Preservation of Sites and Artifacts (Yasur Volcano)

PRESERVATION OF SITES AND ARTIFACTS (YASUR VOLCANO)


Order 12 of 1993
Order 38 of 1997


To provide for the classification of the Yasur Volcano on Tanna.


1. Interpretation
In these Regulations, unless the context otherwise requires:


“Act” means the Preservation of Sites and Artifacts Act [CAP. 39];


“Council” means the Council of Chiefs of Tanna.


2. Yasur Volcano to be a preserved site
(1) The areas delineated in bold lines on the map in the schedule hereto including the Yasur Volcano shall be a preserved site.


(2) Notwithstanding anything in subregulation (1), the customary practise of collecting wild cane for traditional houses within the preserved site by the communities living within and around the reserve shall continue until such time when the Minister may by notice state otherwise.


3. Management authority
(1) The general management and control of the Yasur Volcano, including the exclusive right to provide amenities of any kind, shall be vested in the Council.


(2) Subject to subregulation (1), the Council shall incorporate a Trust to be known as the Nengau Entany Trust to manage the Yasur Volcano on a commercial basis for the benefit of the people of Tanna.


(3) (a) The composition and structure of the Trust which is set up in accordance with subregulation (2) shall be composed the people of whitesands each of whom shall represent each of those portions of land adjoining the Yasur Volcano shown as land portion Nos. 50, 51, 52, 56, 57, 64, 68, 70 and 71 in the Schedule to these Regulations.


(b) The composition of the Trust shall be subject to the approval of the Minister.


(4) The Council shall submit −


(a) an annual financial report; and


(b) an annual report on the operations of the Council,


to the Minister.


5. Rules
The Council may make rules providing for –


the proper management and control;


the control (including prohibition) of building, trading or advertising;


the fees or charges payable in connection with the visit or the use of any facilities provided at,


the Yasur Volcano.
