s father Tepai, and that he was descended from Oakirangi. He conceded however that Oakirangi never held the Tinomana title; Poi was there any evidence that Tinomana Tepai\hich\af0\dbch\af31505\loch\f0 
 held the Tinomana title as he had on claimed. Significantly however Mr Jonassen still persiste}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16125418 \hich\af0\dbch\af31505\loch\f0 d in claiming that the land wa}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 s Tinomana land; that there was no}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16125418 \hich\af0\dbch\af31505\loch\f0  record of Tepai being Tinomana}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 ; and that he nevertheless claimed as a direct descendant of Tepai\hich\af0\dbch\af31505\loch\f0  while at the same time conceding that Tepai was not Tinomana. He certainly acknowl}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16125418 \hich\af0\dbch\af31505\loch\f0 edged that he had no evidence tha}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 t Tinomana Tepai held the title.

\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 ut" the land that\hich\af0\dbch\af31505\loch\f0  he was applying for - a strange acknowledgement."

The submissions by Mr Holmes now attempts to address what the Court perceived as insufficient evidence to support the claim by Mrs Jonassen.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16125418 \hich\af0\dbch\af31505\loch\f0  He confirmed that his client ".}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 .. seeks title to the entire area\hich\af0\dbch\af31505\loch\f0 
 known as Vairauara-Ki-Uta in Aroarangi." His application relied on the genealogy detailed in Minute Book 2/234, that is Tinomana Te Pai and that the Applicant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12932630\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 
'}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 s "...claim was as direct descendants of Te Pai." At this point it is necessary to confirm that \hich\af0\dbch\af31505\loch\f0 
Mr Jonassen, who gave evidence at the original hearing, was not able to produce evidence that Tinomana Te Pal had ever held the title; and further that while Mr Jonassen was able to refer to his family occupying the adjoining Blocks 88H and 88M, he was no
\hich\af0\dbch\af31505\loch\f0 t\hich\af0\dbch\af31505\loch\f0  able to identify any specific area actually occupied}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11338414 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 in the 106 Block. These concessions and admissions have not assisted the Court }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid16663423 
\hich\af0\dbch\af31505\loch\f0 in making}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0  a decision on the claim presented by Mrs Jonassen.}{\rtlch\fcs1 \af0 \ltrch\fcs0

Of more concern however is the serious conflict of the genealo\hich\af0\dbch\af31505\loch\f0 
gical evidence presented to this Court. By way of example, Mr Holmes in paragraphs 31- 38 of his submissions refers to number of minute books and their references. These are 2/234 to 239; 6/258 to 262; and the journal of the Polynesian Society Volume 26 (
\hich\af0\dbch\af31505\loch\f0 1\hich\af0\dbch\af31505\loch\f0 
917) 59 to 65. However, he claims that the genealogy in Minute Book 6 at page 260 is not accurate. Similarly he says that the genealogy of Oakirangi in Minute Book 6 at page 260 is incorrect. To add further confusion to the conflict of the numerous minute
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 
books referred to, it appears that the evidence in Minute Book 2/234 is also contrary to the evidence in Minute Book 11/185 and to the genealogy referred to as having been compiled by Mr Savage.
\par \hich\af0\dbch\af31505\loch\f0 The Court accepts that there is this conflict and as a result\hich\af0\dbch\af31505\loch\f0 
 it is not possible to make a definitive determination without further evidence as to which is the correct genealogy and as to which genealogy as recorded in the original minute books is to be disregarded or confirmed as inaccurate. Mr Holmes has drawn co
\hich\af0\dbch\af31505\loch\f0 n\hich\af0\dbch\af31505\loch\f0 clusions from this conflicting evidence and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7748897 \hich\af0\dbch\af31505\loch\f0 then bases}{\rtlch\fcs1 \af0 \ltrch\fcs0

 proceed on a "surmise". Nor can it proceed where there is conflict of mute Book evidence without an acceptable explanation as to which}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9519010 \hich\af0\dbch\af31505\loch\f0  evidence should be relied upon.}{

