Civil Aviation (Aircraft Parking Fees) Regulations

CIVIL AVIATION (AIRCRAFT
PARKING FEES) REGULATIONS

To provide for fees in respect of parking of aircraft at Bauerfield and Pekoa international airports.


1. Interpretation

In these regulations, unless the context otherwise requires −


“airports" means Bauerfield International Airport and Pekoa International Airport;


"period of parking" means the period of time between the landing and departure of an aircraft at the airports;


"standard landing fees" means the fees prescribed by the Civil Aviation (Aircraft Landing Fees) Regulations;


"standard night landing fees" means the fees prescribed by the Civil Aviation (Special Landing and Take-Off Fees) Regulations.


2. Charge

(1) There shall be charged parking fees in respect of every aircraft of maximum certified take-off weight exceeding 5,700 kg which is parked at the airports for a period exceeding 12 hours.


(2) The parking fee or fees shall be payable by the owners or charterers of the aircraft.


3. Parking fees

(1) The parking fee for all aircraft of 5,700 kg of maximum take-off weight or more when parked for a period of more than 2 hours shall be −


(a) In the case of winged aircraft, 14 per cent of the standard landing fee per hour of parking thereafter;

(b) in the case of helicopters, 14 per cent of half the standard landing fee per hour of parking thereafter;

(c) in the case of both winged aircraft or helicopter parking overnight, 7 per cent of the standard landing fee plus the fees relating to outside normal operations hours.

(2) The parking fee for all aircraft of less than 5,700 kg maximum take-off weight when parked for more than 28 consecutive days in areas not approved as long term parking sites shall be VT 100 per whole day for the first 28 days taken from the date of the aircraft’s last flight, and thereafter the parking fee shall be VT 500 per day of parking.


(3) The parking fee for all aircraft parked at approved long term parking sites shall be VT 50 per day of parking taken from the date when the aircraft was first parked at the site.


(4) Parking fees under these Regulations do not apply to aircraft parked in a hangar or on the hangar apron undergoing maintenance.

5. Method of payment

The fees herein provided shall become due immediately after the arrival or prior to the departure of an aircraft and shall be payable on behalf of the owner or charterer by the captain of the aircraft to an authorised officer of the Government at the airports:


Provided that arrangements may be made between the owner or charterer of an aircraft and the Director of Civil Aviation for parking fees to be paid on a monthly-parking basis.

6. Fees to be recovered as a civil debt

The Government shall recover any fees not paid either wholly or partly within 30 days from their due dates as civil debts.
