereby created shall be deemed to be an extraordinary vacancy. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (4) An extraordinary vacancy shall be filled by the appointment of a member by Order in Executive Council. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (5) Every person appointed to fill an extraordinary vacancy shall be appointed for the residue of the term for which the vacating member was appointed. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (6) The powers of the Tribunal shall not be affected by one vacancy in its membership. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 9. }{\fs24\ul\insrsid13043067\charrsid10500276 Meetings}{\fs24\insrsid13043067\charrsid8062676 - (1) Meetings of the Tribunal shall be held at such times and places as the Tribunal or its Chairperson from time to time appoints. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (2) At any meeting of the Tribunal, 2 members shall form a quorum. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (3) The Chairperson shall preside at every meeting of the Tribunal at which he or she is present. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (4) In the absence of the Chairperson from any meeting, the Deputy Chairperson shall preside at that meeting. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (5) A decision of a majority of the members pr esent at any meeting shall be the decision of the Tribunal, and, in the event of an equality of votes, the member presiding shall have a casting vote as well as a deliberative vote. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (6) Subject to the provisions of this Act, the Tribunal may regulate its procedure in such manner as it thinks fit. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (7) No decision or determination of the Tribunal, and no proceeding before the Tribunal, shall be held bad for want of form, or be void or in any way vitiated by reason of any informality or error of form. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 10. }{\fs24\ul\insrsid13043067\charrsid10500276 Members and officers to maintain secrecy}{\fs24\insrsid13043067\charrsid8062676 - (1) Every member of the Tribunal and every person engaged or employed in connection with the work of the Tribunal shall maintain and aid in maintaining the secrecy of all matters which come to his or her knowledge when carrying out his or her functions or duties under this Act, and shall not communicate any such matters to any person except in the discharge of his or her functions and duties under this Act. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (2) Every person who willfully acts in contravention of su bsection (1) commits an offence and shall be liable on conviction to imprisonment for a term not exceeding 3 months or to a fine not exceeding $1,000 or both. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 11. }{\fs24\ul\insrsid13043067\charrsid10500276 Remuneration and travelling allowances}{\fs24\insrsid13043067\charrsid8062676 - (1) The Minister shall be advised of every determination of the Tribunal and shall forthwith present the same to the Queens Representative for promulgation by Order in Executive council. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (2) Every determination of the Tribunal shall take effect upon a date to be specified by Order in Executive Council. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 16}{\fs24\insrsid13043067\charrsid10691147 . }{\fs24\ul\insrsid13043067\charrsid10500276 Release of determinations to Government Statisticians}{\fs24\insrsid13043067\charrsid8062676 - The Tribunal shall release to the Government Statistician such of its determinations as the Government Statistician may require for the purpose of publishing statistics pursuant to the Statistics Act 1966. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid10691147 17. }{\fs24\ul\insrsid13043067\charrsid10691147 Obligation to consult before making determinations about Parliamentary salaries and allowances}{\fs24\insrsid13043067\charrsid8062676 - Before making a }{\fs24\insrsid10691147 determination under section 13(1)(a), the }{\fs24\insrsid13043067\charrsid8062676 tribunal must}{\fs24\insrsid4223992 }{\fs24\insrsid13043067\charrsid8062676 - \par }\pard \ql \li0\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin0\itap0\pararsid8062676 {\fs24\insrsid10500276 \par }\pard \ql \li1440\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin1440\itap0\pararsid10691147 {\fs24\insrsid13043067\charrsid8062676 (i) to the persons or group of persons whose remuneration is being determined; and \par }\pard \ql \li0\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin0\itap0\pararsid8062676 {\fs24\insrsid10500276 \par }\pard \ql \li1440\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin1440\itap0\pararsid10691147 {\fs24\insrsid13043067\charrsid8062676 (ii) to the taxpayer; and \par }\pard \ql \li0\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin0\itap0\pararsid8062676 {\fs24\insrsid10500276 \par }\pard \ql \li720\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin720\itap0\pararsid10691147 {\fs24\insrsid13043067\charrsid8062676 (c) the state of the {\*\xmlopen\xmlns1{\factoidname place}}Cook Islands{\*\xmlclose} economy. \par }\pard \ql \li0\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin0\itap0\pararsid8062676 {\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (2) In