Plant Protection (Control of Quarantine Pest)

PLANT PROTECTION (CONTROL OF QUARANTINE PEST)

Order 20 of 1999


An Order to control the movement of the quarantine pest Achatina fulica (“Giant African Snail”) from the area of infestation on the Island of Tanna.


1. Interpretation
In this Order, unless the context otherwise requires –


“Achatina fulica” means the quarantine pest which is commonly known as the Giant African Snail;


“craft” includes any conveyance used or capable of being used for carrying people by air, or sea, and any shipping container;


“goods” means any kind of moveable property;


“plant material” means any goods that are wholly or partly derived from a member of the plant kingdom or its excretions or secretions;


2. Movement of plant material, goods and crafts
(1) No plant material, goods or craft suspected of carrying the quarantine pest Achatina fulica is to be moved out of the controlled area.


(2) Any movement of plant material, goods or craft from the controlled area shall be authorised by an officer of the Vanuatu Quarantine and Inspection Service.


3. Offence to move plant material, goods and crafts
Any person who moves or causes to move any plant material, goods or craft from the controlled area is in breach of this Order and will have committed an offence under section 22 of the Plant Protection Act [Cap. 239].


4. Controlled area
(1) The area delineated on the map in the Schedule to this Order is the controlled area.


(2) This Order applies to the controlled area.
