Municipal Council (Payment of Gratuities)

MUNICIPAL COUNCIL (PAYMENT OF GRATUITIES)

Order 55 of 2005

To provide for the payment of gratuities to Mayors, Deputy Mayors and councillors of Municipal Councils.

1. Interpretation
In this Order unless the context otherwise requires:

“Act” means the Municipalities Act [Cap. 126];

“Councillor” means an elected member of the Council.

2. Gratuity Payments
(1) Subject to the provisions of this Order, the Municipal Council must pay to each of its Councillors on the15^th day of December each year, gratuities. The amount of gratuity due for payment covers the full calendar year including the month of December and shall be paid according to the amounts specified below:

(2) If a Councillor ceases to hold office due to any of the circumstances provided for under section 10 of the Act, the amount of gratuity payable to the Councillor shall be calculated as follows:

Gratuity per year = MDA x 2 x 252 WD

Where: MDA = Maximum Duty Allowance
WD = Working Days
CA = Calendar Year