determining the remuneration of any persons or group of persons pursuant to section 13(1)(a), the Tribunal shall take into account}{\fs24\insrsid10691147 }{\fs24\insrsid13043067\charrsid8062676 - \par }{\fs24\insrsid10500276 \par }\pard \ql \li720\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin720\itap0\pararsid10691147 {\fs24\insrsid13043067\charrsid8062676 (a) the requirements of the position concerned; and \par }\pard \ql \li0\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin0\itap0\pararsid8062676 {\fs24\insrsid10500276 \par }\pard \ql \li720\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin720\itap0\pararsid10691147 {\fs24\insrsid13043067\charrsid8062676 (b) the conditions of service enjoyed by the persons whose remuneration is being determined, and those enjoyed by the persons or members of the group of persons whose remuneration and conditions of employment are, in the opinion of the Tribunal, comparable with those of the persons or members of the group of persons, whose remuneration is being determined. \par }\pard \ql \li0\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin0\itap0\pararsid8062676 {\fs24\insrsid13043067\charrsid8062676 \par 19. }{\fs24\ul\insrsid13043067\charrsid10500276 Frequency of adjustments}{\fs24\insrsid13043067\charrsid8062676 - (1) Subject to }{\fs24\insrsid10691147 subsection (4), every Order in e}{\fs24\insrsid13043067\charrsid8062676 xecutive Council promulgated pursuant to section 15, shall specify the date on which it expires and shall continue in force at least until the close of that date. The Tribunal may advise the Minister of separate determinations, at different times, for the different positions under the jurisdiction of the Tribunal. The Tribu}{\fs24\insrsid10691147 nal may make a determination bef}{\fs24\insrsid13043067\charrsid8062676 ore or after the date upon which that determination is to come into force. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (2) No determination, o r any part of it, shall come into force earlier than the date of the expiry of the currency of an existing determination being wholly or partially superseded by the first-mentioned determination. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (3) Notwithstanding the expiry of the currency of a determination, it shall continue in force to the extent that it is not superseded by another determination. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (4) Notwithstanding subsection (1) of this section, the Tribunal may at any time while an Order in Executive Council is in force advise the Minister to have the Order amended - \par }{\fs24\insrsid10500276 \par }\pard \ql \li720\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin720\itap0\pararsid10691147 {\fs24\insrsid13043067\charrsid8062676 (a) for the purpose of remedying any defect or removing any ambiguity of the determination; or \par }\pard \ql \li0\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin0\itap0\pararsid8062676 {\fs24\insrsid10500276 \par }\pard \ql \li720\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin720\itap0\pararsid10691147 {\fs24\insrsid13043067\charrsid8062676 (b) to deal with any new matter that was not dealt with at the time of the making of the determination; or \par }\pard \ql \li0\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin0\itap0\pararsid8062676 {\fs24\insrsid10500276 \par }\pard \ql \li720\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin720\itap0\pararsid10691147 {\fs24\insrsid13043067\charrsid8062676 (c) if the Tribunal is satisfied that in all the circumstances there are particular and special reasons that justify a period of less than the term specified in the determination. \par }\pard \ql \li0\ri360\widctlpar\wrapdefault\faauto\adjustright\rin360\lin0\itap0\pararsid8062676 {\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (5) The Tribunal shall review and advise the Minister of a determination for each position that is subject to its jurisdiction at intervals of not more than 3 years. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 20. }{\fs24\ul\insrsid13043067\charrsid10500276 Submissions to Tribunal}{\fs24\insrsid13043067\charrsid8062676 - (1) Any person or any organisation shall be entitled to make written submissions to the Tribunal in relation to the exercise by the Tribunal of its functions under this Act. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid8062676 (2) Where the Tribunal is considering, whether to make a determination in relation to the remuneration of any person or group of persons, the following persons and organisations shall be entitled to make written sub missions and, at their option, oral submissions to the Tribunal, at a time and place and in a manner to be determined by the Tribunal - Where any position is subject to the determination of}{ \fs24\insrsid10691147 the Tribunal under section 13(1}{\fs24\insrsid13043067\charrsid8062676 )(a) and the remuneration for that position is determined by the Tribunal at a rate that is lower than that being lawfully received by the holder of that position, the remuneration of any person holding that position shall not be reduced as a result of that determination. \par }{\fs24\insrsid10500276 \par }{\fs24\insrsid13043067\charrsid10752397 22. }{\fs24\ul\insrsid13043067\charrsid10752397 Powers of Tribunal}{\fs24\insrsid13043067\charrsid10752397 -
