In \f3\fs24\b0\i1 Puatiki Section 84B3 \f0\fs24\b0\i0\cf5 - \f3\fs24\b0\i1\cf3 Island Hotels Limited, \f0\fs24\b0\i0 Coxhead \f4\fs22\b0\i0 J \f0\fs24\b0\i0 contemplated no commission on the cash consideration, and for 2.5% on annual payments as the bulk of the cash consideration was being paid directly to the \f0\fs24\b0\i0\expnd-1\expndtw-4 landowners.\f4\fs15\up9 2 \f0\fs24\b0\i0\expnd0\expndtw0\up0 Also, annual payments were quite substantial and with over 35 owners, it was submitted that 2.5% commission was a reasonable amount for the Court's time in writing the cheques\expnd2\expndtw10  \f0\fs24\b0\i0\expnd0\expndtw0 out.\f0\fs24\cf3\par\pard\plain\s1\nooverflow\nocwrap\sl240\slmult1\sb8\f0\fs21\b0\i0\par\pard\plain\s4\nooverflow\nocwrap\li159\sl240\slmult1\f5\fs23\b1\charscalex105\cf3 Decision\par\pard\plain\s1\nooverflow\nocwrap\sl240\slmult1\f5\fs33\b1\i0\par\pard\plain\s5\ls1\ilvl0\nooverflow\nocwrap\li163\fi-2\ri196\qj\sl362\slmult1\tx872\f0\fs24\b0\cf3 The submissions by the Crown as to the approach to be taken by the Comt when exercising its discretion under s 492(5)(a) appear entirely appropriate. For application 508/19, the transaction consideration is $350,000 and the 5% commission would be\expnd-7\expndtw-34  \f0\fs24\b0\i0\expnd0\expndtw0 $17,500.\f0\fs24\cf3\par\pard\plain\s1\nooverflow\nocwrap\sl240\slmult1\f0\fs20\b0\i0\par\pard\plain\s1\nooverflow\nocwrap\sl240\slmult1\f0\fs20\b0\i0\par\pard\plain\s1\nooverflow\nocwrap\sl240\slmult1\f0\fs20\b0\i0\par\pard\plain\s1\nooverflow\nocwrap\sl240\slmult1\f0\fs20\b0\i0\par\pard\plain\s1\nooverflow\nocwrap\sl240\slmult1\f0\fs20\b0\i0\par\pard\plain\s1\nooverflow\nocwrap\sl240\slmult1\f0\fs20\b0\i0\par
