least one of whom shall be appointed from the private sector being a person who, in the opinion of the Minister possesses suitable knowledge relating to conservation and environmental matters. In the absence of the Chairman the members present shall appoint one of their number to be the Chairman of that meeting. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid10244173\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (2) The first meeting of the Council }{\fs24\lang2057\langfe5129\langnp2057\insrsid10244173\charrsid16739050 shall be }{ \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 held on a da te to be appointed by the Chairman, and subsequent meetings shall be held at such times as the Council may from time }{\fs24\lang2057\langfe5129\langnp2057\insrsid10244173\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (5 ) Every question before a meeting of the Council shall be determined by a majority of valid votes of the members present and, in the case of equality of votes the Chairman shall have a casting as well as a deliberative vote. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid10244173\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (6) Subject to the provisions of this Act and any }{\fs24\lang2057\langfe5129\langnp2057\insrsid10244173\charrsid16739050 regulations }{ \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 made hereunder, the Council may regulate its }{\fs24\ul\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 Minutes of meetings}{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 - (1) The council shall cause }{\fs24\lang2057\langfe5129\langnp2057\insrsid10244173\charrsid16739050 minutes }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 of all meetings to be kept in a book provided for the }{ \fs24\lang2057\langfe5129\langnp2057\insrsid10244173\charrsid16739050 purpose }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 of all resolutions and proceedings at its }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (3) A copy of the minutes of every meeting shall be furnished to every member of the Council. \par \fs24\lang2057\langfe5129\langnp2057\insrsid11237808\charrsid16739050 }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 - Every Council member may be paid out of the public account such remuneration expenses and allowances as may be determined by the Queen's Representative by Order in Executive Council. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid10244173\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 14. }{\fs24\ul\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 Disclosure of conflicting interests}{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 - (1) Any member who, otherwise than in his capacity as a member; is directly or indirectly interested in any arrangement or agreement}{\fs24\lang2057\langfe5129\langnp2057\insrsid10244173\charrsid16739050 }{ \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 entered into or proposed to be entered into by the Council shall, as soon as possible after the relevant facts have come to his this section shall be recorded in the minutes of the meeting and the member shall thereafter not take part in any deliberations or decisions relating to}{ be appointed by the Minister, and shall be the administrative head of the Service who may subject to the consent of the Council exercise such functions and powers as are conferred on the Service. \par being in force relating to the tenure of office of employees of the Cook Islands Public Service, the grounds upon which such employees may be dismissed or suspended, the rights of such employees to appeal against dismissal or suspension, the rights of such employees to apply for other positions in the Cook Islands Public Service, and the rights of such employees to join superannuation schemes administered by the Cook Islands Public Service shall, except as otherwise provided in this Act, apply to the Director and the other officers and employees of the Service as if they were employees of {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 \par (7) Where the Minister has refe rred the draft management plan to the Council under subsection (6) (b), the Council shall consider the Minister's suggestions, and may alter, amend, or vary the draft plan before re-submitting the draft plan to the Minister for his approval. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (8) As soon as practicable after a management plan }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (9) Cabinet may approve and adopt any management plan or refer the plan to the Council for reconsideration and revision. \par force by Order in Executive Council, and the Service shall then manage those areas within the management plan in accordance with that plan. \par if the Conservation Service shall have undertaken work pursuant to section 35(b), the Court may in its discretion, order t he offender to pay to the Conservation Fund all or part of the expenses incurred by the Service in so doing and the amount so awarded shall be deemed to be a judgement debt due to the Service from the offender and may be enforced in any manner in which a judgement or }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 the Director may upon application in writing being made and upon being satisfied that no harm, damage, or injury will be caused to navigation and the environment, and with the consent of the harbourmaster in the case of waters forming part of a harbour for which there is a harbourmaster, permit the deposit of any material in \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 result of a shipping casualty a ship constitutes or is likely to constitute a serious risk of pollution in}{\fs24\lang2057\langfe5129\langnp2057\insrsid16279371\charrsid16739050 or to Cook Islands waters, or to the coast of the Cook Islands or to related interests, then, for the purposes mentioned in }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 subsection (1), he may - \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 issued instructions under}{ \fs24\lang2057\langfe5129\langnp2057\insrsid2897746\charrsid16739050 }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 paragraph (a). \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 {\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (4) In order