1. He claims that the investiture of this title should be carried out at the Palace and on the grounds surrounding. He claims that he has the majority of the Kopu Ariki in support of this decision. He says that there are four }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid2373048 distinct families in the Kopu Ariki, and that the Applicant has the support of three and a quarter of those four families, and that the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6188570 remaining three-quarters suppo}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid14772030 rt the Respondent. His principal}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6188570  c
laim therefore is that on the basis of that significant majority that there is a substantial support in favour of the application which he makes.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14092365

\ltrch\fcs0 \insrsid6505610  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10113220 formalities associated with the investiture itself cannot prejudice in any way the prior }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6505610 proceedings and the }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid12151288 prior investiture}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6505610  of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12151288 R}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6505610 espondent. }{\rtlch\fcs1 \af0 \ltrch\fcs0

e-Tonga away from the Palace and its surrounding grounds. The Applicant wishes to hold her investiture}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4353029  at the Pare-o-Tane Palace and on the grou
nds surrounding. There could well be some significance as to where the investiture is held which could be advantageous to one or other of the parties. These are matters about which the court knows nothing nor upon which there have been any submissions. It
 is not necessary to enquire at }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3822895 this}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4353029  stage as to which is the correct forum for such an investiture. That }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14772030 w}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4353029 ill form part of the litigation which will undoubtedly follow.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6188570

le occurred where both Applicants were granted exemption from an earlier injunction to enable them to separately hold their investitures on the Palace grounds. The }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12871975 
accommodation provided by that exemption enabled both }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12661700 parties to}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12871975  be }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12661700 satisfied}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid12871975 , while at the same time easing the tension }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3822895 and}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12871975  confli}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12661700 
ct which had previously existed. Both parties faithfully kept to the arrangements }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10581821 that}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12661700 
 were made and each vacated that Palace in accordance with the conditions laid down at the time the exemption from the injunction was granted}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12869923 
. Consequently it is appropriate for Mr Manarangi to refer to that particular injunction as, with the benefit of hindsight, all parties were able to satisfactorily carry out}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid89873  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid3822895 their}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid89873  wishes and complete their investitures.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7078675

original injunction that he was instrumental in seeking was not against the Respondent but was agai}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6228443 nst the supporters of both the A}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6169664 pplicant and the Respondent. }
{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10581821 Mr Manarangi was acting for the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10291886 supporters}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10581821  of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6228443 A}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid10581821 pplicant at that}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10895366  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10291886 time, even though the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10895366 
 Applicant had not received official recognition from the family of the support which she now apparently enjoys. The Court believes that that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10291886 is a reasonable submission and that the injunction}{\rtlch\fcs1

was Mr Manarangi who applied for the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12655983 injunction which}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1461248  precluded the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12655983 followers}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid1461248  of the Respondent from }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12655983 completing}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1461248  what they believed were formal ties associated with the investiture which }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid12655983 had}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1461248  been ca}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12655983 rried out the previous day. That 
observation is, of course, quite true. But it is fair to concede that not only was the injunction against the followers of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12416420 Respondent, but also against the followers of the Applicant. There }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5589969 is}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12416420  no suggestion that the Respondent was prevented in any way by the injunction, now the subject of these proceedings from carrying out }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid5589969 the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12416420  investiture that she had arranged}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5589969 
. The investiture was not done at the Palace or in the surrounding grounds, but at the Marae Arai-Te-Tonga selected b}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3822895 u}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5589969 
t the respondent for the purpose of her investiture.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13663095 
 There is therefore a distinction, as pointed out by Mr Manarangi, which the court understands, without in any way making a decision on the formalities carried out at the investiture of the Respondent. The Court has no }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid6307748 details whatsoever of those formalities and the Court believes that it is appropriate that such considerations are quite unne}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8590178 cessary at this stage.}{\rtlch\fcs1 \af0 \ltrch\fcs0

\insrsid5441540 Applicant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8521913  and a serious disadvantage to the Respondent. The Court is not able to really follow that argument.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5441540  It appea}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid5655853 rs, as already stated, that the Respondent selected her Marae fo}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5441540 r the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4076813 investiture, believing}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid5441540  no doubt that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5655853 that}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5441540  was the correct }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5655853 procedure that she wished}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid4076813  to follow. On the other hand the Applicant has decided that she wishes the investiture}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16726503 
 to be done at the Palace and the surrounding grounds. If the Tinomana case was followed, both parties could quite easily have had the investiture at the Palace or surrounding }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8461898 grounds}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid16726503 . The Respondent chose to have her investiture at }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8461898 her}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16726503  Marae and not }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8461898 
the Palace. To that extent I do not believe there is any unfair advantage.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5655853  I}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8461898 n fact it may very well turn out as an advantage to the }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid5203483 Respondent}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8461898 
 in that the Applicant may have selected the incorrect location for the investiture to be undertaken. In other words the Respondent may have selected the correct Marae, and so has that advantage over the Applicant who has selected a different forum for t
he investiture proceedings.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16726503

\insrsid15673290  Finally, Mr Williams challenge}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12520506 s the degree of support that Mr Manarangi claims. Mr Man}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15673290 arangi says that his support is three }{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid5471348 and a quarter out of the four families, and only a three-quarter interest in support of the Respondent. Mr Williams}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15673290  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5471348 
has claimed otherwise and has supported h}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12520506 is claim just the same as Mr Mana}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5471348 rangi has supported the claim }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11349028 with}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5471348  documentation which will have to be considered by the Court}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4213291  in due course.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11349028 
 However I believe that it would be most inappropriate for the court to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1799812 enquire}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11349028  into the allegations and counter-allegations as to support.}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid12848033  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1799812 Especially at this preliminary stage. That is a matter which will have a big }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12848033 impact}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1799812 
 on any decision the Court will have to make.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12848033  I do not propose therefore to make any definite ruling }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12859369 
on either party's support or lack of support. I believe it would be unfair to both parties to at this stage determine some critical analysis of their respective support. Rather I believe it would be better if I simply disregarde}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid12520506 d}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12859369  the alleged support and approached the question on the basi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1912465 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12859369  that the Re}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5118654 spondent has already had her investiture and the Applicant now applies for the opportunity of having her investiture. Once again I believe that the matter is whether or not there will be a breach of the }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13379293 peace, and it is for that reason that I rely heavily on the information provided by the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7078675\charrsid7438286 Inspector of Police}{\rtlch\fcs1 \af0 \ltrch\fcs0

\ltrch\fcs0 \insrsid7078675\charrsid7438286 ranting the original in}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8793680 j}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7078675\charrsid7438286 unction. With the passage of time }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid8793680 the Court believes there would not be a situation similar to that which }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7078675\charrsid7438286 existed when the origi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15614077 n}{\rtlch\fcs1 \af0 \ltrch\fcs0
