UNITED NATIONS ACT
NO. 1 OF 2002


An Act to confer on the Prime Minister power to make orders to enable Vanuatu to fulfil the obligations undertaken by it under Article 41 of the Charter of the United Nations


Be it enacted by the President and Parliament as follows-


1 Power to make orders to enable effect to be given to Article 41


(1) If, under Article 41 of the Charter of the United Nations, the Security Council of the United Nations calls upon the Government in Vanuatu to apply any measures to give effect to any decision of that Council, the Prime Minister may make such orders as are necessary or expedient for enabling those measures to be effectively applied.


(2) An order is not invalid because it deals with any matter already provided for by any Act, or because of any repugnancy to any Act.


(3) All orders must be laid before Parliament as soon as possible after they are made.


2 Liability for breach of orders


(1) A person who:


(a) commits or attempts to commit, or does any act with intent to commit, any offence against any orders made under this Act; or


(b) counsels, procures, aids, abets, or incites any other person to commit, or conspires with any other person (whether in Vanuatu or elsewhere) to commit, any offence against any orders made under this Act;


is punishable on conviction by the penalty set out in subsection (2).


(2) The penalty is:


(a) in the case of an individual, to imprisonment for not more than 5 years or to a fine not exceeding VT 20,000,000; or


(b) in the case of a body corporate, to a fine not exceeding VT 100,000,000.


(3) The publication in the Gazette of any orders made under this Act is for all purposes deemed to be notice of the order to all persons concerned, and in any prosecution the liability of the accused is to be determined accordingly.


(4) Nothing in this Act or in any orders made under this Act is to be construed or operates as to take away or restrict the liability of any person for any offence punishable independently of this Act, but a person must not be punished twice for the same offence.


3 Commencement


This Act commences on the day on which it is published in the Gazette.

UNITED NATIONS ACT NO. 1 OF 2002


Explanatory Note


This Bill gives the Prime Minister power to make orders to enable Vanuatu to fulfil the obligations undertaken by it under Article 41 of the Charter of the United Nations.


Under this Act, orders will be prepared to give effect to UN Security Council Resolutions dealing with anti - terrorism that have been adopted since 11 September 2001.