to carry out any of the }{\fs24\lang2057\langfe5129\langnp2057\insrsid16279371\charrsid16739050 measures }{ \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 referred to in subsection (2)(b) the minister may, after consulting the owner of the ship to whose master the instructions are to be given, - \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 any other ship within Cook Islands waters, }{ \fs24\lang2057\langfe5129\langnp2057\insrsid4545999\charrsid16739050 to }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 render assistance to any ship that is or }{\fs24\lang2057\langfe5129\langnp2057\insrsid4545999\charrsid16739050 is }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 likely}{\fs24\lang2057\langfe5129\langnp2057\insrsid73935\charrsid16739050 to be a shipping casualty; and \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid73935 {\fs24\lang2057\langfe5129\langnp2057\insrsid73935\charrsid16739050 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid73935 {\fs24\lang2057\langfe5129\langnp2057\insrsid73935\charrsid16739050 (b) }{\fs24\lang2057\langfe5129\langnp2057\insrsid4545999\charrsid16739050 to i}{ \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 nstruct the master of any Cook Islands ship take on board any equipment, to sail to any place,}{\fs24\lang2057\langfe5129\langnp2057\insrsid16279371\charrsid16739050 }{ \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 to render assistance to any ships engaged in assisting a shipping casualty or engaged in any operations for the clearing up, removal, or dispersal of any oil or noxious or harmful substance, and to obey the instructions of any person for the time being authorised by the Minister to}{ \fs24\lang2057\langfe5129\langnp2057\insrsid11237808\charrsid16739050 }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 exercise}{\fs24\lang2057\langfe5129\langnp2057\insrsid11237808\charrsid16739050 }{ \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 control}{\fs24\lang2057\langfe5129\langnp2057\insrsid11237808\charrsid16739050 }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 over}{ \fs24\lang2057\langfe5129\langnp2057\insrsid11237808\charrsid16739050 }{\fs24\lang2057\langfe5129\langnp2057\insrsid16279371\charrsid16739050 o}{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 r responsibility for a shipping cas ualty. \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 \par (5) The master or owner of the ship shall be notified of any measures the minister proposes to take under subsection (2)(b): \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 Provided that the Minister may dispense with such notice where in his opinion the urgency of the situation is such that the measures must be taken immediately. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (6) The powers of the Minister under this section to issue instructions under subsection (2)(a) or to take measures under subsection (2)(b) shall be exercisable by any person duly authorised by him. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (7) Any instructi ons issued under this section by the Minister or by any person so authorised shall be served on the persons specified in subsection (2)(a) or, as the case may require, subsection (5). \par {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 "Related interests" includes interests directly affected or threatened, including (but without limiting the generality of this definition) maritime, coastal, port, or estuarine activities (including fisheries activities constituting an essential means of livelihood of the persons concerned), tourist at tractions, public health and welfare, and the conservation of living marine resources and of wildlife; \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 {\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid13436134 {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 "Ship" means every description of vessel (including any boat, barge, craft, or other contrivance) used in or on or under Cook Island waters, without rega rd to the method of or the lack of propulsion; and "Cook Islands ship" means a ship licensed under the laws for the time being in force in the Cook Islands relating to the licensing of ships; \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 {\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql loss, stran ding or abandonment of any ship, or other incident occurring outside any ship or on board any ship or to any ship resulting in material damage or the risk of material damage to any ship or {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (b) require that person to pay to him within 7 days a fine of $10.00; \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 {\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (3) Every -person who is required by a Conservation Officer to pay a fine pursuant to subsection 2(b) - \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid16279371 {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (a) may elect to pay the sum of $10 in which case the Conservation Officer shall upon payment acknowledge in writing the receipt of such sum and that person shall}{\fs24\lang2057\langfe5129\langnp2057\insrsid11237808\charrsid16739050 }{ \fs24\lang2057\langfe5129\langnp2057\insrsid12990700\charrsid16739050 not }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 be liable to pro}{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 secution pursuant to section 48}{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 ; or \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 {\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid16279371 {\fs24\lang2057\langfe5129\langnp2057\insrsid12990700\charrsid16739050 (b) may elect not to pay}{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 the sum of $10 in which case that upon such default, be liable to prosecution under section 48. \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 here a Conservati}{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 on}{\fs24\lang2057\langfe5129\langnp2057\insrsid6769964\charrsid16739050 O}{ \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 fficer has reasonable cause to believe that litter has been deposited (whether inadvertently or otherwise) in a public place or onto private land without the consent of the occupier of that }{ \fs24\lang2057\langfe5129\langnp2057\insrsid8129976\charrsid16739050 private land, the Conservation O}{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 fficer may require the person responsible for so depos}{ \fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 i}{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 ting that litter to provide his name and place of residence. