Although we accept that the Judge should have directed the jury that the onus of proof did not rest with the accused and the 
jury needed to be satisfied beyond reasonable doubt that the accused was not absent as he claimed to be, before it could find the accused guilty, the failure to so direct did not lead to a miscarriage of justice. A solid basis for an alibi defence has not
 been made out.
