FABRIC OF LAWS MISCELLANEOUS REPEAL ACT 2020
2020, No. 18


AN ACT to repeal various Acts of Parliament and Ordinances and for related purposes.

[Assent and commencement date: 19th August 2020]


BE IT ENACTED by the Legislative Assembly of Samoa in Parliament assembled as follows:


  1. Short title and commencement:

(1) This Act may be cited as the Fabric of Laws Miscellaneous Repeal Act 2020.

(2) This Act commences on the date of assent by the Head of State.


  1. Repeal of Acts and Ordinances:

The following Acts and Ordinances are repealed:

(a) Samoa Act 1921 (NZ);

(b) Samoan Market Ordinance 1927;

(c) Building Alignment Ordinance 1932;

(d) General Laws (No.2) Ordinance 1932;

(e) Law Reform Act 1964;

(f) Asian Development Bank Loan Act 1969;

(g) Hotel Levies Act 1972;

(h) Government Superannuation Act 1972;

(i) National Investment Corporation Act 1981;

(j) Royal Samoan Hotel Act 1984;

(k) Bad Debts Act 1990;

(l) General Wage Increase (Public Officeholders and Public Servants) Act 2001;

(m) Development Loan Authorisation Act 2005;

(n) Loan Authorisation Act 2006;

(o) Loan Authorisation Act 2007;

(p) South Pacific Games (Taxation Incentives) Act 2007;

(q) SEG International Enterprise Act 2011.


  1. Savings and transitional:

(1) The repeal of the Acts and Ordinances in section 2 (‘repealed Acts’) does not affect any rights or liabilities made under the provisions of the repealed Acts, and such rights or liabilities must continue and remain in force until they have been completed or ended.

(2) The repealed Acts continue and must remain in force for the purpose of continuing and perfecting under the repealed Acts an act, matter, or thing, or any proceedings commenced or in progress under them, if there is no substituted provision adapted to the completion of the act, matter, or thing, or proceedings commenced or in progress under the repealed Acts.

(3) A power or act which may be necessary to complete, carry out, or compel the performance of a subsisting contract or agreement lawfully made, entered into, or commenced under the repealed Acts may be exercised and performed in all respects to the completion of that contract or agreement.