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (5) A Conservation Officer may, if permitted or requested to do so, by the occupier of any private land, enter that land if so required}{ \fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 for the discharge of his duty. \par \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (6) Every person commits an offence who - \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid16279371 {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (a) refuses to remove and dispose of litter when requested by a Conservation Officer pursuant to subsection.(2) (a); or \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid16279371 {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (b) refuse to supply his name and place of residence upon request, \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 {\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 and shall be liable upon conviction to a fine not exceeding $500. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 46. }{\fs24\ul\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 Receptacles to be provided in public places}{ \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 - (1) Every person and Department of State shall at all times provide and maintain in every public}{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 place under his or its control }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 or management where litter is likely to be deposited, such number of litter receptacles, of suitable construction and design for the temporary deposit of litter as may reasonably be necessary to keep the place free from litter. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (2) Where litter generated on or attributable to any particular land or premises is likely to be carried or to otherwise escape from that land or those premises onto a public place a Conservation Officer may require the occupier of the land or premises to take all reasonable steps to prevent such litter being carried or escaping onto the public place. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (3) Where a person or Department of State fails to provide suitable litter receptacles in accordance with subsection (1) or an occupier fails to comply with any proper request of a Conse rvation Officer to take reasonable steps to prevent litter being carried or escaping under subsection (2), a Conservation}{\fs24\lang2057\langfe5129\langnp2057\insrsid1194662\charrsid16739050 O}{ \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 fficer may provide and install those receptacles or take those steps and recover the cost of so doing from the person or Department o f State or occupier as the case may be as a debt due to the Service. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (4) Every person and Department of State shall also make appropriate provision for the emptying of the contents of litter receptacles situated within public places under his or its contr ol or management and for the removal and disposal of those contents. The work shall be executed promptly, efficiently, and at regular intervals. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 47. }{\fs24\ul\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 Conservation officer may require occupier of land to clear litter}{ \fs24\lang2057\langfe5129\langnp2057\insrsid14095899\charrsid16739050 - (1) Any Conservation O}{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 fficer may serve}{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 on the occupier of any land a notice in writing requiring the occupier, to the satisfaction of the Conservation Officer: \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid16279371 {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (a) To clear awa}{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 y, or remove, from the land; or \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid16279371 {\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid16279371 {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (b) To clean up; or \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid16279371 {\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid16279371 {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (c) To screen, cover, or otherwise obscure from view, \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 {\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 such litter as may be specified in the notice within such time as may be so specified. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (2) If, upon the representations of an occupier served with a notice under subsection (1) a Conservation Officer is satisfied that steps have been taken to comply with the requirements of the notice but the occupier has been prevented by reasonable cause from completing the necessary work within the time specified, the Conservation Officer may extend the time specified for such further period as he thinks fit. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (3) Every person receiving a notice under subsection (1) may object to the requirements of the notice within 7 days after its receipt on the grounds that those requirements are unreasonable. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (4) Every object}{\fs24\lang2057\langfe5129\langnp2057\insrsid14700842\charrsid16739050 ion shall be made in writing to}{ \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 the Council, which shall appoint a time and place for hearing the objection, and shall give reasonable notice of that time and}{ \fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 place to the objector who shall be entitled to be present and, if present at that time and place, to be heard. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (5) The Council may, after hearing an obje ction, confirm cancel, or vary the requirements of the notice, and shall, within 7 days after the hearing, give to the objector written notice of its decision. