\par }\pard \s34\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14056816 {\insrsid16335043 \par }\pard \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16335043 {\insrsid12744850 (}{\insrsid15234184\charrsid2641192 b) shall not fish or attempt to fish while within the territorial waters of the Cook Islands; \par }\pard \s34\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14056816 {\insrsid16335043 \par }\pard \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16335043 {\insrsid15234184\charrsid2641192 (c) shall not load, unload or tranship any fish while within these limits; \par }\pard \s34\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14056816 {\insrsid16335043 \par }\pard \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16335043 {\insrsid15234184\charrsid2641192 (d) shall stow its fishing gear in accordance with regulati}{\insrsid15023805 ons issued by the Minister; and}{ \insrsid16335043 \par }\pard \s34\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14056816 {\insrsid16259274 \par }\pard \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16335043 {\insrsid15234184\charrsid2641192 (e) shall obey such other regulations as may from time to time be issued by the Minister. \par }\pard\plain \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid2641192 \fs24\lang2057\langfe1033\cgrid\langnp2057\langfenp1033 {\insrsid15234184\charrsid2641192 \par (3) In the event of contravention of this section in the case of a foreign fishing vessel - \par }{\insrsid16335043 \par }\pard\plain \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16259274 \fs24\lang2057\langfe1033\cgrid\langnp2057\langfenp1033 {\insrsid15234184\charrsid2641192 (a) the master}{\insrsid16259274 }{ \insrsid15234184\charrsid2641192 of the foreign fish}{\insrsid12744850 ing vessel shall be liable to a}{\insrsid15234184\charrsid2641192 fine not exceeding $100,000 or imprisonment for a term not exceeding five years or both; \par }\pard \s34\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid12744850 {\insrsid16335043 \par }\pard \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16259274 {\insrsid15234184\charrsid2641192 (b) the Court may on c}{\insrsid2445412 onviction of the master of the }{\insrsid15234184\charrsid2641192 foreign fishing vessel of an offence under this section also order the forfeiture}{\insrsid16335043 }{\insrsid15234184\charrsid2641192 to the Government of the Cook Islands of the foreign fishing vessel and of any fish}{\insrsid16335043 and}{ \insrsid15234184\charrsid2641192 tackle, engines, nets, gear, apparatu}{\insrsid16335043 s,}{\insrsid12744850 cargo and}{\insrsid15234184\charrsid2641192 stores. \par }\pard\plain \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid2641192 \fs24\lang2057\langfe1033\cgrid\langnp2057\langfenp1033 {\insrsid16259274 \par }{\insrsid15234184\charrsid2641192 (4) The }{\insrsid2445412 foregoing}{\insrsid3436074\charrsid2641192 provisions}{\insrsid15234184\charrsid2641192 of this section shall not prohibit or restrict fishing by foreign fishing vessels in areas within the territorial waters of the Cook Islands with}{\insrsid16335043 }{\insrsid3436074 respect to whi}{\insrsid15234184\charrsid2641192 ch }{ \insrsid16335043\charrsid2641192 special}{\insrsid15234184\charrsid2641192 provision for fishing by such vessels is made by any arrangement between the Government of the}{\insrsid16335043 }{\insrsid15234184\charrsid2641192 Cook Islands and the Government of the country in which such vessels are registered or the owners of such vessels. \par }{\insrsid16335043 \par 6. }{\cs50\ul\insrsid15234184\charrsid16335043 Fisheries Protection. Officers}{\insrsid15234184\charrsid2641192 - The following persons shall be Fisheries Protection O}{\insrsid12744850 fficers}{\insrsid15234184\charrsid2641192 for the purposes of this Act, that is to say}{\insrsid16335043 -}{\insrsid15234184\charrsid2641192 \par }{\insrsid16335043 \par }\pard\plain \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16335043 \fs24\lang2057\langfe1033\cgrid\langnp2057\langfenp1033 {\insrsid16335043 (a) }{\insrsid15023805 members of}{\insrsid12744850 the }{ \insrsid15234184\charrsid2641192 Police Force; \par }\pard \s34\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16479724 {\insrsid16335043 \par }\pard \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16335043 {\insrsid15234184\charrsid2641192 (b) officers and employees of the Ministry}{\insrsid16335043 of }{\insrsid15234184\charrsid2641192 Economic S}{ \insrsid12744850 ervices and Natural}{\insrsid15023805 Resources;}{\insrsid16335043 \par }\pard \s34\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16479724 {\insrsid16335043 \par }\pard \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16335043 {\insrsid15234184\charrsid2641192 (c) any other person appointed as a Fisheries Protection Officer by the Minister. \par }\pard\plain \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid2641192 \fs24\lang2057\langfe1033\cgrid\langnp2057\langfenp1033 {\insrsid16335043 \par 7. }{\cs50\ul\insrsid15234184\charrsid16335043 Powers of Fisheries Protection Officers}{\insrsid15234184\charrsid2641192 - For the}{\insrsid16335043 }{\insrsid15234184\charrsid2641192 purposes}{\insrsid16335043 of enforcing the provisions of }{ \insrsid4093695 t}{\insrsid15234184\charrsid2641192 his Act a Fisheries Protection Officer shall have the following powers, that is - \par \par }\pard\plain \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16259274 \fs24\lang2057\langfe1033\cgrid\langnp2057\langfenp1033 {\insrsid15234184\charrsid2641192 (a) he may,}{\insrsid3436074 }{ \insrsid15234184\charrsid2641192 with or without a warrant, stop, board and search any foreign fishing vessel reasonably suspected of being used for the purposes of fishing and may examine any fish on the boat and the equipment of the boat including the fishing gear and r equire persons on the boat to do anything which appears to him to be necessary for facilitating such examination; \par }\pard \s34\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16479724 {\insrsid16335043 \par }\pard \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16259274 {\insrsid15234184\charrsid2641192 (b) where it appears that any contravention of the provisions of this Act has taken place, he may, with or without a warrant, arrest any}{\insrsid16335043 }{\insrsid15234184\charrsid2641192 pers on whom he believes has committed any such contravention, and if the Fisheries Protection Officer arresting that person is not a poli}{\insrsid12744850 ce officer, he shall without un}{\insrsid15234184\charrsid2641192 necessary }{\insrsid12744850 delay make over that person to a}{\insrsid15234184\charrsid2641192 police officer; \par }\pard \s34\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16479724 {\insrsid16335043 \par }\pard \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16259274 {\insrsid15234184\charrsid2641192 (c) where it appears that any co ntravention of the provisions of this Act has taken place, he may, with or without a warrant, seize the}{\insrsid16335043 }{\insrsid15234184\charrsid2641192 fishing vessel in relation to which the contravention took place together with its tackle, engines, nets, gear, apparatus cargo and stores and may take the same and the crew of the fishing vessel to the port which appears to him to be the nearest convenient port and may detain the same and the crew}{\insrsid16335043 }{\insrsid15234184\charrsid2641192 until the completion of pro}{\insrsid3436074 ceedings for any}{\insrsid16335043 contravention;}{\insrsid15234184 \par }\pard \s34\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16479724 {\insrsid16335043\charrsid2641192 \par }\pard \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16259274 {\insrsid15234184\charrsid2641192 (d) where it appears that any fish have been ta ken or are possessed in contravention of this Act, he may seize same and if adequate facilities are not available to preserve}{\insrsid16335043 }{\insrsid15234184\charrsid2641192 such fish pending the completion of proceedings for the contravention, he may take }{\insrsid16335043\charrsid2641192 all}{\insrsid15234184\charrsid2641192 necessary step}{\insrsid16335043 s for the sale of such f}{\insrsid15234184\charrsid2641192 ish}{ \insrsid16335043 }{\insrsid15234184\charrsid2641192 at its reasonable market value, the net proceeds of such sale to be paid to th}{\insrsid3436074 e}{\insrsid15234184\charrsid2641192 Registrar of the High Court}{\insrsid16335043 pending the making o}{ \insrsid12744850 f}{\insrsid16335043 a final }{\insrsid15234184\charrsid2641192 order by the Court in respect of the forfeiture or otherwise of that fund;}{\insrsid15234184 \par }\pard \s34\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16479724 {\insrsid16335043\charrsid2641192 \par }\pard \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16259274 {\insrsid15234184\charrsid2641192 (e) where it appears that any contraven tion of the provisions of this Act has taken place, he may engage in hot pursuit of the vessel or fishing}{\insrsid16335043 }{\insrsid15234184\charrsid2641192 vessel in relation to which the contravention t}{\insrsid12744850 ook place or of its mother ship}{\insrsid15234184\charrsid2641192 , and }{\insrsid12744850 s}{\insrsid15234184\charrsid2641192 uch hot pursuit shall be in accordance with the p}{\insrsid16335043 rovisions of Article 23 of the Convent}{ \insrsid15234184\charrsid2641192 ion}{\insrsid16335043 }{\insrsid15234184\charrsid2641192 of the High Seas signed }{\insrsid12744850 a}{\insrsid15234184\charrsid2641192 t Genev}{\insrsid16335043 a, on 8th day of April 1958, }{ \insrsid15234184\charrsid2641192 which Article 23 is set ou}{\insrsid16335043 t in}{\insrsid15234184\charrsid2641192 the Schedule hereto.}{\insrsid15234184 \par }\pard\plain \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid2641192 \fs24\lang2057\langfe1033\cgrid\langnp2057\langfenp1033 {\insrsid16335043\charrsid2641192 \par }{\insrsid16335043 8. }{\cs50\ul\insrsid16335043\charrsid16335043 Obstruction etc}{\cs50\ul\insrsid13052022 .,}{\cs50\ul\insrsid3436074 }{\cs50\ul\insrsid15234184\charrsid16335043 of Fisheries Protection Officers}{\insrsid15234184\charrsid2641192 - Any person who}{\insrsid16259274 - \par }\pard\plain \s34\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid12744850 \fs24\lang2057\langfe1033\cgrid\langnp2057\langfenp1033 {\insrsid16259274 \par }\pard \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16259274 {\insrsid16259274 (a)}{\insrsid5965580 }{\insrsid15234184\charrsid2641192 wilfully obstructs any Fisheries Protect ion Officer in the exercise of any of his powers under this Act; or \par }\pard \s34\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16479724 {\insrsid5965580 \par }\pard \s34\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16259274 {\insrsid15234184\charrsid2641192 (b) fails to comply with any lawful requirement imposed or to answer any lawful enquiry made by any Fisheries Protection Officer under this Act;
