On an election petition pursuant to s 96 of the Electoral Act 1998 ("the Act") Hillyer J, in the High Court, allowed the petition of the present respondent, disqua\hich\af0\dbch\af31505\loch\f0 lified the previously elected candidate \hich\f0 \emdash

 could be challenged as a point of law which, in our view, it clearly cannot. Questions as to the mandatory or directory nature of the supposed prohibition, particularly in s 6, wer\hich\af0\dbch\af31505\loch\f0 e canvassed}{\rtlch\fcs1 \af0 \ltrch\fcs0

 appellant had had misgivings as to his qualifications to be nominated. It was said that he had consulted the authorities and had been assured that, contrary to earlier advice from officialdom, the Chief Electoral Officer\hich\af0\dbch\af31505\loch\f0 
, after consulting Crown Law Office, ruled that the nomination was in order. Thereafter the poll was conducted with the appellant and the respondent as candidates with the subsequent declaration of the appellant to be elected. We have checked the record a

\hich\af0\dbch\af31505\loch\f0 lodging nominations}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9514690\charrsid9514690 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15891087 \hich\af0\dbch\af31505\loch\f0 was }{\rtlch\fcs1 \af0

\ltrch\fcs0 \insrsid16735838 \hich\af0\dbch\af31505\loch\f0 5th }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 \hich\af0\dbch\af31505\loch\f0 May 1999. Accordingly it would have been too late for his party to ha
\hich\af0\dbch\af31505\loch\f0 ve nominated another candidate in lieu. But it is clear that the question of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15891087 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 
\hich\af0\dbch\af31505\loch\f0 his status vis-a-vis his position as a Crown servant was known to various people during the month of May. At what stage it is not certain. However, by the afternoon of the 20th Ma\hich\af0\dbch\af31505\loch\f0 
y, it was too late for any other candidate to be substituted and indeed, because of the assurance received on the 3}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16735838 \hich\af0\dbch\af31505\loch\f0 1st}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4398872 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 \hich\af0\dbch\af31505\loch\f0 May, the appellant would have believed himself qualified.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid4398872 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 \hich\af0\dbch\af31505\loch\f0 
The electoral office, having so determined, printed the rolls and did all other\hich\af0\dbch\af31505\loch\f0  matters leading up to the election and conducted the same with two apparent qualified candidates. Had the }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid4398872 \hich\af0\dbch\af31505\loch\f0 correct}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 \hich\af0\dbch\af31505\loch\f0  conclusions been reached by the Chief Electoral Officer at an earlier date, when the appellant}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9514690\charrsid9514690 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 \hich\af0\dbch\af31505\loch\f0 s status as a school teacher had been well-kno
\hich\af0\dbch\af31505\loch\f0 wn, his party advisers would doubtless have considered the position and regard may well have been paid even after the 3}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16735838 \hich\af0\dbch\af31505\loch\f0 1st}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid4398872 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 \hich\af0\dbch\af31505\loch\f0 May, to the provisions in s 44 concerning death or retirement of a candidate.
\par \hich\af0\dbch\af31505\loch\f0 It seems likely that an attempt would have been made to\hich\af0\dbch\af31505\loch\f0 
 take advantage of those provisions, for upon a retirement notice being accepted by the returning officer, the election in that constituency is to have been cancelled and a subsequent by-election called with the opportunity of a fresh nomination from the 
\hich\af0\dbch\af31505\loch\f0 a\hich\af0\dbch\af31505\loch\f0 ppellant or from some other member of his party. It is true that in s 44; no comparison is made between the advice by a candidate of retirement }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4398872 
\hich\af0\dbch\af31505\loch\f0 age as against the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 \hich\af0\dbch\af31505\loch\f0 closing date for accepting nominations. However; by a parity of reasoning against the situati
\hich\af0\dbch\af31505\loch\f0 
on relating to death, it would appear that the disappearance from either cause, death or retirement, can occur at any time prior to polling for it would be an obvious recognition of the purposes of the Act that electors wishing to do so should exercise a 
\hich\af0\dbch\af31505\loch\f0 c\hich\af0\dbch\af31505\loch\f0 hoice between properly-nominated candidates. The death of one of these persons at any time prior to the election would bring into play the provision}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid4398872 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 \hich\af0\dbch\af31505\loch\f0 for cancellation and subsequent by-election. If so in respect of death, we see no reason why the same provi
\hich\af0\dbch\af31505\loch\f0 sion would not apply in retirement cases.
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid4398872 \hich\af0\dbch\af31505\loch\f0 We conclude therefore that had the correct conclusion been reached by the Chief Electoral}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 
\hich\af0\dbch\af31505\loch\f0  Officer, as has been reached by the hearing Judge, the appellant and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4398872 \hich\af0\dbch\af31505\loch\f0 his}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690

\hich\af0\dbch\af31505\loch\f0 ; and a subsequent by-election would be in accord with }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4398872 \hich\af0\dbch\af31505\loch\f0 democratic}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 
\hich\af0\dbch\af31505\loch\f0  principles offering a right to constituents to choose.
\par \hich\af0\dbch\af31505\loch\f0 There can be no doubt but that the appellant in this matter was acting in good faith because o\hich\af0\dbch\af31505\loch\f0 
f his attempt to resign prior to nomination: but in effect had not done so. But misunderstanding of his status by the electoral office during May and June led him to being erroneously included in as a candidate but with subsequent disqualification, and re
\hich\af0\dbch\af31505\loch\f0 s\hich\af0\dbch\af31505\loch\f0 ponsibility for this unfo}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15682385 \hich\af0\dbch\af31505\loch\f0 rtunate sequence must, in part,}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid7800984\charrsid9514690 \hich\af0\dbch\af31505\loch\f0  rest with the erroneous decision given by the electoral office officials and their advisers.

\hich\af0\dbch\af31505\loch\f0 so\hich\af0\dbch\af31505\loch\f0 far, therefore, as this appeal is against the declaration by the learned\hich\af0\dbch\af31505\loch\f0  Judge of the sole candid\hich\af0\dbch\af31505\loch\f0 
ature and declaration of the respondent as elected, the events leading up to the election and the mismanagement thereof were, in our view, substantial irregularities in "the proceedings preliminar}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3369913 
\hich\af0\dbch\af31505\loch\f0 y}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 \hich\af0\dbch\af31505\loch\f0  to the polling" as a result of which the election was not \hich\af0\dbch\af31505\loch\f0 
conducted in accordance with the principles laid down in the Act (s 101). To this one must add matters already }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3369913 \hich\af0\dbch\af31505\loch\f0 referred}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid7800984\charrsid9514690 \hich\af0\dbch\af31505\loch\f0  to na}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3369913 \hich\af0\dbch\af31505\loch\f0 m}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 \hich\af0\dbch\af31505\loch\f0 
ely, the omission by the Judge to give reasons for declaring the respondent to have been elected. We accept that to so declare, pa\hich\af0\dbch\af31505\loch\f0 rticularly without }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3369913 
\hich\af0\dbch\af31505\loch\f0 discussion }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7800984\charrsid9514690 \hich\af0\dbch\af31505\loch\f0 of what matters had been taken into account in reaching that decision, was to disenfranchise half the elect}{