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 48. }{\fs24\ul\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 Deposit of litter in public place}{ \fs24\ul\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 }{\fs24\ul\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 or on private land}{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 - (1) Subject to subsection (2), every person commits an offence and is liable, in the case of an individual, to a fine not exceeding $500 or, in the case of a body corporate, to a fine not exceeding $2,000, who, without reasonable excuse- \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid16279371 {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (a) Deposits any litter in or on any public place or, in the case of any private land, in or on that private land without the consent of its occupier; or \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 {\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid16279371 {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (b) Having deposited any litter (whether inadvertently or otherwise) in or on any public place, or in or on any private land without the consent of its occupier, leaves the litter there. \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 {\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (2) Where any person commits an offence, against subsection (1) and the litter deposited is of such a nature as is likely to endanger any person or to cause physical injury disease or infection t o any person coming into contact with it (being in particular any bottle whether broken or not, glass, article containing glass, sharp or jagged material, or any substance of a toxic or poisonous nature) that person is liable - \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid16279371 {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (a) In the case of an indiv idual, to imprisonment for a term not exceeding 1 month, or to a fine not exceeding $750, or to both; or \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 {\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid16279371 {\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (b) In the case of a body corporate, to a fine not exceeding $5,000. \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid11237808 {\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 49. }{\fs24\ul\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 Wilful breaking of bottles or glass}{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 - Every person commits an offence, and is liable to imprisonment for a term not exceeding 1 month or to a fine not exceeding $750, or to both, who wilfully breaks any bottle, or any glass, or any article made of glass, in or on any public place without l awful authority or without the express consent of the person}{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 or Department of State having the control or management of the public place, or in or on any private land without lawful authority or without the express consent of the occupier of the private land. \par \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 50. }{\fs24\ul\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 Liability of officers of body corporate}{ \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 - If a body corporate commits an offence against this Part, every director, manager, secretary, or other similar officer of the body corporate, and every person purporting to act in any such capacity, shall a lso be guilty of that offence if the act or omission constituting the offence occurred with his knowledge and consent. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 51. }{\fs24\ul\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 Offender may be ordered to clear area}{ \fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 - (1) Without limiting the powers conferred on Conversation Officers by this Act, where any person is convicted of an offence against this Part}{ \fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 ,}{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 the Court may, instead of or in addition to imposing a penalty, order the offender, under the supervision}{ \fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 and to the satisfaction of a person nominated by the Court, to clear up and remove the deposited li tter within such period and to such place as may be specified in the order; and on the making of any such order the Court may further order that, if the offender fails to comply with the order, he is liable, in additi}{ \fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 on to any penalty imposed, to a }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 fine not exceeding $500. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (2) Where the order is complied with to the satisfaction of the person nominated by the Court that person shall give or send to the offender and to the Court, a statement in writing to that effect. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (3) Where an offender fails to comply with any such order, the High Court on the application of the person nominated by the Court to supervise the clearing and removal of the litter, may issue a summons requiring the offender to show cause why the order should not be enforced. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 (4) On the hearing of the summons to show cause, the Court may make such order as it thinks fit. \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid13436134\charrsid16739050 \par }{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 52. }{\fs24\ul\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 Cost of removing litter}{\fs24\lang2057\langfe5129\langnp2057\insrsid7098216\charrsid16739050 - Where a Court convicts a person of an offence against this Part, it may, if it thinks fit, in addition to imposing a penalty, order the offende r to pay by way of compensation to the person or Department of State having the control or management of the public place or, as the case may be, the occupier of the private land where the offence was committed such sum as it considers reasonable to cover the cost of the removal of the litter;
