STATUTE LAW (MISCELLANEOUS PROVISIONS)
ACT NO. 8 OF 2018

An Act to provide for the amendments to certain Acts.

Be it enacted by the President and Parliament as follows-

1. Amendment

The following Acts are amended as set out in the Schedule:

(a) Business Licence Act [CAP 249];

(b) Citizenship Act [CAP 112];

(c) Government Act [CAP 243];

(d) Passport Act No. 20 of 2009;

(e) Prevention of Cruelty to Animals Act [CAP 78];

(f) Waste Management Act No. 24 of 2014

2. Repeal of Act

(1) This Act is repealed on the day following the day on which all provisions of this Act have commenced.

(2) The repeal of this Act does not, because of the operation of section 11 of the Interpretation Act [CAP 132], affect any amendments made by this Act.

3. Commencement

(1) Subject to subsection (2), this Act commences on the day on which it is published in the Gazette.

(2) Item 1 commences on 1 January 2019.

1. BUSINESS LICENCE ACT [CAP 249]

Schedule 1 – At the end of Class F

Add

Paragraph 8C(2)(e)

Delete “.”, substitute

“; and

(f) a Police Officer nominated by the Commissioner of Police.”

2. GOVERNMENT ACT [CAP 243]

(a) Section 23A Definitions (section heading)

Repeal the section heading, substitute “22A Definitions”

(b) Sections 23B, 23C, 23D, 23E, 23F and 23G

Renumber the sections as “22B, 22C, 22D, 22E, 22F and 22G”

3. PASSPORT ACT NO. 20 of 2009

Section 4B

Repeal the section.

4. PREVENTION OF CRUELTY TO ANIMALS’ ACT [CAP 78]

After section 7

Insert

“7A Defence

(1) It is a defence to an offence under this Act, if a person is carrying out a regulated livestock management activity and acting in compliance with a prescribed livestock management standard.

(2) For the purposes of this section:

Regulated livestock management activity has the same meaning as required under the Livestock Management Act No. 19 of 2018;

Prescribed livestock management standard means a livestock management standard prescribed by the Regulations under the Livestock Management Act No. 19 of 2018.”

5. WASTE MANAGEMENT ACT NO. 24 OF 2014

Paragraph 44(2)(d)

Repeal the paragraph.
