EDUCATION (AMENDMENT)
ACT NO. 35 OF 2019

An Act to amend the Education Act No. 9 of 2014.

Be it enacted by the President and Parliament as follows-

1. Amendment

The Education Act No. 9 of 2014 is amended as set out in the Schedule.

2. Commencement

This Act commences on the day on which it is published in the Gazette.

SCHEDULE

AMENDMENTS OF EDUCATION ACT NO. 9 OF 2014

1. Title of the Act

Delete “Education Act”, substitute “Education and Training Act”

2. Long title

Delete “and secondary”, substitute “, secondary and tertiary”

3. References to Education Act

A reference in this Act or any other Act or instrument to the “Education Act” is taken to be a reference to the “Education and Training Act”

4. Section 1

Delete “and secondary”, substitute “, secondary and tertiary”

5. Paragraphs 2(a), (b) and (g)

Delete “and secondary”, substitute “, secondary and tertiary”

6. Paragraph 2(c)

After “secondary”, insert “and tertiary”

7. Section 3

Insert in its correct alphabetical position:

“higher education and training means the educational level following the completion of a school providing a secondary education and includes universities as well as institutions that teach specific capacities of higher learning such as colleges, technical training institutes, community colleges, nursing schools, research laboratories and distance learning centres;

primary education means education referred to in subsection 4(1);

tertiary education means education referred to in subsection 4(4);”

8. Section 3 (definitions of Director General, Minister and Ministry)

After “education”, insert “and training”

9. Section 4 (Heading)

Delete “and secondary”, substitute “, secondary and tertiary”

10. At the end of section 4

Add

“(4) Tertiary education refers to levels 1 to 10 prescribed by the Vanuatu Qualification Framework.”

11. Paragraphs 64(3)(a), (b), (c) and (d)

Repeal the paragraphs, substitute

“(a) the President of the Chamber of Commerce and Industries; and

(b) the Vice-Chancellor of the National University of Vanuatu; and

(c) the Commissioner of Labour; and

(d) the Commissioner of the Vanuatu Financial Service Commission; and”
