red to a Cook Islands Trust to avoid judgment as alleged in the statement of claim, the Defendants would be unlikely to find any sympathy extended by the Court. I do not find this issue weighs one way or the other in my assessment.

r, the Plaintiff is impecunious and its assets are outside the jurisdiction. The fact that its principal, Mr\~Park, has funds does not mean that they are accessible by the Defendants, although the provision of an undertaking by Mr\~
Park (which has not been provided) would be a factor to be taken into account.

very and inspection. The Defendant is now being timetabled to file a statement of defence. Neither party could give me an estimate of the duration of the trial. The Plaintiff's best estimate was five days to prove every allegation.
