RATING VALUATION (ENTRY ON PREMISES)


To enable authorised persons to enter on private land for the purpose of preparing valuation lists.


ENTRY ON LAND FOR RATING VALUATION


  1. It shall be lawful for members of the Survey Department who have been authorised in writing by the Minister responsible for land and such other persons as have been authorised by the Minister to enter upon any land or premises in Port Vila and Luganville for the purpose of preparing valuation lists of properties in the municipalities of Port Vila and Luganville.

NOTICE OF ENTRY


  1. (1) Any authorised person may without giving notice enter on any land (including any part of a building) over which the public normally have access.

(2) Any authorised person may enter land forming part of the curtilege or gardens of a dwelling-house without giving prior notice of his intention so to do to the owner or occupier thereof, but he shall, if the owner or occupier is present at the time of such entry, first seek the permission of the owner or occupier before carrying out any work, and shall comply with any reasonable conditions imposed by him.


(3) No authorised person may enter any private building or dwelling-house without having first given at least 3 days notice of his intention to do so. When inside such building or dwelling house he shall comply with any reasonable conditions imposed by the owner or occupier.


OFFENCES


  1. Any person who shall assault, molest or wilfully hinder or obstruct any person authorised to enter land and premises in accordance with section 1 shall commit an offence punishable upon conviction by a fine not exceeding VT40,000.