For those obvious reasons the application by Mrs Jonassen cannot be sustained. This is n\hich\af0\dbch\af31505\loch\f0 
ot to say that with further research and investigation this applicant could resolve the uncertainties that have been highlighted and so provide the Court with the necessary evidence that could be further considered at a subsequent Court hearing.

 to the application by Emily Pauka. In evidence she has conceded that Tinomana did not give her the Mataiapo title. Rather she said her family gave it to her. Her claim is similar in some respects to that of Mrs Jonassen - they are both owners in the adjo
\hich\af0\dbch\af31505\loch\f0 i\hich\af0\dbch\af31505\loch\f0 ning 88H }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12545345 \hich\af0\dbch\af31505\loch\f0 and 88M}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7817579 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 
\af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid7817579 \hich\af0\dbch\af31505\loch\f0 Blocks and they bo}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 th believe that}

factor of itself gives them some priority and entitlement}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid7817579 \hich\af0\dbch\af31505\loch\f0  over other applic}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid7817579 \hich\af0\dbch\af31505\loch\f0 n}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 ts. She makes no specific claim based on use and occupation; or on cultivation and planting. As Mr Manarangi has submitted, the issues for d}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid5455607 \hich\af0\dbch\af31505\loch\f0 etermination are the defining of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 
 traditional and permissive occupation. He claims}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid5455607 \hich\af0\dbch\af31505\loch\f0  that his client has the right to t\hich\af0\dbch\af31505\loch\f0 his land and has}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0  not been given any rights. However there is insufficient }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid5455607 
\hich\af0\dbch\af31505\loch\f0 evidence to support Emily Pauka'}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 
s claim to this land. Her claim is contrary to the record of the meeting on 28 July 1976 and any deficiencies in the evidence supporting her claim wer\hich\af0\dbch\af31505\loch\f0 
e not corrected or remedied by the evidence of Mr Raymond Pirangi. For those reasons the evidence as presented cannot sup}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid13777607 \hich\af0\dbch\af31505\loch\f0 
port this application by Emily P}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 auka and is therefore dismissed}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid13777607 .}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0  As stated previously however, the production of relevant evidence or m
\hich\af0\dbch\af31505\loch\f0 aterial in the future may well justify a further application. The applications by Mrs Jonassen and Mrs Pauka are made under }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid14560917 
\hich\af0\dbch\af31505\loch\f0 the provisions of Sections 421 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 and 422 of the Cook Islands Act 1915. Section 422 states as follows

\par \hich\af0\dbch\af31505\loch\f0 I turn now to the third application by Manoa Heather. This .application, unlike the two previously dealt with, both of which sought title to the whole of the land, is limited to part \hich\af0\dbch\af31505\loch\f0 
of the land only, namely an area of 16.7 hectares as shown on Survey Plan 506 dated 14 April 1994. There can be no doubt as to the continuous occupation of this area for a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13777607 \hich\af0\dbch\af31505\loch\f0 
t least 60 years; the uninter}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3999089 \hich\af0\dbch\af31505\loch\f0 rupt}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2578127\charrsid12932630 \hich\af0\dbch\af31505\loch\f0 
ed and unhindered usage of an area of approximately \hich\af0\dbch\af31505\loch\f0 
100 acres of which about 75 percent was rock; that the use of this land was for the whole of this time free from interference or objection by anyone; and the establishment of a quarry since December 1989 at which date interference for the first time occur
\hich\af0\dbch\af31505\loch\f0 r\hich\af0\dbch\af31505\loch\f0 ed.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid3999089 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3999089 \hich\af0\dbch\af31505\loch\f0 I have al}{\rtlch\fcs1 \af0 \ltrch\fcs0

ready determined that the meeting of the owners on 28 July 1976 was of real significance. The historical nature of the meeting held some 19 years ago is important. Tinomana Napa provided the historical background of what he knew of this land a
\hich\af0\dbch\af31505\loch\f0 nd it is recorded in the minutes of that meeting. It is significant that the Tinomana is not party to these proceedings.
