BROADCASTING AND TELEVISION (AMENDMENT) ACT
NO 11 OF 2003


An Act to amend the Broadcasting and Television Act No. 3 of 1992.


Be it enacted by the President and Parliament as follows-


  1. Amendments

The Broadcasting and Television Act No. 3 of 1992 is amended as set out in the Schedule.


  1. Commencement

This Act commences on the day on which it is published in the Gazette.


SCHEDULE


AMENDMENTS OF THE BROADCASTING AND TELEVISION ACT
NO. 3 OF 1992


1 Section 1


Insert the following definition in its correct alphabetical position


Minister means the Minister responsible for broadcasting and television.”.


2 Subsection 3(6)


Repeal the subsection.


3 Subsection 3(7)


Repeal the subsection, substitute:


“(7) The Minister may remove the Chairman, Deputy Chairman and any member of the Corporation if he or she:


(a) is incapacitated by physical and mental illness; or


(b) has performed unsatisfactorily for a significant period of time; or


(c) is convicted of an offence involving dishonesty or fraud; or


(d) is absent from 4 consecutive meetings of the Corporation unless the member is excused by the Corporation for having been absent from those meetings; or


(e) becomes bankrupt; or


(f) is otherwise unfit or unable to discharge the functions of a member.”.


4 Paragraph 11(2)(i)


Delete all the words from and including “, gramophone” to and including “(including tapes”, substitute “and records (including compact discs and tapes”.


5 Subsection 12(1)


Repeal the subsection, substitute


“(1) The Corporation must, with the approval of the Minister, appoint as General Manager a competent and qualified person experienced in the field of management and, if possible, broadcasting, finance, law or journalism.”.


  1. Subsections 3(1), (2),(4) and (5), subsection 4(1), section 9 and subsections 12(5) and (6)

Delete “Prime Minister” (wherever occurring), substitute “Minister”.
